DISTRICT: Not Applicable

City’s established Temporary Use Permit (TUP) process.

DISCUSSION

Several months ago, a Moreno Valley non-profit organization informed the City that they would be receiving a donated mobile shower unit for use by unhoused persons in the context of a homeless resources fair/outreach event . However, Municipal Code Section

9.02.150 Temporary Use Permits, does not list this activity or service as a permissible use. Recently, a different non -profit also inquired about providing a mobile shower unit during an organized event at a City park. This recent request includes connecting the mobile shower unit to a City water source.

When evaluating a proposed mobile shower unit, several factors should be considered for purposes of mitigating certain potential secondary effects associated with such a use.

To mitigate potential liability for the City, staff recommends that the use of mobile shower units be limited to private property, and not be allowed in the public right of way (i.e., city streets), public facilities, or City parks. Additionally, staff recommends this service to be allowed through the TUP process only in connection with a duly approved and organized homeless resources and outreach fair/event to ensure that the mobile shower units are properly stored and secure and used for their intended purposes.

When considering a TUP application for a mobile shower unit, Planning would place certain conditions of approval on the TUP including, but not limited to, the following items:

 Liability insurance and naming the City of Moreno Valley as additionally insured  Property owner authorization
 Information on tank capacity, i.e., maximum # of showers, time limits per user  Potable water source
 Gray/wastewater containment and disposal location
 Electric generator specifications
 Emergency abatement plan/cleanup of gray water spills  Security plan
 Infection control plan
 Parking/storage of mobile shower unit vehicle

Staff recommends the City Council provide direction on this matter, since it is a legislative (policy) matter. If so , directed by the City Council, the Planning Division w ill update Section 9.02.150 (Temporary Use Permits) to add “Homeless Resources Fair/Outreach Event including those with Mobile Shower Units” to the list of permitted temporary uses as part of the Spring Omnibus Ordinance.
