Housing Laws to Receive OBAG 3 Funds
RECOMMENDATION
Adopt a Resolution of the City Council of the City of Mountain View to Comply with State Housing Laws, to be read in title only, further reading waived (Attachment 1 to the Council report).
BACKGROUND AND ANALYSIS
On February 14, 2023, Council adopted three resolutions of local support for MTC’s One Bay Area Grant Cycle 3 (OBAG 3) program. These resolutions of local support allow the City to receive $8,306,000 in OBAG 3 funding for three complete streets projects:
• Middlefield Road Complete Streets ($2,406,000);
• Moffett Boulevard Complete Streets ($3,500,000); and
• El Camino/Escuela/El Monte Intersection Improvements ($2,400,000).
In addition to resolutions of local support, the OBAG 3 program requires that cities adopt a resolution self-certifying compliance with State housing laws related to surplus lands, accessory dwelling units, and density bonuses. The attached resolution includes resolved clauses that:
• The City will comply with the terms of the Surplus Land Act;
• The City will comply with State laws related to Accessory Dwelling Units (ADUs) and Junior Accessory Dwelling Units (JADUs);
• The City will comply with State Density Bonus Law; and
• The City has no claims, actions, suits , or proceedings pending alleging violations of State housing laws.
