DISCUSSION
The applicant, NWB Moreno Valley, LLC, submitted a request for the vacation of a portion of Alessandro Boulevard. Said portion is a five -foot (5’) wide strip along the existing southerly Alessandro Boulevard right -of-way, located west of Moreno Beach Drive. Per the Conditions of Approval for PEN23-0103, the developer is required to vacate a portion of Alessandro Boulevard along its project frontage. City staff, therefore, support the request to vacate said portion of Alessandro Boulevard. Prior to the vacation, the California Government Code requires the Planning Commission to find that the vacation conforms with the General Plan.
On March 26, 2026, the Planning Commission recommended the City Council approve the street vacation for a portion of Alessandro Boulevard, in accor dance with provisions of Division 9, Part 3, Chapter 3 of the Streets and Highways Code of the State of California, designated the “Public Streets, Highways, and Service Easements Vacation Law”. A recommendation from the Planning Commission is required prior to formal review and action by the City Council on the requested street vacation. The Planning Commission reviewed the proposed full vacation of this portion of Alessandro Boulevard and found that vacating this portion of Alessandro Boulevard was in con formance with the General Plan and Zoning Regulations. In addition, the City Council approved the Notice of Intent to Vacate (Resolution 2026-21) on May 5, 2026.
The City Council’s approval to vacate this portion of Alessandro Boulevard would abandon all of the City’s rights for public use, with the exception of reserving easements as requested by Crown Castle Communications and Charter Spectrum for existing communication facilities. An access easement will be reserved for EMWD for access to its property. Vacation of the five feet of right -of-way along Alessandro Boulevard, as described and shown in the exhibits attached to the proposed resolution, is in accordance with the Streets and Highways Code.
ALTERNATIVES
1. Approve and adopt the recommended action s as presented in this staff report.
Staff recommend this alternative as this would allow the street vacation process to move forward.
2. Do not approve and authorize the recommended actions as presented in this staff report. Staff do not recommend this alt ernative as this would not allow the street vacation process to move forward as required by the project’s Conditions of Approval.
FISCAL IMPACT
No fiscal impact is anticipated.
