21 Cal OES Form 130 Instructions
A Designation of Applicant’s Agent Resolution for Non-State Agencies is required of all Applicants to be eligible to receive funding. A new resolution must be submitted if a previously submitted resolution is older than three (3) years from the last date of approval, is invalid, or has not been submitted.

When completing the Cal OES Form 130, Applicants should fill in the blanks on pages 1 and 2. The blanks are to be filled in as follows:

Resolution Section:

Governing Body: This is the group responsible for appointing and approving the Authorized Agents.

Examples include: Board of Directors, City Council, Board of Supervisors, Board of Education, etc.

Name of Applicant: The public entity established under the laws of the State of California.

Examples include: School District, Office of Education, City, County or Non-profit agency that has applied for the grant, such as: City of San Diego, Sacramento County, Burbank Unified School District, Napa County Office of Education, University Southern California.

Authorized Agent: These are the individuals that are authorized by the Governing Body to engage with the Federal Emergency Management Agency and the California Governor’s Office of Emergency Services regarding grants for which they have applied.

There are two ways of completing this section:

1. Titles Only: The titles of the Authorized Agents should be entered here, not their names. This allows the document to remain valid if an Authorized Agent leaves the position and is replaced by another individual. If “Titles Only” is the chosen method, this document must be accompanied by either a cover letter naming the Authorized Agents by name and title, or the Cal OES AA Names document. The supporting document can be completed by any authorized person within the Agency (e.g., administrative assistant, the Authorized Agent, secretary to the Director). It does not require the Governing Body’s signature.

22 Checking Universal or Disaster-Specific Box: A Universal resolution is effective for all past disasters and for those declared up to three (3) years following the date of approval. Upon expiration it is no longer effective for new disasters, but it remains in effect for disasters declared prior to expiration. It remains effective until the disaster goes through closeout unless it is superseded by a newer resolution.

Governing Body Representative: These are the names and titles of the approving Board Members.

Examples include: Chairman of the Board, Director, Superintendent, etc. The names and titles cannot be one of the designated Authorized Agents. A minimum of three (3) approving board members must be listed. If less than three are present, meeting minutes must be attached in order to verify a quorum was met.

Certification Section:

Name and Title: This is the individual in attendance who recorded the creation and approval of this resolution.

Examples include: City Clerk, Secretary to the Board of Directors, County Clerk, etc. This person cannot be one of the designated Authorized Agents or Approving Board Member. If a person holds two positions (such as City Manager and Secretary to the Board) and the City Manager is to be listed as an Authorized Agent, then that person could sign the document as Secretary to the Board (not City Manager) to eliminate “Self-Certification.”

DOLLY PARTON DAY
24 CITY COUNCIL AGENDA ITEM # 9
Staff Report
MEETING DATE: October 12, 2026
TO: Honorable Mayor and Members of the City Council
FROM: Kim Fowler, Acting City Manager
SUBJECT: Appointment of City Treasurer
X Regular Special Consent Closed
RECOMMENDATION: Staff recommends appointing Shannon Norris, Finance consultant, to the position of City Treasurer for the remainder of the current term, which ends in 2028.

DISCUSSION: The City’s previously appointed Treasurer, Malisa Dodd, submitted her resignation with the City of Mt. Shasta; her employment ended on October 6, 2026. Malisa’s departure means that the Treasurer’s seat is currently vacant.

Staff recommends appointing Shannon Norris, who is currently serving as one of the City’s Finance consultants.

The City Treasurer is responsible for compiling reports, including but not limited to payroll, disbursements, revenue status, and monthly investment and financial reports for City Council review and approval.

AUTHORIZATION: Mt. Shasta Municipal Code Section 2.04.020 assigns the City Council with the responsibility of appointing a City Treasurer. The City Treasurer is not required to be a resident or registered voter within the City of Mt. Shasta, but should have expertise in government finance, municipal accounting and related fields.

Alternatively, the City Council can enact an ordinance to delegate the appointment power to the City Manager or retain the authority to themselves. If retained, the Council has sixty days from the vacancy date to appoint a successor.

