A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOUNTAIN VIEW
APPOINTING MAX BOSEL AS AN INTERIM POLICE CHIEF
UNDER GOVERNMENT CODE SECTION 21221( h)
WHEREAS, Government Code Section 21221( h) ot the Public Employees' Retirement Law pi,rmilFagoverningbody Lo appointa CalPERSretiree to a vacantpositionrequiring specializedskills clutingtectuiLinetil. I U1d PeilildtlenLcippuinLineiii. and ProvidesLhaL such appoinb'nenL will not subjectthe retiredperson to reinstatementfrom retirementor lossof benefitsso longas it is a singleappointmentthat doesnot exceed960 hoursin a fiscalyear; and WHEREAS, the City of MountainView desiresto appointMax Bosel as an interimappointment retired annuitantto thevacantpositionof PoliceChief for the City of MountainView underGovernmentCode Section21221( h), effectiveFebruary 10, 2023; and WHEREAS, the [ bv Council, the City of MountainView, and Max Bose| certify that Max Bosel has not andwill not receivea GoldenHandshakeor anyotherretirement -related incentive; and
WHEREAS,
an appointmentunder GovernmentCode Section21221( h) requiresthe retireeto be appointedinto the interimappointmentduring recruitmentfor o permanentappointment; and
WHEREAS,
the governingbody has authorizedthe searchfor a permanentappointmenton January I7, 2O23; and WHEREAS,
this GovernmentCode Section21221( h) appointmentshall only be madeonce and, therefore, will end on February9, 2024; and WHEREAS,
the entire employmentagreement, contract, or appointmentdocument between Max Boseland the City of MountainView has beenreviewedby thisbodyand is attached herein; and WHEREAS,
the compensationpaid to retireescannot be lessthanthe minimumnor exceedthe maximummonthly base salarypaid to otheremployeesperforming comparable duties, divided by 173333 to Pqualthe hourlyrate; and M

WHEREAS, the maximum monthly base salary for the duties of Police Chief is $29,394 and equivalent is $ 123. 33; and
WHEREAS, Max Bosel has not and will not receive any other benefit, incentive, compensation in lieu of benefit, or other form of compensation in addition to this hourly pay rate; now, therefore, be it
RESOLVED: that the City of Mountain View hereby certifies the nature of the employment 0 Max Bosel as described herein and as detailed in Lhe aLtached employmenL appointment docurnent, and that this appointment is necessary to fill the critically needed position of Police Chief for the City of Mountain View, beginning February 10, 2023, to perform work requiring specialized skills during the recruitment to fill the position on a permanent basis.
