Background: The California Central Valley Water Board notified the City that it is required to have an approved Title 22 Engineering Report describing how the City treats and distributes treated/recycled effluent. The report will need to be submitted and approved by the Water Board before the City can continue to discharge to the golf course this coming season. Mt. Shasta City Council Regular Meeting, January 13, 2025 2 Mt. Shasta Regular City Council Meeting Agenda
Monday, January 13, 2025
Background: The Finance Director will review the current fiscal year budget.
Report By: Malisa Dodd, Finance Director
Recommended Council Action: Receive report, no action.
Background: This year, the City will receive an additional $29,663 in COPS revenue allocation. The budget adjustment is before Council for discussion and approval.
Report By: Malisa Dodd, Finance Director
Recommended Council Action: Staff requests the Mayor and City Council Approve an increase in the budget of $29,663 for the COPS Fund, Resolution CCR-25-XX
Background: Fund 90 – Public Works Reimbursable Projects fund has not been used for many years.
During the review of funds with the fiscal auditor, staff discussed closing this out to clean up the balance sheet. After discussion with the Public Works director, he does not see a need for these funds for that purpose. The amount is immaterial, and the staff proposes moving it to Fund 12 - Equipment Replacement Reserve for future use.
Report By: Malisa Dodd, Finance Director
Recommended Council Action: Staff respectfully requests the City Council approve the closing out of Fund 90 – Public Works Reimbursable Projects and reallocate the $19,532.60 cash on hand balance to Fund 12 - Equipment Replacement Reserve.
Background: Staff was contacted by Kaila Burns from the Chamber wondering why the City’s supplemental support payment was lower than in 2023. After researching the issue, it was determined that at the November 13, 2023 Council meeting, Council approved a one-time payment to the Chamber totaling $15,000.
Report By: Todd Juhasz, City Manager
Recommended Council Action: Consider whether to provide an additional $15,000 in funding to the Mt. Shasta Chamber of Commerce.
Background: Before the City may take any action to dispose of land consistent with City policies or procedures, the City Council must declare the land as either “surplus land” or “exempt surplus land”, pursuant to the provision of the Surplus Lands Act (SLA) found in California Government Code. Council will hear the report by staff and consider the declaration.
Report By: Jeff Mitchem, Planning Director
Recommended Council Action: Staff recommend City Council consider the record and adopt Resolution CCR-25-XX declaring portions of APNs 067-010-010 and 067-010-020, and all of APN 067-010-140 owned by the City of Mt. Shasta as “Surplus Land” and portions of APNs 067-010-010 and 067-010-020 as “Exempt Surplus Land” and directing Staff to prepare and submit a Notice of Availability.

Mt. Shasta City Council Regular Meeting, January 13, 2025 Mt. Shasta City Council Regular Meeting, January 13, 2025 3232 City Council Agenda Item # 9
Staff Report
Meeting Date: January 13, 2025
To: Mayor and City Council
From: Todd Juhasz, City Manager
Subject: Expenditure for Title 22 Engineering Report
Recommended Action: Approve the expenditure of $45,000 for preparation and submittal of a Title 22 Engineering Report
Background:
The California Central Valley Water Board notified the City that it is required to have an approved Title 22 Engineering Report describing how the City treats and distributes treated/recycled effluent. We have been using recycled effluent to irrigate the golf course for over twenty years without a Title 22 Engineering Report being filed. Now, under a new Waste Discharge Requirement (WDR Order R5-2023-0016), it has been made a requirement. The report will need to be submitted and approved by the Water Board before the City can continue to discharge to the golf course this coming season.
The City requested bids from four engineering firms to generate the report. Two firms responded.
They were SHN Engineering and PACE Engineering. PACE submitted the low bid of $45,000. • It is recommended that the City Council approve the expenditure of $45,000 to PACE Engineering to produce a Title 22 Engineering Report detailing the production and distribution of tertiary treatment effluent for recycled use on the Mount Shasta Resort Golf Course for irrigation purposes. It is in the best interest of the City and is reasonable in cost.