FISCAL IMPACT: There is no fiscal impact in the appointment of a City Treasurer.

ENVIRONMENTAL REVIEW: The activity is covered by the general rule that CEQA does not apply where it can be seen with certainty that there is no possibility that the activity will have a significant effect on the environment (CEQA, Article 5, Section 15061(b)(3)).

PUBLIC NOTIFICATION: The agenda was posted in accordance with the Brown Act. 25 MEETING DATE: October 12, 2026
TO: City Council
FROM: Rachel Agron, Deputy City Clerk
SUBJECT: Library Tax Advisory Committee Appointments
X Regular Special Consent Closed
RECOMMENDATION: Staff recommends that the City Council review Committee applications and make appointments to the Library Tax Advisory Committee.

BACKGROUND: The Library Tax Advisory Committee has several vacant seats. Members of the public have submitted applications to serve on the Committee.

SUBJECT:

October 12, 2026
Members of the City Council Kim Fowler,
Acting City Manager
Library Expansion Project: Construction RFP
X Regular Special Consent Closed
RECOMMENDATION: The City has received the Library Modernization Expansion cost estimates and is seeking direction from the City Council on how to proceed with next steps.

DISCUSSION: At the May 11, 2026 City Council meeting, staff presented two cost estimates from Sierra West Group, a professional cost estimator, for the Mt. Shasta Library Renovation and Expansion project (Attachment A). The two estimates are for:

1. Entry renovation, $1,989,366

2. Community room, $1,567,083
It was understood that the cost estimates were high, or conservative. Understanding a construction loan would be required, the City Council directed Finance staff to review the cost estimates and run scenarios to determine debt service costs so that the City Council could decide whether to build out the project in phases, or all at once.

Meanwhile, Dennis Johnson on the Library Tax Advisory Committee (LTAC), has shared with staff that it’s possible a construction bid on one of the two construction phases could come in below the existing library fund’s reserve amount of $1.5M. If this is the case; there is no need for a construction loan.

Given that much time has passed since this discussion began, staff is seeking direction from City Council re: whether to wait for the Finance team to finish running some numbers, or go ahead with issuing an RFP now to solicit construction bids from potential contractors. 30

Page 2 of 2 ends

FISCAL IMPACT: No impact if a construction bid comes in below the existing library reserves fund of $1.3M.

31 1 Bid, (Sole Sourced or Negotiated) + 15% to +38%
2 - 3 Bids + 8% to +12%
4 - 5 Bids + 4% to - 4%

Opinion of Probable Cost

CONTINGENCY
BID
An offer to enter into a contract at a fixed price good for a limited length of time.

SOFT COSTS - Not included in Current Cost Estimate
The total cost is based on the work being performed by a single prime contractor in a continuous phase with construction.

PREFACE TO OPINION OF PROBABLE COST
The Opinion of Probable Cost hereunder has been compiled from drawings and specifications believed to be an accurate portrayal of the project as drawn and indicated by the architect and/or engineers on drawings. If said drawings and specifications are incomplete, the project cost engineer has included those items which would usually appear in final drawings and specifications for a complete project in a manner ordinarily prudent under the circumstances. Specialty items unknown to the cost engineer will not normally be included unless communicated through the architect and/or engineers.

The user is cautioned that changes in the scope of the project or the drawings and specifications after the Opinion of Probable Cost has been submitted can cause cost changes and the cost engineer should be notified for appropriate addenda to be issued to the Opinion of Probable Cost.

Escalation has been added to the Opinion of Probable Cost to the anticipated midpoint of construction on the whole project.

The escalation is based on a starting date believed to be accurate; however, unwarranted delays should be cause for added escalation at the current rate.

The Opinion of Probable Cost has also been adjusted for geographical location based on local material and labor rates as well as local construction practice in prevailing wage environment.

In the current Seller's market for construction, our experience show the following results on competitive bids, as a differential from final Opinion of Probable Cost.

