Citywide Pavement Rehabilitation And Preservation (All Districts)
DISTRICT: All Districts

2. Authorize the Public Works Director/City Engineer to make any minor adjustments to the limits of work and minor modifications to the project list, as necessary.

DISCUSSION
On April 28, 2017, the Governor signed the Road Repair and Accountability Act of 2017, Senate Bill 1 (SB1) to address basic road maintenance, rehabilitation, and critical safety needs on state highways as well as local streets and roads. Funds are generated via fuel excise taxes and vehicle registration fees, and a portion is allocated by formula to eligible cities and counties for basic road maintenance, rehabilitation, and critical safety projects.
Roadway maintenance remains a top priority for the City Council.
Prior to receiving the annual allocation of the formula -based SB 1 funds, local agencies must submit a project list to the California Transportation Commission (CTC) prior to July 1, 202 6. The project list must include a description and the location of eac h street segment, a proposed schedule for project completion, and the estimated useful life of the improvements. The project list does not limit the flexibility of an eligible city to fund projects in accordance with local needs and priorities, so long as the projects are consistent with SB 1 funding priorities.
In addition to submitting a proposed list of projects to the CTC for approval, to remain eligible for SB1 funds, local agencies are required to:
1. Submit annual documentation regarding completed projects.
2. File an annual report of expenditures for street or road purposes with the State Controller’s Office.
3. Sustain a Maintenance of Effort (MOE).
4. Follow guidelines developed by the California Workforce Development Board that address participation and inves tment in, or partnership with, new or existing pre - apprenticeship training programs.
Moreno Valley encompasses 51.68 square miles and maintains 526 centerline-miles of streets. The most recent pavement conditions evaluation estimates the City’s pavement infrastructure value at nearly $600 million. The evaluation also identified approximately $30 million in critically deferred maintenance needs. The City is scheduled to receive an estimated $5.9 million in SB1 funding in Fiscal Year 202 6/27, which will be used to help address these maintenance needs.
The street segments selected for the FY 2026/27 Project List are part of the Five -Year Look-Ahead Pavement Management Plan, which was approved by City Council on May 5, 2026. In the effort to maximize the available budget, additional street segments from said Five-Year Look-Ahead Plan are to be included in the Project List as additive bids but may not be constructed depending upon favorable bids received.
For the proposed segments, staff recommends that the City Council authorize the Public Works Director/City Engineer to make minor modifications to the limits of work on individual street segments to accommodate any latest changes in private property development or other conflicting Capital Impr ovement Plan projects that may arise prior to bidding the project for construction. Additionally, staff also recommends authorizing the Public Works Director/City Engineer to make minor modifications to comply with any 195
ID: 26-0224 Page 3
changes in the CTC procedures or forms to avoid delays.
Consistent with the approved Momentum MoVal Strategic Plan, staff is taking proactive steps to create an ongoing annual pavement preservation program with a similar level of efforts in roadway maintenance.
ALTERNATIVES
1. Approve the re commended actions as presented in this staff report. This alternative will allow timely submission of the Project List for SB1 for Fiscal Year 2026/27 funding and the City to continue receiving SB 1 funding for citywide street pavement rehabilitation work.
2. Do not approve the recommended actions as presented in this staff report and provide alternate direction to staff. This alternative may prevent the City from receiving SB1 funding for Fiscal Year 202 6/27 and delay use of State funding to meet the Council’s priority to enhance the condition of City’s roadways.
FISCAL IMPACT
There is no fiscal impact for the recommended action items.
NOTIFICATION
All utilities, adjacent property owners, business owners, law enforcement, fire department, and other emergency services responders in the areas affected by the pavement rehabilitation will be notified in a timely manner prior to the start of construction work.

