REPORT NARRATIVE:
When a State or Federal disaster declaration is made, and the City of Morgan Hill has damages or costs that can be reimbursed from disaster recovery funds, a Designation of Applicant’s Agent Resolution must be made by the City Council. It is important that the State and Federal agencies know that the City’s designated agent has the authority of the City Council to act on the City’s behalf.
Staff is seeking approval from the City Council to designate the staff positions of City Manager, Finance Director, or Senior Accountant as applicant’s agents to represent the City of Morgan Hill for any applications with the State Office of Emergency Services (OES) and Federal Emergency Management Agency (FEMA) for disaster assistance.
The universal resolution is valid for all open and future disasters up to three (3) years, following the date of approval by the City Council. The City Council last approved the designation of applicant’s agent resolution in 2020, when the City filed for the 2020 SCU
13 Lightning Complex Fire cost reimbursements.
The City currently has a reimbursement claim for the 2022-2023 Early Winter Storms.
Therefore, it is necessary for the City to renew the Designation of Applicant’s Agent Resolution on file with Cal OES which will be valid for all open and future disasters for up to three (3) years.

Cal OES Form 130 Instructions
A Designation of Applicant’s Agent Resolution for Non-State Agencies is required of all Applicants to be eligible to receive funding. A new resolution must be submitted if a previously submitted resolution is older than three (3) years from the last date of approval, is invalid, or has not been submitted.
When completing the Cal OES Form 130, Applicants should fill in the blanks on pages 1 and 2. The blanks are to be filled in as follows:
Resolution Section:
Governing Body: This is the group responsible for appointing and approving the Authorized Agents.
Examples include: Board of Directors, City Council, Board of Supervisors, Board of Education, etc.
Name of Applicant: The public entity established under the laws of the State of California.
Examples include: School District, Office of Education, City, County or Non-profit agency that has applied for the grant, such as: City of San Diego, Sacramento County, Burbank Unified School District, Napa County Office of Education, University Southern California.
Authorized Agent: These are the individuals that are authorized by the Governing Body to engage with the Federal Emergency Management Agency and the California Governor’s Office of Emergency Services regarding grants for which they have applied.
There are two ways of completing this section:
1. Titles Only: The titles of the Authorized Agents should be entered here, not their names. This allows the document to remain valid if an Authorized Agent leaves the position and is replaced by another individual. If “Titles Only” is the chosen method, this document must be accompanied by either a cover letter naming the Authorized Agents by name and title, or the Cal OES AA Names document. The supporting document can be completed by any authorized person within the Agency (e.g., administrative assistant, the Authorized Agent, secretary to the Director). It does not require the Governing Body’s signature.
2. Names and Titles: If the Governing Body so chooses, the names and titles of the Authorized Agents would be listed. A new Cal OES Form 130 will be required if any of the Authorized Agents are replaced, leave the position listed on the document, or their title changes.

Checking Universal or Disaster-Specific Box: A Universal resolution is effective for all past disasters and for those declared up to three (3) years following the date of approval. Upon expiration it is no longer effective for new disasters, but it remains in effect for disasters declared prior to expiration. It remains effective until the disaster goes through closeout unless it is superseded by a newer resolution.
Governing Body Representative: These are the names and titles of the approving Board Members.
Examples include: Chairman of the Board, Director, Superintendent, etc. The names and titles cannot be one of the designated Authorized Agents. A minimum of three (3) approving board members must be listed. If less than three are present, meeting minutes must be attached in order to verify a quorum was met.
Certification Section:
Name and Title: This is the individual in attendance who recorded the creation and approval of this resolution.
Examples include: City Clerk, Secretary to the Board of Directors, County Clerk, etc. This person cannot be one of the designated Authorized Agents or Approving Board Member. If a person holds two positions (such as City Manager and Secretary to the Board) and the City Manager is to be listed as an Authorized Agent, then that person could sign the document as Secretary to the Board (not City Manager) to eliminate “Self-Certification.”