Accordingly, it is extremely important that the owner maintain continuous contact with the bidders during the bid period to assure a minimum of 4 - 5 Bids
An Opinion of Probable Cost shall be construed as an indefinite evaluation of cost based on similar structures, produced from plans and/or criteria during early stages of design commonly indicated as schematic or concept level. The cost engineer will add items which are not on the plans and use judgment but cannot know in total what the architect/engineer will later include.

In providing Opinion of Probable Costs, the Client understands that the consultant has no control over the cost or availability of labor, equipment or materials, or over market conditions or the Contractor's method of pricing, and that the Consultant's Opinion of Probable Costs are made on the on the basis of the Consultant's professional judgment and experience and historical costs and data as the basis of pricing. The Consultant makes no warranty, express or implied than the bids or the negotiated cost of the work will not vary from the Consultant's Opinion of Probable Cost.

The Opinion of Probable Cost is comprised of a survey of the quantities measured from the plans and specifications beyond the schematic stage commonly known as design development or working drawings. The estimator will add those items which may not appear on the plans but which he deems may latter be included by the Architect & Engineers.

The Owner and the Consultant agree that certain costs and changes may be required, and therefore, the final construction cost of the Project may exceed the Opinion of Probable Cost.

These costs are related to those items in a project that are necessary to prepare and complete the non-construction needs of the project. Soft costs include the architect's fees, the construction management services, the engineering reports and fees, the appraisal fee, the toxic report fee, owner contingencies, inspections, bidding/ award costs, any government fees - including the plan check fee, the cost of the building permit, any assessments, any sewer and water hook-up fees. These costs are related to those items in a project that are necessary to prepare and complete the non-construction needs of the project. Soft costs do not include construction, telecommunications, furnishings, fixed equipment, and expenditures for any other permanent components of the project.

The Opinion of Probable Cost will make the assumption that the following will be covered separately or not required for this project, unless specifically noted.

1. Hazardous abatement

2. Offsite work

3. Utility company fees, unless otherwise noted.

4. Any unforeseen subterranean conditions or objects

48 CITY COUNCIL AGENDA ITEM # 11
Staff Report
MEETING DATE: October 12, 2026
TO: Members of the City Council
FROM: Casey Glaubman, Mayor
SUBJECT: Appointment of City Manager
X Regular Special Consent Closed
RECOMMENDATION: The Mayor, as representative of the City Council to negotiate a contract with Kim Fowler for the position of City Manager, recommends approval of a contract, included as Attachment A.

DISCUSSION: The City’s previous City Manager, Todd Juhasz, was voted by the City Council to be placed on paid Administrative Leave on July 8, 2026. On July 13, 2026, the City Council appointed the City’s Planning Director, Kim Fowler, as Acting City Manager. On September 27, 2026, Todd Juhasz’s City Manager contract expired.

In the last three months as Acting City Manager, Kim has done a commendable job managing city business. This includes hosting two (2) town hall meetings for The Landing Conceptual Master Plan, preparing multiple ordinances for approval (Tiny Homes on Wheels, Parklets, Mobile Home Rent Stabilization), preparing multiple resolutions for approval (Opportunity Zones, Measure H), onboarding a Finance consultant and Planning consultant, preparing contracts and contract revisions (Chamber of Commerce, The Asension Aesthetics, WBC Campaigns), and updating City Hall processes and procedures.

Kim graduated from the University of California at Irvine in 2004 with three (3) Bachelor of Arts degrees and began her career as a staff planner in Riverside County. Over the next two decades, Kim worked in both the public and private sectors, with increasing management responsibilities in every assignment. Kim is well positioned to be successful in her role as the City Manager.

AUTHORIZATION: Mt. Shasta Municipal Code Section 2.50.020 assigns the City Council with the responsibility of appointing a City Manager.
49

Page 2 of 2 ends

FISCAL IMPACT: Onboarding Kim as the City Manager saves the City from going through a potentially lengthy and costly process of working with a headhunter to recruit for a City Manager from outside the organization. The cost of a headhunter is 15% to 35% of an employee’s first year salary; this equals $27,000 to $63,000. Kim’s contract also excludes a ‘relocation reimbursement,’ which could include a cost of $10,000 upon hiring another candidate. Further, if appointed, the position of Planning Director will be backfilled by a consultant who costs the city less than the current salary and benefits package of the Planning Director.