authority to authorize associated Purchase Orders and Change Orders in accordance with the Agreement’s terms, subject to the approval of the City Attorney and within the budgetary amounts previously approved by the City Council as part of the adopted and/or amended budget process.
SUMMARY
This report recommends that the City Council approve a five-year agreement with ACCO Engineered Systems, Inc., pursuant to the cooperative agreement under Municipal Code
3.12.260, whereas the City Manager authorizes the use of competitively awarded government contracts, commonly referred to as "piggybacking," without further contracting, solicitation, or formal bidding to buy goods or servi ces, if it benefits the city and follows state law . ACCO will be utilizing Axia Cooperative to provide heating, ventilation, air conditioning , and related equipment installation, maintenance and repair services at city-owned facilities and sites.
DISCUSSION
The Fleet and Facilities Maintenance Division maintains numerous City -owned facilities and operational sites that require reliable heating, ventilation, and air conditioning (HVAC) services to ensure safe and efficient operations.
Staff evaluat ed available procurement options and determined that utilizing the cooperative purchasing agreement with Axia Cooperative provides a cost -effective and efficient method for securing these services while complying with public procurement requirements.
ACCO Engineered Systems Inc. has been identified as a qualified vendor capable of delivering comprehensive HVAC Services . Leveraging the Axia cooperative agreement allows the City to benefit from competitively solicited pricing, reduce administrative procurement time, and ensure access to a vetted and experienced service provider.
The proposed five-year agreement will provide continuity of service, improve equipment reliability, and support the City’s ongoing commitment to safety and security across all City-owned facilities.
ALTERNATIVES
1. Approve and authorize the recommended actions as presented in this staff report.
Staff recommend this alternative.
2. Do not approve and authorize the recommended actions as presented in this staff report. Staff does not recommend this alternative.
FISCAL IMPACT
The total not -to-exceed cost of the proposed agreement is $ 3,500,000 over a five -year term.
208
ID: 26-0207 Page 3
Funding for these services are included in the Fiscal Year 2025/26 and 2026/27 Adopted Operating Budget. Funding for future years will be appropriated annually as part of the City’s budget process. No additional General Fund impact is anticipated beyond the approved budget allocations.
The use of the Axia cooperative agreement is expected to provide cost saving s through competitively pre-negotiated pricing and reduce administrative procurement costs. There are no additional long-term liabilities beyond the term of the agreement.

ID: 26-0220 Page 2
4. Adopt Resolution No. CSD 2026-XX, a resolution of the Moreno Valley Community Services District establishing the Community Services District appropriations limit for Fiscal Year 2026/27.
SUMMARY
This report recommends that the City Council and the Community Services District Board of Directors conduct public hearings and adopt the resolutions to establish the Gann Appropriations Limits for both the General Fund and the Community Services District (District) for FY 2026/27. The Gann Appropriations Limit, the result of the passage of Proposition 4 in 1979, places limits on the amount of tax proceeds that can be appropriated each year. For FY 2026/27 the limit for the General Fund is $ 192,172,311 and the limit for the District is $ 30,967,251. With revenues subject to the limit totaling $165,337,920 for the General Fund and $ 14,606,737 for the District, there is still significant capacity to accommodate future revenue growth.
DISCUSSION
Section 7910 of the State Government Code requires a governing body to annually adopt by resolution an Appropriation (Gann) Limit for the upcoming fiscal year. For FY 2026/27 the appropriation limit for the General Fund is $192,172,311, and the limit for the District is $30,967,251. With revenues subject to the limit totaling $ 165,337,920 for the General Fund and $14,606,737 for the District, there is still significant capacity to accommodate future revenue growth. The Gann calculation is reviewed by the City’s external audit firm as part of the annual audit process.
In 2008, the available capacity betwee n the appropriations limit and the appropriations subject to the limit for the City reached the lowest point at 6.34%. Over the next three years, appropriation levels were reduced as a result of the recession and declining revenues. Since then, as the loca l economy has improved, the remaining capacity has gradually increased. The current level of approximately 14% of the appropriations limit represents a decrease from the prior year capacity level of approximately 30%, primarily due to the implementation of the additional 1% Measure U Transaction and Use Tax, approved by voters on November 5, 2024, which increased appropriations subject to the limit. Based on projections from the Long -Range Business Plan, we expect capacity levels to re main relatively high , and we do not foresee any issues going forward that would result in the City reaching the appropriations limit.