14 CITY COUNCIL STAFF REPORT
MEETING DATE: January 17, 2024
PREPARED BY:
Edith Ramirez, Assistant City Manager
APPROVED BY: City Manager
ADOPT RESOLUTION FOR AN EXCEPTION TO THE 180-DAY
WAITING PERIOD TO APPOINT RETIRED ANNUITANT, ANDREW
CRABTREE, TO SERVE AS TEMPORARY EXTRA HELP
(GOVERNMENT CODE SECTIONS 7522.56 AND 21224) IN THE
DEVELOPMENT SERVICES DEPARTMENT TO PERFORM WORK AS A
RETIRED ANNUITANT
RECOMMENDATION(S)
Adopt Resolution for an exception to the 180-day waiting period to appoint Andrew Crabtree, a retired annuitant, to serve as temporary extra help (Government Code Sections 7522.56 and 21224) in the Development Services Department to perform work as a Retired Annuitant.
COUNCIL PRIORITIES, GOALS & STRATEGIES
City Council Ongoing Priorities
Fostering a Positive Organizational Culture
2022-2023 Strategic Priorities
Fiscal Sustainability
Community Outreach, Engagement, and Messaging
REPORT NARRATIVE:
Generally, the Public Employment Retirement Law (PERL) requires that retired annuitants serve a 180-day wait period before working in a retired annuitant position.
However, the PERL also provides for exceptions to this waiting period if certain criteria are met and the governing body of the public agency adopts a non-consent calendar resolution at a public meeting approving the appointment as a critically needed position before the 180 days have passed. The adoption of the resolution allows the employer to hire a retired annuitant to perform work of a limited duration, such as specialized work and limited-term complex projects.
There are two types of post-retirement appointments possible under Government Code Section 7522.56:
1. Extra help retired annuitants hired to perform work of limited duration such as special projects (Government Code Section 21224); and
14 2. Appointment to a vacant position on an interim basis while a permanent replacement is being recruited (an active recruitment must be in place for this type of appointment, and the appointment must end when the replacement is hired, Government Code Section 21221(h)).
Andrew Crabtree recently retired from the City of Santa Clara where he was the Community Development Director from August 2016 until December 30, 2023. As Director, he successfully led a department of approximately 75 employees with a $34 million operating budget, achieving multiple City objectives, including the adoption of the City’s first comprehensive zoning code update, an affordable housing ordinance, four specific/neighborhood plans, and an update of the climate action plan. He oversaw a restructuring of the City’s Housing Division, the implementation of a new permit tracking system, the development of budget tracking tools and the first update of the Building Division fee schedule since 1990, enabling the Building program to develop a robust fund reserve. He reduced his department’s dependence upon the City of Santa Clara General Fund while expanding service delivery and improving service cycle times and customer satisfaction. Andrew has familiarity with the City of Morgan Hill, having previously served as the Community Development Director for Morgan Hill from September 2013 until July 2016, leading the adoption of the City’s General Plan and Residential Development Control System (RDCS) updates.
Staff recommends hiring Mr. Crabtree, on a temporary, part-time basis to work on special projects to support the Development Services Department. His scope of work will include the review and preparation of recommendations related to the Department’s budget, developing recommendations for capacity building and improvements to the operations and work flow to support the growing needs of the administration of new housing laws with limited staffing resources. Mr. Crabtree will report to the Assistant City Manager for Development Services and also help with special projects as needed.
The term of Mr. Crabtree’s employment is anticipated to be approximately four to six months, averaging 20 hours per week, starting January 22, 2024. This employment arrangement would fall under the State Government Code type 1 appointment (Government Code Section 21224).
COMMUNITY ENGAGEMENT:
This staff report serves to inform the Community.
ALTERNATIVE ACTIONS:
Direct staff to return with other options.
PRIOR CITY COUNCIL AND COMMISSION ACTIONS:
None.
FISCAL AND RESOURCE IMPACT:
The Public Employees’ Pension Reform Act (PEPRA) sets forth limitations for compensating retired annuitants. All retirees must be paid hourly, at no less than the
14 minimum, nor more than the maximum, paid to employees doing similar work. Based on the CalPERS formula for setting retired annuitant pay rates, the individual will be paid at the hourly rate for the as-needed position as follows:
Retired Annuitant Hourly Rate of Pay Fiscal Years Not to Exceed Amount
Andrew Crabtree $115.00 2023-2024 (22
weeks) and 2024-
2025 (2 weeks)
$55,200
Consistent with temporary employees, Crabtree will be enrolled in the PARS retirement system in lieu of participation in CalPERS and Social Security. Sufficient appropriations are available in the Development Services Department to fund this position.
CEQA (California Environmental Quality Act):
Not a Project - Organizational or administrative activities of governments that will not result in direct or indirect physical changes in the environment.