ATTACHMENTS:

K. Life Insurance. The City will not contribute to a life insurance plan for Employee.

L. Membership and Development. 6. General Provisions.
53 A. Hours of Work. It is recognized that Employee must devote a great deal of time outside normal office hours to business of the City, and to that end Employee shall be allowed to take compensatory time off as she shall deem appropriate during normal office hours. B. Business Expenses. The City agrees to pay for City-related and non-personal business expenses. The Finance Director shall be authorized to disburse such monies upon receipt of duly executed expense or petty cash vouchers, receipts, statements, or personal affidavits, as and up to the amount budgeted.

7. Termination of Employment and Severance.

A. Employee may terminate this Agreement at any time upon sixty (60) days written notice to the City. During the notice period, all the rights and obligations of the parties under this Agreement shall remain in full force and effect.

B. The City Council may terminate this Agreement at any time with good cause, or without cause.

C. If Employee is paid severance pay as provided in this agreement, payment of such severance shall be conditioned upon Employee’s written waiver of any claims, grievances or causes of action against City, its employees, agents, officers, and City Council arising out of or concerning this Agreement, Employee’s employment with the City, or the termination of her employment with the City. If the Employee does not agree to waive such claims, grievances or causes of action, the City shall not pay Employee severance pay.

D. In the event City terminates this Agreement without cause within twelve (12) months of October 13, 2026, the City shall pay Employee severance in a sum equal to twelve (12) months Total Base Salary. If termination occurs thereafter, the City shall pay employee severance of six (6) months of Total Base Salary. This severance is subject to the restrictions set forth in Government Code Section 53260, including, without limitation, that the maximum amount of severance pay that Employee may receive shall not exceed an amount equal to the portion of the Total Base Salary paid monthly, multiplied by the number of months left on the unexpired Agreement, or 18 months, whichever is less. And further provided that, pursuant to 54 Government Code Section 53243.2, any cash settlement related to the termination of this Agreement received by Employee from City shall be fully reimbursed to the City if Employee is convicted of a crime involving an abuse of her office or position while employed by the City.

In the event City terminates this Agreement, Employee shall be entitled to continued medical and dental benefits at her cost pursuant to the provisions of the federal Consolidated Omnibus Budget Reconciliation Act (COBRA).

E. Notwithstanding any provision in this Agreement to the contrary, the City shall not terminate this Agreement within six (6) months following a general municipal election except by 4/5 votes of the City Council.

F. Notwithstanding any provision in this Agreement to the contrary, the City Council may at any time immediately terminate this Agreement “for good cause.” If Employee is terminated for cause, the City shall not be required to pay any severance under this Agreement. Good cause means:
a. Conviction of any felony that adversely affects the reputation of entire the City or Employee.
b. Conviction of a misdemeanor arising out of Employee’s duties under this Agreement and involving a willful or intentional violation of law. c. Any willful abandonment of duties; or
d. Any conduct which violates the City’s Personnel rules and for which a City employee may be terminated.

Good cause shall also include, but not be limited to, the permanent disability of Employee, or the Employee becoming otherwise unable to perform the duties of her employment, by reason of sickness, accident, illness, injury, mental incapacity or health for a period of six (6) weeks following the exhaustion of all available leave balances and any applicable Family Medical Leave Act or California Medical Leave Act leaves, or where the same occurs for forty (40) working days over a sixty (60) working day period following the exhaustion of such leaves.

G. Notwithstanding any provision in this Agreement to the contrary, the City Council may suspend Employee with full pay and benefits at any time during the term of this Agreement.