ID: 26-0220 Page 3
The Community Services District continues to maintain sufficient capacity related to the appropriations limit. In 2015 , based on a ruling by the City Attorney, revenues that had previously been accounted for as non -proceeds of tax were reclassified as tax related revenues. This restatement resulted in reducing their appropriation capacity from 78% to 38%. Their available capacity is currently approximately 5 3%. Based on the projections from the Long -Range Business Plan, we anticipate that the capacity rate will remain in this relative range and we do not foresee any issues with the appropriations limit going forward.
Adoption of the proposed resolutions will formalize the Gann Appropriations Limit for FY 2026/27.
ALTERNATIVES
1. Conduct a Public Hearing to receive public comments on the City of Moreno Valley General Fund appropriations limit for Fiscal Year 2026/27.
2. Adopt Resolution No. 2026-XX, a resolution of the City Council of the City of Moreno Valley, California, establishing the appropriations limit for Fiscal Year 2026/27.

DISTRICT: All Districts
Recommendation(s)
That the City Council:
1. Conduct a Public Hearing to review and confirm the annual regulatory rate schedule for the National Pollutant Discharge Elimination System Program for new residential, common interest, commercial, industrial, and quasi-public land uses;
2. Adopt Resolution No. 2026-XX, a Resolution of the City Council of the City of Moreno Valley, California, authorizing and approving the levy of the National Pollutant Discharge Elimination System regulatory rates for new and existing residential, common interest, commercial, industrial, and quasi-public development on the County of Riverside property tax roll; and
244
ID: 26-0217 Page 2
3. Authorize the Chief Financial Officer to adjust the ra tes levied on property tax bills if parcel changes or other adjustments occur between the City Council meeting date and the submission of the charges to the County of Riverside , provided the applied rates do not exceed the maximum approved rates and remain consistent with the ballot and adopted budget.
SUMMARY
This report recommends that the City Council conduct a Public Hearing to receive public input on the proposed maximum and applied National Pollutant Discharge Elimination System regulatory rates for Fiscal Year 2026/2027.
The proposed maximum rates reflect an annual inflation adjustment based on the Consumer Price Index, as previously approved by property owners. Revenue generated from these rates supports services provided through the City’s Storm Water Management Program and is included in the proposed budget for Fiscal Year 2026/2027.
National Pollutant Discharge Elimination System rate revenue is restricted and may only be used for Storm Water Management Program services. Adjustments to applied parcel charges may occur based on service level changes.
DISCUSSION
The Clean Water Act of 1987 established requirements regulating the discharge of urban runoff from Municipal Separate Storm Sewer Systems (MS4s) under the National Pollutant Discharge Elimination System (NPDES) program. This program is administered by the Santa Ana Regional Water Quality Control Board through an NPDES permit.
As a requirement of the program , property owners are required to provide a funding source to support NPDES program activities. T o ensure compliance, t he City Council adopted the residential regulatory rate on June 10, 2003, and the commercial/industrial rate on January 10, 2006. These rates fund compliance activities associated with development and help reduce impacts to the General Fund.
Revenue from the commercial and industrial regulatory rates support annual inspections of site design and Best Management Practices (BMPs) , monitoring of maintenance records, and annual compliance inspections. Revenue from the residential regulatory rate supports ongoing operation and maintenance of storm water treatment system s, and program monitoring and compliance inspections.
The attached resolution establishes the proposed maximum and applied regulatory rates and authorizes the County to include these charges on the Fiscal Year (FY) 2026/2027 property tax roll. The proposed applied rates are consistent with the City’s adopted budget.
Proposed Regulatory Rates
The proposed rates apply to each assessable parcel required to comply with the City’s NPDES Storm Water Management Program previously approved by property owner ballot. The FY 2026/2027 maximum rates are calculated by applying a 3.01% Consumer 245
ID: 26-0217 Page 3
Price Index adjustment to the prior yea r’s maximum rates, consistent with voter authorization.
The applied regulatory rate represents the actual amount levied and is based on the cost of providing required services. While the applied rate may be lower than the maximum rate, it cannot exceed it. An analysis of each parcel, including development status and maintenance needs, was conducted to determine appropriate service levels and corresponding rates.
For FY 2026/2027, the proposed maximum regulatory rate for single -family residential development is $433.19 per parcel. The proposed maximum regulatory rate for common interest, commercial, industrial, and quasi-public use development is $326.20 per parcel.
Applied rates for each parcel are available at the City Clerk’s office as well as posted online at https://moval.gov/departments/public_works/services-stormwater.html.
ALTERNATIVES
1. Approve the recommended actions as presented in this staff report. Staff recommends this alternative to ensure placement of the NPDES regulatory rates on the County property tax roll.
2. Do not approve the recommended actions as presented in this staff report. Staff do not recommend this alternative, as it may limit the City’s ability to place the rates on the County property tax roll and could increase General Fund obligations.
FISCAL IMPACT
Projected FY 202 6/2027 revenue from the applied NPDES regulatory rates is $1,002,168.88, as included in the City’s budget detail (Attachment 2). Costs not recovered by NPDES revenue are subsidized by other funding sources, including the General Fund.

