3. Approve the issuance of annual purchase orders to Branson Industries, LLC for a total amount of $823,956 ($547,700 for Special Districts and $276,256 for Park Maintenance) over the five-year term of the agreement.
SUMMARY
This report recommends award of an Agreement to Branson Industries, LLC (the “Contractor”). The Agreement is for landscape lighting and electrical maintenance services within the City and CSD’s (collectively “City”) landscape maintenance districts.
The Agreement is for a five-year term and is subject to an annual inflationary adjustment.
Funding for these services is provided through a parcel charge, real property assessment, or special tax (“parcel charge”) collected as part of the annual property tax bill. The parcel charge is only applied to those properties receiving benefit from the public service and where such property owners have previously approved the charge.
DISCUSSION
The City established landscape maintenance dis tricts to provide financial resources to maintain public landscaping, including lighting and electrical in certain parkways, medians, traffic circles and open space areas for designated developments throughout the community. Property owners within a landsc ape maintenance district pay a parcel charge as part of their annual property tax bill. Revenue received from the parcel charge funds the cost to provide the landscape maintenance services. The funds received from the parcel charge are restricted and can only be used for landscape maintenance services and only in the area for which they are collected.
Maintenance of the public landscaping and associated specialty services are performed by licensed and insured contractors. The contractors are selected throu gh a competitive Request for Proposal (RFP) process every five years, consistent with the City’s Procurement Policy. Public Contract Code 22002, the Uniform Public Construction Cost Accounting Act (Municipal Code 3.12.300), allows the use of the RFP procur ement process for landscape maintenance services.
On March 27, 2026, an RFP for landscape lighting and electrical maintenance services was issued using the City’s electronic bid and vendor management system (PlanetBids).
Nine hundred and fourteen (914) v endors were notified of the RFP. One valid response was received before the RFP due date of 2:00 p.m. on April 28, 2026, two others were unfortunately incomplete and deemed unresponsive.
The RFP requested information on the proposer’s 1) pricing, 2) refer ences from other municipalities/public agencies where similar services have been provided, 3) ability to provide the services, and 4) qualifications and certifications in accordance with accepted
ID: 26-0242 Page 3
standards. Evaluation of the response was independently comp leted by one Division Manager from the Financial and Management Services Department and two Supervisors from the Parks and Community Services Department, all of whom have experience in managing contracts.
Staff recommends 1) awarding the Agreement to Bran son Industries, LLC, waiving any and all minor irregularities, 2) authorizing the City Manager (or designee) to execute the Agreement and authorizing the Chief Financial Officer to approve all future amendments in accordance with the terms of the Agreement and subject to the approval of the City Attorney, and 3) approve the issuance of annual purchase orders. Amendments shall only be entered into provided they are within the authorized not -to-exceed amount and provided sufficient funding appropriation approvals have been granted by the City Council. Authorizing the Chief Financial Officer to amend the Agreement allows for adjustments in additional work services, as may be necessary, without an extended delay in service.
This action meets Strategic Plan Priorities by managing and maximizing Moreno Valley’s public infrastructure to ensure an excellent quality of life, develop and implement innovative, cost -effective infrastructure maintenance programs, public facilities management strategies, and capital improvement programming and project delivery.
The City Council will take action on this item acting as both the City Council and the CSD Board.
ALTERNATIVES
1. Approve the Agreement for Landscape Lighting and Electrical Maintenance Services with Branson Indus tries, LLC and related recommended actions as presented in this staff report. Staff recommends this alternative to provide needed maintenance of the lighting and electrical systems in the City’s landscape districts.
2. Do not approve the Agreement. Staff does not recommend this alternative as it would cause further delays to the maintenance of lighting and electrical systems in the City’s landscape districts.
3. Do not approve the Agreement but continue the item to a future City Council meeting. Staff does not recommend this alternative as it may cause extensive delays in the maintenance of lighting and electrical systems in the City’s landscape districts.
FISCAL IMPACT
Maintenance costs to provide public landscape lighting and electrical maintenance services are funded through a property owner approved parcel charge, which is levied on the property tax bills. Revenue from the parcel charge can only be used for landscape lighting and electrical maintenance services, and administrative costs associated with the public lighting and electrical landscaping in the respective landscape maintenance

districts.
Funding is available in the adopted two -year Operating Budget for Fis cal Year 2026/27.
Funding for future fiscal years is subject to the approval of both the City Council and CSD Board, through the budget adoption process. The total budget amount of $823,956 ($547,700 for Special Districts and $276,256 for Park Maintenance) represents the cumulative total over the five -year term of the agreement. Annual expenditures are anticipated to average approximately $164,791 per year; however, actual allocations may vary based on project demands and operational needs and will remain s ubject to City Council approval of future Operating Budgets.
NOTIFICATION
The RFP was posted on the City’s bid portal (PlanetBids) and notified 914 vendors and identified 35 prospective bidders.
