A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOUNTAIN VIEW AUTHORIZING A LOCAL ENFORCEMENT AGENCY PURSUANT TO ASSEMBLY BILL 1276
WHEREAS, on October 5, 2021, Governor Gavin Newsom signed Assembly Bill (AB) 1276, which regulates the distribution of single -use food service ware accessories and standard condiments packaged for single-use by food facilities; and
WHEREAS, AB 1276 and Section 42272 of the Public Resources Code require a City, County, or City and County to authorize an enforcement agency , on or before June 1, 2022, to enforce these requirements;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Mountain View that, in conformance with Assembly Bill 1276 and Section 42272 of the Public Resources Code, the City of Mountain View is hereby designated the enforcement agency of the Public Resources Code regulations of single-use foodware accessories and standard condiments packaged for single use within the City of Mountain View . The City Manager, in conformance with the C ity Manager’s authority set forth in Mountain View City Code, Section 2.88, shall designate the City employees with the duty of enforcing A ssembly Bill 1276 and California Public Resources Code Section 42272.
