RESOLUTION NO. 2025-XX
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MORENO VALLEY, CALIFORNIA, TO CONFIRM THE
ELECTRIC PROGRAMS AND INCENTIVES BY ADOPTION
OF THE MORENO VALLEY ELECTRIC UTILITY PUBLIC
PURPOSE PROGRAMS BOOK
WHEREAS, the City of Moreno Valley (the “City”), a municipal corporation, is authorized pursuant to Article XI, Section 9(a) of the California Constitution to establish, purchase, and operate public works to furnish its inhabitants with light, water, power, heat, transportation, or means of communication; and
WHEREAS, on June 26, 2001, the City Council of the City of Moreno Valley approved Resolution No. 2001 -33 and, as amended by Resolution 2002-46, authorized the formation of a municipally owned utility for the purpose of providing electrical power, storm water, telephone telecommunications, cable TV, water, natural gas, and sanitary sewer; and
WHEREAS, as a municipal electric utility, the C ity is generally subject to the legislative and regulatory requirements applicable to local publicly owned electric utilities (”POUs”); and
WHEREAS, California public Utilities Code (“PUC”) Section 385(a) requires local publicly owned utilities to establish a non -bypassable, usage based cha rge to fund investments by the utility and other parties in the following: (1) Cost-effective demand- side management services; (2) Investment in re newable energy resources and technologies consist ent with existing statutes and regulations; (3) Research, development and demonstration programs for the public interest to advance science and technology which is not adeq uately provided by competitive markets; and (4) Services provided for lo w-income electricity customers, including, but not limited to energy efficiency services, education, weatherization, and rate discounts; and WHEREAS, California Public Uti lities Code Section 9615 requires local publicly owned utilities to identify all potentially achievable cost-effective energy efficiency savings and establish annual targets for energy efficiency savings and demand reduction; and WHEREAS, local publicly owned ut ilities are required to report to the California Energy Commission annually the expenditures, programs, cost-effectiveness and energy savings achieved though the implementation of various energy efficiency programs.
WHEREAS, Moreno Valley Utility has drafted a Public Purpose Programs Book to communicate how it complies with the establishment of programs and incentives required by PUC code 385.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MORENO VALLEY, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS:
1. The City Council hereby confirms the approval and adoption of Moreno Valley Utility Public Purpose Program s Book, attached hereto as Exhibits A, incorporated herein, and on file in the Public Works Department.