15 CITY COUNCIL STAFF REPORT
MEETING DATE: January 17, 2024
PREPARED BY:
Michelle Bigelow, City Clerk
APPROVED BY: City Manager
PROVIDE DIRECTION REGARDING CITY COUNCIL TERM LIMITS AND
MAYORAL TERM
RECOMMENDATION(S)
1. Provide direction to staff regarding the drafting of an ordinance creating term limits that would be submitted to the voters in November 2024; and
2. Provide direction to staff regarding the mayoral term.
COUNCIL PRIORITIES, GOALS & STRATEGIES
City Council Ongoing Priorities
Fostering a Positive Organizational Culture
Preserving and Cultivating Public Trust
Enhancing Diversity and Inclusiveness
REPORT NARRATIVE:
On May 3, 2023, the Council directed staff to bring back this topic for Council consideration. On June 7, 2023, the Council directed staff to research term limits and bring information back to the City Council to review and provide direction. The City of Morgan Hill does not have term limits for the Council or commissions. Should the City Council want to put term limits in place for the elected positions of Mayor and Council Member, it would require voter approval.
Government Code Section 36502(b) specifies that the City Council or the residents of the City may propose, by initiative, a proposal to limit the number of terms a member of the City Council may serve on the City Council or the number of terms an elected mayor may serve. Any proposal to limit the number of terms a member of the city council may serve on the city council, or the number of terms an elected mayor may serve, shall apply prospectively only and shall not become operative unless the proposition is submitted to the electors of the City at a regularly scheduled election and a majority of the votes cast favor its adoption. Limitations may be placed on the number of consecutive terms that Council Members may serve and may also be placed on the number of terms that a person may serve during their lifetime.
There are a few term-limit ordinances currently being used throughout the state, and
15 they generally fall within four models:
• Two or three consecutive terms of four years for Council Members and two or more terms of two years for the Mayor, followed by a hiatus of a specified duration (typically 1, 2, or 4 years) before the incumbent is eligible to seek election to additional terms. • Two or three consecutive terms of four years for Council Members and two or more terms of two years for the Mayor.
• Eight or ten-year maximum consecutive terms for Council Members and the Mayor, followed by a hiatus of a specified duration (typically 1, 2, or 4 years) before the incumbent is eligible to seek election to additional terms. • Eight or ten-year maximum consecutive terms for Council Members and the Mayor.
In addition, pursuant to Government Code Section 36502(b), a term limit ordinance applies prospectively only. This means that any term of office that commenced prior to the effective date of a term limit ordinance would not count as a term served for purposes of implementing the ordinance.
For purposes of discussion, the Council is asked to consider the following points:
• The number of terms a Council Member/Mayor may serve consecutively • Whether to allow a hiatus between terms when the imposed limit has been reached or create a lifetime term limit
• The period of hiatus between terms, if desired, when the imposed limit has been reached
• Whether to limit terms for Commissioners
If the City Council wishes to put terms limits in place, it is asked to provide direction to staff on the specific model of term limits it wants to move forward with (examples outlined above) and to direct staff to bring back a staff report for adoption of a resolution placing a term limit ordinance on the November 2024 ballot.
The City Council is also asked to discuss the mayoral term and if it wishes to change the mayoral term from two to four years. Should the City Council wish to make this change, it would require voter approval, and the City Council is asked to provide direction to staff to bring back a staff report for adoption, placing the mayoral term change on the ballot.
COMMUNITY ENGAGEMENT:
This report serves to inform the community of the City Council's discussion regarding term limits.
ALTERNATIVE ACTIONS:
The City Council may direct staff to take no further action.
PRIOR CITY COUNCIL AND COMMISSION ACTIONS:
On May 3, 2023, the Council directed staff to bring back this topic for Council
15 consideration. On June 7, 2023, the Council directed staff to research term limits and bring information back to the City Council to review and provide direction.
FISCAL AND RESOURCE IMPACT:
No fiscal impact is associated with seeking direction from the Council on this item.
Should the City Council move forward with placing a measure(s) on the ballot, the estimated cost is $60,000 per ballot measure.
CEQA (California Environmental Quality Act):
Not a Project.
Organizational or administrative activities of governments will not result in direct or indirect physical changes in the environment.

GOVERNMENT CODE
Section 36502
36502. (a) A person is not eligible to hold office as councilmember, city clerk, or city treasurer unless he or she is at the time of assuming the office an elector of the city, and was a registered voter of the city at the time nomination papers are issued to the candidate as provided for in Section 10227 of the Elections Code.
If, during his or her term of office, he or she moves his or her place of residence outside of the city limits or ceases to be an elector of the city, his or her office shall immediately become vacant.
(b) Notwithstanding any other provision of law, the city council of a general law or charter city may adopt or the residents of the city may propose, by initiative, a proposal to limit or repeal a limit on the number of terms a member of the city council may serve on the city council, or the number of terms an elected mayor may serve.
Any proposal to limit the number of terms a member of the city council may serve on the city council, or the number of terms an elected mayor may serve, shall apply prospectively only and shall not become operative unless it is submitted to the electors of the city at a regularly scheduled election and a majority of the votes cast on the question favor the adoption of the proposal. Notwithstanding the provisions of this subdivision, the provisions of any city charter that, on January 1, 1996, impose limitations on the number of terms a member of the city council may serve on the city council, or the number of terms an elected mayor may serve, shall remain in effect. Unless otherwise prohibited by a city charter, any city charter may be amended pursuant to this section or pursuant to the procedures specified in the charter, to include the limitation authorized in this subdivision.

To all concerned
I am voicing my opinion that I believe we should have Term Limits for City Counsel. We need to have constant and fresh eyes for keeping the wonderful town growing at the right pace. Some times I think members all they see are dollar signs and it’s pushing the business and good people out of town. Keep it real.
