storm drain facilities. As a condition of approval for PEN21 -0290 (Tentative Tract Map 38265), the City requires the Developer to construct certain public improvements to provide flood protection and drainage as a result of the developer’s planned development.
The Cooperative Agreement is the District’s mechanism by which the District, the City, and the Developer coordinate the construction and maintenance of master storm drain facilities.
DISCUSSION
On September 22, 2022, the Moreno Valley Pl anning Commission approved Tentative Tract Map 38265, a project to construct 236 single-family lots consisting of 20 Live-Work units and 216 traditional residential units on approximately 20 acres through a Planned Unit Development (PUD). The project site is located on the north side of Alessandro Boulevard between Morrison Street and Nason Street and is part of the City’s Downtown Center District project. As a condition of approval of PEN21 -0290 (Tract Map 38265), certain flood control facilities need to b e constructed to provide proper flood protection and drainage. The required storm drain facility improvements for this project include the extension of the Moreno MDP – Line J, consisting of approximately 642 lineal feet of 48- inch reinforced concrete pip e (RCP) and associated structures that connect to the District’s existing Moreno MDP – Line J storm drain at the downstream end. The District’s maintenance responsibility shall be approximately 642 lineal feet of the 48 -in diameter RCP that connects to their existing storm drain at the downstream end.
The Developer will be responsible for the design and construction of the project improvements, preparing plans and specifications in accordance with the District and the City’s standards, and submitting improvement plans to the District and the City for review and approval. Both the City and the District will review the plans and specifications, provide inspection during construction, and, if the Developer meets all requirements of the Agreement, will accept ownership and responsibility for the operation and maintenance of the drainage facilities within their respective jurisdictions.
Prior to the construction of the facility or recordation of the final map, whichever occurs first, the Developer will be requ ired to submit bonds for the improvements and execute an Agreement for Public Improvements, as approved by the Public Works Director/City Engineer for PEN21-0290. The Agreement will include a Faithful Performance bond and Material and Labor bond for both t he District’s drainage facility and the City’s drainage facility. The City will hold the storm drain portion of the bonds until completion of the storm drain and acceptance of the storm drain improvements by the City and the District.