PROPOSAL
August 23, 2024
Ken Kellogg
Public Works Director
City of Mt. Shasta
305 N. Mt. Shasta Blvd.
Mt. Shasta, CA 96067
[email protected]
Dear Ken,
Subject: Title 22 Report
Proposal for Engineering Services
PACE Engineering, Inc. (PACE) is pleased to provide this proposal to the City of Mt. Shasta (City).
It is our understanding that the City desires to complete a Title 22 Report (Report) for their wastewater treatment plant (WWTP). Our proposed Scope of Services is below.
SCOPE OF SERVICES
TASK 100 – TITLE 22 REPORT
PACE will prepare a Report based on the outline provided in the California Water Board’s Guidelines for the Preparation of an Engineering Report for the Production, Distribution and Use of Recycled Water dated June 2023. Initially the Report will be provided in a draft form for review. A subsequent final Report will be prepared based on City and Division of Drinking Water (DDW) comments.
TASK 200 – REGULATORY ASSISTANCE
PACE will meet with the City and DDW to review their comments on the Draft Report. PACE will revise the document based on the comments provided by the City and DDW. It is anticipated that these revisions will be minor in nature.
TASK 300 – ADDITIONAL ASSISTANCE
PACE will provide additional assistance for tasks requested by the City that are related to the Report but outside of the specific Scope of Services. One item that is of particular note is related to the golf course disposal site. This site is privately owned and operated. As such, the City has little information on its infrastructure and irrigation practices. The Report will provide a general description based on the information that is available but will not include an investigation of these items. If more information is required, PACE can assist on a time-and-expense basis.
Mt. Shasta City Council Regular Meeting, January 13, 2025 Mt. Shasta City Council Regular Meeting, January 13, 2025 3535
PROPOSAL Title 22 Report
Three hard copies of the draft Report will be submitted to the City for comment, along with a digital version for DDW’s review. City and DDW comments will then be incorporated into a Final Report, of which five hard copies and one digital copy will be submitted to the City.
EXCLUSIONS
The following items are not included in the above Scope of Services:
1. Groundwater assessment.
2. Surface water assessment.
3. Environmental documentation.
4. Investigation of golf course infrastructure and irrigation practices.
5. Consultation with authority(ies) unless otherwise noted in the Scope of Services.
FEE
Our proposed fee for completing the identified Scope of Services is shown below. Refer to attached Person-Hour Breakdown and Fee Estimate. Given the uncertainty surrounding Task 300, it will be completed on a time-and-expense basis not to exceed without prior approval. The remainder of the tasks will be billed on a percent-complete basis.
Task 100 – Title 22 Report: $37,000
Task 200 – Regulatory Assistance: $7,000
Task 300 – Additional Assistance: $1,000
Total: $45,000
Thank you again for the opportunity to submit this proposal. Please contact me if you have any questions.
Sincerely,
Grant A. G. Maxwell, P.E.
Senior Engineer

Staff Report
Meeting Date: January 13, 2025
To: Mayor and City Council
From: Todd Juhasz, City Manager
Subject: Consideration of Granting Three Easements to PacPower for Wildfire Mitigation
Recommended Action: Consider granting three easements to PacPower in support of wildfire mitigation projects.
Background: PacifiCorp (doing business in Mt Shasta as Pacific Power) has a wildfire mitigation project planned within City limits. It includes the conversion of overhead to underground conductors at three locations, thus precipitating the easement request.
Compensation for the three parcels is a nominal $1,000 fee to cover administrative costs.
The written description of each parcel is outlined below and in the attached exhibits.
Tax Lot #057-241-630
As part of the project, Pacific Power is requesting an easement in the northeast corner of tax lot
63. There is an existing 10’ wide easement for the existing facilities recorded in Volume 534, Page 609 and shown as a dashed line on the enclosed easement exhibit map (identified as “Exhibit B”). The new easement will overlap the existing easement with the exception of a narrow strip of additional space needed. The easement area is 10’ wide with a total of 829 square feet (sf). The square footage includes a 12’x12’ area on the east property line adjoining Commercial Way where an underground vault (84”x56”x48”) will be installed. A sectionalizing cabinet will be placed above it on a concrete pad measuring 5.5’ x 7.5’. The remainder of the easement area is needed for underground conduit and cable.
Tax Lot #057-241-510
An irregular-shaped, 163 sf easement is needed for underground conduit and cable that joins to the easement described above over tax lot #057-241-630. Most of the new easement is locatedwithin the existing easement recorded in Volume 534, Page 609. The underground conduit will connect to the existing vault.
Tax Lot #057-241-530
An irregular-shaped, 140 sf easement is needed for underground conduit and cable that is in the northwest corner of the property and will connect to the existing vault.