8. Review and Evaluation.

A. At the six month anniversary of her appointment and annually thereafter, the City Council shall conduct an evaluation of the City Manager’s performance and discuss the results of the same with the City Manager. The evaluations 55 shall include a self-evaluation by the City Manager in written form in reference to identified goals, achieved goals, challenges, successes and plans for the future. In conjunction with the annual performance evaluations of the City Manager, the City Council may conduct a review of the City Manager’s salary/benefits and authorize adjustments.

9. Indemnification.

A. The City shall defend, hold harmless and indemnify Employee against any tort, civil rights, personnel, discrimination, professional liability claim or demand or other legal action, arising out of an alleged act or omission occurring in the performance of Employee’s duties in accordance with the provisions of Government Claims Act and California Government Code Section 825 and shall provide a defense to Employee in accordance with Government Code Section 995. The City may decline to defend and/or indemnify Employee only as permitted by the California Government Code.

The City may compromise and settle any such claim or suite and pay the amount of any resulting settlement or judgement. Provided, however, that the City’s duty to defend and indemnify shall be contingent upon Employee’s good faith cooperation with such defense.

66 CITY COUNCIL AGENDA ITEM # 13
Staff Report
MEETING DATE: October 12, 2026
TO: Honorable Mayor and Members of the City Council
FROM: Kim Fowler, Acting City Manager
SUBJECT: General Fund Budget Adjustment for Contract Planning Services X Regular Special Consent Closed
RECOMMENDATION: Staff recommends that the City Council adopt a resolution to approve a budget adjustment in the amount of $90,000 and approve a contract with Placeworks for consultant Planning services.

BACKGROUND: On July 13, 2026, the Planning Director was appointed by the City Council to be the Acting City Manager; Environmental Science Associates (ESA) was onboarded to backfill some of the Planning Director’s workload; specifically, preparation of a General Plan Amendment (Noise Element) and Noise Ordinance. ESA does not have the bandwidth to take on the balance of the Planning Director’s workload.

DISCUSSION: Attached for the City Council’s review and consideration is a contract in the amount of $90,000 with PlaceWorks to provide general Planning services.

PlaceWorks will support the City by assisting with review of ongoing planning projects through preparation of staff reports, drafting public notices, and other materials needed for City consideration of applications. As part of the review process, PlaceWorks will coordinate with other City departments to ensure that relevant comments, conditions, and considerations are incorporated into the analysis. Serving as an extension of City staff, PlaceWorks will also evaluate prospective projects and recommend the appropriate level of review. To manage costs, most work will be performed off-site, with meetings held as requested by the City Manager. The scope and volume of work may vary over time based on the City’s requests.

FISCAL IMPACT: No significant impact (see Attachment C, Budget Adjustment Request).

The monthly Planning Director cost is $13,972.79 through the end of the current fiscal year.

The average monthly Planning Consultant cost is $10,000.00. 67

SCOPE OF WORK
[See attached PlaceWorks Statement of Qualifications.]
75 October 7, 2026
Kim Fowler, City Manager
City of Mt. Shasta
305 N. Mt. Shasta Boulevard
Mt. Shasta, California 96067
Subject: On-Call Planning Services
Dear Kim:

Please accept this submittal as PlaceWorks’ statement of qualifications to provide on-call planning services for the City of Mt. Shasta. Given our planning experience throughout California, we are ideally positioned to help the City with a variety of planning and environmental review services.

PlaceWorks has a large, multidisciplined staff with vast experience, providing the full range of planning and environmental services. We can efficiently respond to demanding schedules on complex projects, and we are perfectly sized, nimble, and efficient. We have a well-honed workload/staff management process that includes effective time projection and tracking software and weekly, monthly, and quarterly companywide meetings to review and discuss staff availability.

We are honored to serve as an extension of staff in a number of communities and in diverse agencies. We are very experienced in municipal development review assistance, including staff report preparation and exhibits, developer/City facilitation, site planning, urban design, and presentations to commissions and City Councils.

