CITY OF MOUNTAIN VIEW
RESOLUTION NO. 18814
SERIES 2023
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOUNTAIN VIEW APPROVING INCLUSION OF THE FISCAL YEAR 2023- 24 UNDERGROUND UTILITIES AT 1020 TERRA BELLA PROJECT IN THE RECOMMENDED FISCAL YEAR 2023- 24 THROUGH FISCAL YEAR 2027- 28 CAPITAL IMPROVEMENT PROGRAM
WHEREAS, the City Council held duly noticed Study Sessions on April 3, 2023 and May 9, 2023 and took public comment from all persons wishing to be heard on the Recommended Fiscal Year 2023- 24 through Fiscal Year 2027- 28 Capital Improvement Program; and WHEREAS, the Recommended Fiscal Year 2023- 24 through Fiscal Year 2027- 28 Capital Improvement Program includes a proposed Fiscal Year 2023- 24 project to fund the undergrounding of utilities along the Terra Bella frontage for the 1020 Terra Bella Avenue affordable housing project; and
WHEREAS, the Underground Utilities at 1020 Terra Bella project is contingent upon advice from the State of California Fair Political Practices Commission (" FPPC") regarding a potential California Government Code Section 1090 conflict of interest, which would prohibit the City from proceeding with the project; and
WHEREAS, the City Council, nevertheless, wishes to include the Underground Utilities at 1020 Terra Bella project in the Recommended Fiscal Year 2023- 24 through Fiscal Year 2027- 28 Capital Improvement Program so the project may proceed without delay if the FPPC determines that no conflict of interest exists; now, therefore, be it RESOLVED: that the City Council of the City of Mountain View hereby approves inclusion of the Fiscal Year 2023- 24 Underground Utilities at 1020 Terra Bella project in the Fiscal Year 2023- 24 through Fiscal Year 2027- 28 Capital Improvement Program, as recommended by the City Manager, a copy of which is on file in the City Clerk' s Office. 1-