SE1/4 of Section 16, Township 40 North, Range 4 West, Mt. Diablo Meridian Together with the right of access, for Grantee, its contractors, or agents, to the right of way from adjacent lands of Grantor for all activities in connection with the purposes for which this easement has been granted; and together with the present and (without payment therefor) the future right to keep the right of way clear of all brush, trees, timber, structures, buildings and other hazards which might endanger Grantee’s facilities or impede Grantee’s activities.
At no time shall Grantor conduct or permit any ground penetrating activity or excavation in the right of way without the express written consent of the Grantee. Subject to the foregoing limitations, the right of way may be used for other purposes not inconsistent, as determined by the Grantee, with the purposes for which this easement has been granted.

Such arbitration shall be in accordance with the rules and procedures of the American Arbitration Association (AAA). Notwithstanding any AAA rules and procedures or any other provisions or any state or federal laws, the parties agree that the arbitrators shall not consider or award punitive damages as a remedy. Grantor represents and warrants that it possesses all right, title and interest in and to the right of way area, free and clear of any lien, security interest, encumbrance, claim, license or other restriction that would interfere with Grantee’s use of the right of way area for the purposes contemplated hereunder.

SUBJECT: Closeout of Fund 90 – PW Reimbursable Projects RECOMMENDATION:
Staff respectfully requests the City Council approve the closing out of Fund 90 – Public Works Reimbursable Projects and reallocate the $19,532.60 cash on hand balance to Fund 12 - Equipment Replacement Reserve.
BACKGROUND & SUMMARY:
Fund 90 – Public Works Reimbursable Projects fund has not been used for many years.

Subject: Consideration of Supplemental Funds for the Chamber Recommended Action: Consider whether to provide an additional $15,000 in funding to the Mt.
Shasta Chamber of Commerce (Chamber).
Background:
Staff was contacted by Kaila Burns from the Chamber wondering why the City’s supplemental support payment was lower than in 2023. She was under the impression that Council had approved a permanent increase in support funding amounting to $15,000.
After researching the issue, it was determined that at the November 13th City Council meeting in 2023, Council approved a one-time payment to the Chamber totaling $15,000.

