3-B. CONSIDERATION OF A RESOLUTION TO ADOPT GUIDELINES FOR BATCH

BROADBAND PERMIT PROCESSING OF WIRELESS TELE -

COMMUNICATIONS FACILITIES

Government Code § 65964.3 requires cities to use “batch broadband permit processing” when they: (1) receive two or more broadband permit applications for “substantially similar broadband project sites;” (2) applications are submitted at the same time; and (3) by the same applicant.

Government Code § 65964.3 defines “substantially similar broadband project sites” as “broadband project sites that are nearly identical in terms of equipment and general design, but not location.” It does not, however, define what the phrase “nearly identical in terms of equipment and general design, but not location” means.

The proposed Resolution would, if adopted, establish guidelines defining what the phrase “nearly identical in terms of equipment and general design, but not location” means.

CEQA (California Environmental Quality Act):

The proposed Resolution is exempt from additional environmental review under the California Environmental Quality Act (California Public Resources Code §§ 21000, et seq., “CEQA”) and CEQA regulations (14 California Code of Regulations (“CCR”) §§ 15000, et seq.) because it establishes guidelines for batch broadband permit processing of wireless telecommunications facilities, which does not involve any commitment to a specific project which could result in a potentially significant physical impact on the environment; and constitutes an organizational or administrative activity that will not result in direct or indirect physical changes in the environment. Accordingly, this Resolution does not constitute a “project” that requires environmental review (see specifically 14 CCR § 15378(b)(4-5)).

Action Taken: The City Council adopted Resolution No. 2024- R34 establishing guidelines for the batch broadband permit processing of wireless telecommunications facilities, on Consent Calendar.

PERMIT PROCESSING OF WIRELESS TELECOMMUNICATIONS FACILITIES

3-C. ESTABLISHING THE SATURN PARK ADVISORY REVIEW COMMITTEE (“SPARC”)

On April 9, 2024, the Planning Commission considered future land uses at McCaslin Business Park as contemplated by the Land Use Element (“LUE”) to the General Plan (approved by voters in 2020). A copy of the April 9 th staff report is
attached for reference to this staff report.

May 22, 2024

During a subsequent Planning Commission meeting on April 15, 2024, Planning Commissioners expressed support for various land uses within the McCaslin Business Park to implement the vision expressed in the LUE. Based upon those discussions, it seems prudent for the City to solicit public input to adopt new land use regulations for what the LUE identifies as “Saturn Park.” The LUE was guided by a citizen’s oversight committee identified as the “General Plan Advisory Committee”; it is recommended that the City Council create the “Saturn Park Advisory Review Committee” or “SPARC” as described below.

Public Speaker:

- Maychelle Yee, resident, expressed her concerns regarding the development of the proposed area and suggested amending the recommendation to allow the community to appoint 3 members and asked for consideration to appoint her as one of the community members.

Action Taken: The City Council e stablished the Saturn Park Advisory Review Committee (“SPARC”) initially comprised of Mayor Thomas Wong, Mayor Pro Tem Vinh Ngo, and Assistant City Manager Diana Garci a, as amended to allow the initial committee to determine the numbers of appointment s of community members.

Motion: Moved by Council Member Lo and seconded by Council Member Sanchez, motion carried by the following vote:

Ayes: Council Members: Sanchez, Lo, Yiu, Ngo, Wong
Noes: Council Members: None

Absent: Council Members: None
Abstain: Council Members: None
