SUMMARY
The report recommends awarding a construction contract to Hardy & Harper, Inc. for the Citywide Pavement Rehabilitation Program, Fiscal Year 2025 –26. It also recommends approving a Professional Consultant Services Agreement with Certerra RMA Group to provide geotechnical services, materials testing, and construction inspection in support of the project’s construction engineering. Project funding is provided through Senate Bill 1 (SB1) Funds (Fund 2000A) Road Maintenance and Rehabilitation Account (RMRA), Public Works Capital Projects Fund (Fund 3002), and Capital Improvement Grants Fund (Fund 3001 - CalRecycle Grant Funds).

DISCUSSION
On May 6, 2025, the City Council adopted Resolution No. 2 025-26, approving a list of arterial, collector, and local street segments for pavement rehabilitation in Fiscal Year (FY) 2025 –26 pursuant to California Transportation Commission (CTC) funding requirements under Senate Bill 1 (SB1). The selected street segments are consistent with the City’s Pavement Management Five -Year Look -Ahead Plan, approved by the City Council in April 2025, which identifies priority locations for pavement repair based on the limited funding available.

In accordance with California State Public Contract Code Section 22000 et seq., Public Works is limited in its ability to perform asphalt pavement rehabilitation using force account, which restricts such work to projects with an estimated value of $75,000 or less.

Additionally, state law generally limits in -house crews to minor maintenance activities, such as asphalt repairs of 1 inch or less in depth. As a result, competitive bidding and contracting is required for the proposed project along with other more extensive pavement rehabilitation projects.

ID: 26-0188 Page 3
This project aligns with the City Council’s Momentum MoVal Strategic Plan, as roadway maintenance continues to be a top priority. In 2022 , the City Council approved a historic $50 million investment in pavement rehabilitation to address deferred maintenance and complete critical repairs across numerous corridors. The Council continued this commitment in 2023 by allocating an additional $20 million in the current budget cycle – $10 million for the FY 2023–24 project and $10 million for last year’s project.

The FY 2025–26 project includes both preventative and corrective pavement treatments for approximately 174 local street segments citywide. Preventative measures such as crack sealing, along with corrective treatments including localized repairs and surface replacement, will extend the useful life of the City’s roadway network at the lowest long-term cost. The project also includes installation of three traffic signal video detection systems to replace existing detector loops, re -establishment of traffic striping, and other related street improvements.

The project design was completed by in -house engineering staff as a cost -saving measure. The project was advertised for construction bids on March 25, 2026, and formal bidding procedures were conducted in accordance with the Public Contract Code. A total of five (5) bids were received through the City’s electronic bid management system, PlanetBids.com, on April 21, 2026, as follows:

Contractors Bid Amount

1. Hardy & Harper, Inc. $4,606,000.00

2. All American Asphalt $4,998,112.00

3. Vance Corporation $5,118,782.90

4. R.J. Noble Company $5,839,556.30

5. Onyx Paving Company Inc. $6,139,000.00
The lowest responsible bidder was determined by evaluating the cumulative total of all bid items, as required by the bidding documents. Staff has reviewed the bid submitted by Hardy & Harper, Inc. and confirmed that it is the lowest r esponsive and responsible bid, supported by a valid contractor’s license and bid bond. Staff also reviewed the references provided by Hardy & Harper, Inc. and found no outstanding issues. Accordingly, staff recommends awarding the construction contract to Hardy & Harper, Inc. to complete the much-needed street improvements included in this project.

Additionally, staff recommends awarding an agreement to Certerra RMA Group in the amount of $113,300.00 to provide geotechnical, materials testing, and construct ion inspection services for this project. These services include testing contractor -furnished slurry seal, asphalt, and concrete materials, as well as observing field placement to verify compliance with project specifications. The consultant will also mana ge day -to-day construction activities and perform field inspections to ensure all improvements are constructed in accordance with the approved plans and specifications. Certerra RMA Group was selected through a competitive request -for-proposals process and was determined to be highly qualified to perform the quality assurance and quality control (QA/QC) services required for this project.

A 20% contingency is recommended to be added to the purchase orders for Hardy and

ID: 26-0188 Page 4
Harper, Inc. and Certerra RMA Group to address any changed field conditions that may have arisen between completion of the engineering design and the start of construction.

The contingency will also allow staff to respond quickly to unforeseen circumstances encountered during construction, min imizing delays and reducing the likelihood of contractor change orders.

ALTERNATIVES

1. Approve and authorize the recommended actions as presented in this staff report.

This alternative will provide for the timely construction of the Citywide Pavement Rehabilitation Program for Fiscal Year 2025-26. Staff recommends this alternative.

2. Do not approve and authorize the recommended actions as presented in this staff report. This alternative will delay the construction of improvements needed and may result in highe r repair costs in the future . Staff does not recommend this alternative.

FISCAL IMPACT
This project was approved in the adopted FY 2025 -26 & 2026 -27 Capital Improvement Plan (CIP) and is funded by Senate Bill 1 (SB1) Funds (Fund 2000A) Road Maintenance and Rehabilitation Account (RMRA), Public Works Capital Project (Fund 3002), and Capital Improvement Grants (CalRecycle Grant Funds) (Fund 3001).