FROM: Jeff Mitchem, Planning Director
DATE: January 13, 2025
SUBJECT: Surplus Lands / Exempt Surplus Lands Declaration City Owned Property: APN’s 067-010-010, 067-010-020 and 067-010-140 ATTACHMENTS: A. City Council Resolution CCR-24-XX Surplus Land Exhibit A – Surplus Lands Map; Exhibit B – Notice of Availability (NOA)
RECOMMENDATION
Staff recommend City Council consider the record and adopt attached resolution CCR-24-XX (Attachment A) declaring portions of APNs 067-010-010 and 067-010-020, and all of APN 067-010- 140 owned by the City of Mt. Shasta as “Surplus Land” and portions of APNs 067-010-010 and 067- 010-020 as “Exempt Surplus Land” (as depicted in Exhibit A of Attachment A) and directing Staff to prepare and submit a Notice of Availability (Exhibit B of Attachment A).
BACKGROUND
Before the City may take any action to dispose of land consistent with City policies or procedures, the City Council must declare the land as either “surplus land” or “exempt surplus land”, pursuant to the provision of the Surplus Lands Act (SLA) found in California Government Code, Title 5, Division 2, Part 1, Chapter5, Article 8.
Surplus Land. Pursuant to Government Code section 54221(b)(1), portions of The Landing properties are declared “surplus land”. The City may not solicit or accept offers to purchase or develop surplus land prior to publishing a Notice of Availability (NOA) for a 60-day noticing period and, if in receipt of any responses to the NOA, completed a 90-day good faith negotiation period with those parties.
Exempt Surplus Land. Pursuant to Government Code section 54221(f)(1)(J)(i), portions of The Landing properties are declared “exempt surplus land”. The exempt surplus land is subject to a valid legal restriction not imposed by the City of Mt Shasta prohibiting residential use with no feasible mitigation to avoid the prohibition of housing. The exemption declaration accompanied by written findings shall be provided to HCD at least thirty (30) days prior to disposition. The net surplus land declaration shall consist of a total of 93.45 acres described as follows:
APN Gross Site Area Land Use Covenant Net Surplus Land
067-010-010 19.5 acres 13.88 acres 5.62 acres
067-010-020 44.4 acres 6.76 acres 36.83 acres
067-010-140 51 acres -- 51 acres
Total 114.9 acres 20.64 acres 93.45 acres
Mt. Shasta City Council Regular Meeting, January 13, 2025 86 Disposal of Land Within SLA. After City Council’s declaration by resolution of the above described
93.45 acres of city-owned property as surplus land, Staff shall execute the following in compliance with the SLA:
a) Pre-Negotiation and Disposal Notice. Send to HCD for review, the NOA, City Council Resolution declaring surplus land and Notice of Exemption (NOE) for the portions of the property restricted by covenant.
b) Notice of Exemption. Publish (online and/or newspaper) the NOE including exemption findings and City contact information 30 days prior to disposition. c) NOA Period (60-days). Send to HCD and all CalHFA-certified housing sponsors and local public entities the NOA. Interested entities must notify the City within 60 days of the NOA being sent.
d) Good Faith Negotiation Period (90 days). Upon receipt of a timely Notice of Interest, commence negotiations for a period of 90 days immediately following the end of the 60-day NOA period.
e) Post-Negotiation and Proposed Disposition Summary. Send to HCD for review, a Proposed Disposition Summary at the conclusion of negotiations at least 30 days prior to disposition.
Disposal of Land Outside SLA. Should negotiations fail (concluding the 90-day negotiation period) with respondents to the NOA, the City may dispose of the land outside of the SLA. In order to do so, the City must establish and document that good faith negotiations have taken place with each respondent to the NOA, and any offers rejected on grounds including, but not limited to, the following:
a) The local agency and buyer/lessee cannot agree on the sales price and terms or lease terms. b) Priority is given to a competing offer that includes a greater number of affordable units or, in the case of a tie in the number of units, the lowest average level of affordability consistent with Government Code section 54222.5.
c) The interested entity is not responsive to a local agency’s reasonable conditions or restrictions as described in the NOA, where consistent with these Guidelines and the SLA.
HCD may request a purchase and sale or lease agreement disposing of surplus land when good faith negotiations do not result in a disposition to an affordable housing entity. In all dispositions of surplus land in which the local agency does not agree to price and terms or in which no entity responds, the following shall apply:
1. Affordability Covenant. An affordability covenant must be recorded against the property IF 10 or more residential units are developed on the property, not less than 15 percent of the total number of residential units developed on the property shall be sold or rented as affordable housing.
2. Rent Restrictions. Rental units shall remain at an affordable housing cost to, and occupied by, lower-income households for a period of at least 55 years.
3. Prior to Issuance of Permit. These requirements shall be contained in a covenant or restriction to be recorded against the surplus land prior to land use entitlement.
4. HCD Notice. The City shall provide a draft copy of any restrictions to be recorded against the surplus land to HCD as an attachment to the form prescribed by HCD (attached).
ENVIRONMENTAL REVIEW
The action fails to meet the definition of a “project” under CEQA. Though a discretionary act, Mt. Shasta City Council Regular Meeting, January 13, 2025 87 approval of a resolution to designate city-owned land as surplus constitutes activity not capable of causing a direct or reasonably foreseeable indirect physical change in the environment as the action does not concentrate, nor shift property uses within the City of Mt Shasta. Additionally, all future development of the surplus land will be subject to CEQA.

Section 1: The Properties are "surplus land" as defined by the Act, because the Properties are owned in fee simple by the City, and portions of the properties fall within the definition of "exempt surplus land" as set forth in the Act.
Section 2. The City Council authorizes and approves the form of the Notice of Availability (NOA), attached hereto as Exhibit C, and authorizes the City Manager, Planning Director, or designee(s) to comply with the requirements of the Act, to issue the Notice of Availability to those statutorily entitled to receive it pursuant to Government Code Section 54222, and to negotiate in good faith with those entities, if any, who submit qualified Notices of Interest (Government Code Sections 54222.5 and 54223).
