SUMMARY
On May 28, 2026, the Planning Commission recommended on a 4 to 0 vote, with one Planning Commissioner absent, that the City Council introduce and adopt the proposed Ordinance amending various sections of Title 9 based on the finding that the proposed amendments are exempt from the California Environmental Quality Act.
DISCUSSION
The discussion of the sections below generally corresponds to the order of the text amendments set forth in the attached Ordinances.
Title 9 Amendment
Section 9.02.150 (Temporary Use Permits)
The proposed revisions to Section 9.0 2.150 (Temporary Use Permits ) would add “Homeless Resources Fair/Outreach Event, including those with Mobile Shower Units” to the list of permitted temporary uses with a Temporary Use Permit.
Section 9.03.040 (Residential Site Development Standards)
The proposed amendments to Section 9.03.040 (Residential Site Development Standards) would remove the current requirement that a minimum of 35 percent of the total site area within multifamily residential developme nts be landscaped. Landscaping requirements for multifamily residential projects would instead be governed by the provisions of Section 9.17.080 (Multifamily Residential Development), whi ch provides more flexible standards for site landscaping. Pursuant to these requirements, setback areas adjacent to public streets must be appropriately landscaped and continuously maintained in compliance with the City of Moreno Valley Objective Design Standards for Multiple-Family and Mixed-Use Residential Developments and the applicable provisions of Chapter 9.17.
In addition, corresponding amendments are proposed to the Landscape Standards handbook to remove the existing requirement that multifamily residential developments maintain a minimum landscaped area equal to 35 percent of the total site area.
ENVIRONMENTAL
The proposed Municipal Code Amendments (PEN26-0059) are exempt from the California Environmental Quality Act in accordance with Section 15061(b)(3) of the CEQA Guidelines in that the amendments involve general policy and procedure making, and it can be seen with certainty that there is no possibility that the amendments will have a significant effect on the environment.
