SUMMARY
On February 12, 2026, the Planning Commission recommended on a 5 to 0 vote, with one planning commissioner absent, that the City Council in troduce and adopt the proposed Ordinance amending various sections of Title 9 based on the finding that the proposed amendments are exempt from the California Environmental Quality Act.

However, since the proposed amendment to Title 12 is not within the pu rview of the Planning Commission, it was not presented to the Planning Commission for its consideration, but staff recommends that the City Council also introduce and adopt the proposed Ordinance amending Title 12, based too on the finding that the propose d amendments to Title 12 are exempt from the California Environmental Quality Act.

DISCUSSION
The discussion of the sections below generally corresponds to the order of the text amendments set forth in the attached Ordinances.

Title 9 Amendment
Section 9.09.130 (Accessory Dwelling Units (ADUs)
The proposed revisions to Section 9.09.130 (Accessory Dwelling Units) would clarify local development standards and by -right development standards, including the number of ADUs permitted on a lot, maximum unit sizes, and setback requirements, and would require coordination with the Department of Environmental Health for ADUs proposed on properties served by septic systems.

Section 9.17.080 (Multifamily Residential Development)
The proposed revisions to Section 9.17.080 (Multifamily Residential Development) would eliminate the minimum 35 percent site -area landscaping requirement for multifamily residential developments and establish a less restrictive standard requiring that setback areas adjacent to public streets be appropriately landscaped and continuously maintained in accordance to the City of Moreno Valley Objective Design Standards for Multiple - Family and Mixed -Use Residential Developments , and Chapter 9.17 (Landscaping and Water Efficiency Requirements).

Title 12 Amendments
Section 12.02.001 (Definitions)
The proposed revisions to Section 12.02.001 (Definitions) would add the definitions of “Immigration enforcement”, “Personally identifiable information”, and “Sidewalk vendor”,

ensuring consistency with the provisions of Senate Bill 635 (SB 635).

Section 12.02.019 (Penalty for violation)
The proposed revisions to Section 12.02.019 (Penalty for violations) would clarify that the established penalties for violations are only applicable to Mobile Vendors as defined in the Municipal Code and do not apply to Sidewalk Vendors, ensuring consistency with the provisions of the Street Vendor Protection Act, Senate Bill 635 (SB 635).

Section 12.02.020 (Street Vendor Protection Act (SB635)) This proposed new section (12.02.02 0) (Street Vendor Protection Act (SB635)) establishes protections and enforcement rules for sidewalk vendors under the Street Vendor Protection Act. It limits how the City may collect, use, and disclose personal information from vendors and sets rules for enforcement and penalties related to sidewalk vending, ensuring alignment with the requirements of the Street Vendor Protection Act , Senate Bill 635 (SB 635).

ENVIRONMENTAL
The proposed Municipal Code Amendments (PEN26-0003) are exempt from the California Environmental Quality Act in accordance with Section 15061(b)(3) of the CEQA Guidelines in that the amendments involve general policy and procedure making, and it can be seen with certainty that there is no possibility that the amendments will have a significant effect on the environment.

ALTERNATIVES

1. Staff’s Preferred Alternative – Introduce the Ordinance as presented to and recommended by the Planning Commission and adopt the Ordinance at a subsequent City Council meeting.

2. Staff Non-Preferred Alternative - Do not introduce and adopt the Ordinance.

FISCAL IMPACT
There are no fiscal impacts anticipated from the approval and adoption of the proposed Ordinances. However, it is anticipated that the proposed modifications will streamline business and developme nt regulations, which is expected to have a positive impact on business and development which will result in a positive fiscal impact for the City.

NOTIFICATION