AGENDA DATE: June 2, 2026
TITLE: ADOPTION OF A TECHNOLOGY DISRUPTION POLICY
FOR REMOTE PUBLIC MEETINGS IN COMPLIANCE
WITH SENATE BILL 707 (2025) AND THE BROWN ACT
(REPORT OF: CITY CLERK) (DISTRICT: ALL
DISTRICTS)
TITLE SUMMARY: Technology Disruption Policy Adoption for Remote Public Meetings
DISTRICT: All Districts
Recommendation(s)
That the City Council:
1. Adopt the Technology Disruption Policy in compliance with Senate Bill 707 (2025) and Government Code Section 54953.4; and
2. Direct staff to implement the policy for all applicable City Council meetings on or before July 1, 2026.
SUMMARY
This report recommends adoption of a Technology Disruption Policy to establish procedures for responding to telephonic or internet service interruptions that prevent members of the public from accessing or observing City Council meetings remotely.
Senate Bill 707 (2025) requires eligible legislative bodies to adopt such a policy at a noticed public meeting by July 1, 2026. Adoption of this policy will ensure compliance with 254
ID: 26-0229 Page 2
state law, transparency, and support continued public participation during technical disruptions.
DISCUSSION
Senate Bill 707 (2025) amended the Brown Act to require legislative bodies that provide remote access to public meetings to adopt a formal policy addressing service disruptions.
The law requires that this policy be considered in open session and not pl aced on the consent calendar. The legislation will remain in effect until January 1, 2030.
The Brown Act (Government Code §54953.4) emphasizes the importance of public access to meetings, including when remote participation options are offered. As reliance on telephonic and internet -based meeting platforms has increased, the Legislature has recognized the need for clear procedures when technical failures occur.
Policy Overview
The proposed Technology Disruption Policy establishes a structured frame work for responding to interruptions in remote access services. Key provisions include:
Immediate Notification: The Presiding Officer or City Clerk must announce any disruption as soon as it is identified.
Temporary Recess: The meeting may be recessed for at least one hour to allow staff to restore services.
Restoration Efforts: Staff will make good faith efforts to restore access, including troubleshooting systems, using backup equipment, or contacting service providers.
Reconvening the Meeting:
o If service is restored, the meeting resumes normally. o If service is not restored within one hour, the Council may either adjourn or continue the meeting after making a required finding that continuing is in the public interest.
Documentation: The City Clerk will document the disruption, response efforts, and any actions taken in the meeting minutes.
Analysis
Adoption of this policy ensures that the City remains compliant with State law while maintaining transparency and public trust. The policy balances the need for uninterrupted governance with the public’s right to observe and participate in meetings.
The requirement to pause proceedings and attempt restoration reflects a commitment to accessibility, while the provision allowing meetings to continue under cer tain findings ensures that essential City business is not indefinitely delayed due to technical issues. 255
ID: 26-0229 Page 3
Additionally, formalizing procedures provides clarity to staff and the public, reducing confusion during disruptions, and ensuring a consistent response across meetings.
ALTERNATIVES
1. Approve an d adopt the Technology Disruption Policy as presented in this staff report. Staff recommends this alternative.
2. Do not approve the Technology Disruption Policy. Staff does not recommend this alternative, as it would result in non -compliance with Senate Bill 707 (2025) and could limit the City’s ability to lawfully conduct meetings when disruptions occur.
FISCAL IMPACT
There is no direct fiscal impact associated with the adoption of this policy. Implementation will be carried out using existing staff and resources.
Potential minor costs may arise from maintaining or upgrading backup equipment, software, or technical support services to ensure reliable remote access; however, these costs are expected to be minimal and can be accommodated within existing departmental budgets. No additional appropriations are required at this time.