Project Understanding
PlaceWorks will support the City by assisting with review of ongoing planning projects through preparation of staff reports, drafting public notices, and other materials needed for City consideration of applications. As part of the review process, we will coordinate with other City departments to ensure that relevant comments, conditions, and considerations are incorporated into the analysis. Serving as an extension of City staff, PlaceWorks will also evaluate prospective projects and recommend the appropriate level of review. To manage costs, most work will be performed off-site, with meetings held as requested by the City Manager. The scope and volume of work may vary over time based on the City’s requests. 76 Approach
PlaceWorks approaches every project as a collaborative effort. Our planners work as an integrated team to prepare analyses and technical documents that address applicable local, regional, and state regulations. We also recognize the importance of identifying and responding to community concerns, even when they extend beyond strictly technical requirements. Whether managing public outreach, analyzing environmental impacts, or developing practical, cost-effective mitigation, we serve as an integral partner throughout the planning and environmental review process. Our work is grounded in innovative problemsolving, accuracy, and close attention to detail.

Our senior project management team will serve as an extension of the City’s management team, maintaining focus on the City’s overall vision, budget, and schedule. We will coordinate with City staff and the consultants assigned to individual project components, establish a clear path forward, ensure that appropriate resources are available to address roadblocks, and keep each project moving. Consistent communication among all team members will be essential. We have decades of experience working collaboratively with other consultants, including direct competitors, to achieve shared goals. In this role, we will represent the City’s interests and recommend actions that best advance its vision.

Meetings
PlaceWorks will participate in periodic virtual project management meetings with City staff and to review project status, technical findings, emerging issues, and upcoming decisions. We will track assignments, coordinate follow-up, and direct team members as appropriate to keep work moving and resolve issues before they affect the schedule. Significant interpretations and decisions will be documented in the project file to maintain a clear record and preserve institutional knowledge.

Staff Reports and Presentations
PlaceWorks will prepare staff reports and supporting materials using the City’s established format or, if needed, a format developed in coordination with City staff. Reports will clearly present the project description, relevant graphics and photographs, analysis, findings, and recommended actions. We will coordinate comments from City reviewers, reconcile conflicting direction, and incorporate revisions so that submittals require minimal City review.

We will also prepare presentation materials to support Planning Commission and City Council consideration of projects and will assist, as needed, with ordinances, resolutions, approval letters, and other materials required to complete the review process. Final documents and attachments will be formatted for posting on the City’s website. 77 Quality Assurance Plan
PlaceWorks’ QA/QC program ensures consistent, accurate, and reader-friendly work products through the review steps outlined below.

Personnel and Responsibilities
Associate-level staff efficiently compile data, conduct routine fieldwork, and prepare initial drafts under the close supervision of project managers. Project managers review all work products before submittal, and a company principal provides an additional quality review.

Preparation of Documents
Before finalization, our word processing and editing team formats each document and checks spelling, headers and footers, the table of contents, and other production details. A technical editor then reviews consistency, readability, grammar, graphics, and typographical accuracy.

After corrections, a senior project manager or principal conducts the final review.

Budget and Schedule Control
Schedule Control
Clear communication and regular progress checks will keep each assignment on schedule and within budget. PlaceWorks will establish and monitor key milestones, including completeness review, technical analysis, CEQA review, conditions of approval, staff reports, and presentation materials. Regular conference calls and meetings will allow the team to identify issues early and confirm next steps.

If the schedule starts to slip, we first try and determine the reason. If it is a PlaceWorks staff resources issue, we can bring more staff into the project to meet the requirement. If the issue is outside of our control, then finding out early can help us recommend solutions to getting things back on track. Ultimately, it comes back to communication and making sure the City is aware of the schedule and our commitment.

Budget and Funding Requirements
PlaceWorks prepares monthly invoices detailed to billing codes and based on task orders, work authorizations, and funding sources. We will make any changes to the assignments following discussion with the City and ensure that the monthly billings follow the corrected weekly reports.

Each new assignment will have a project number and a series of labor codes based on milestones or tasks. PlaceWorks will keep the City apprised of the work progress and budget as part of the weekly and monthly reports
