Dear Honorable Mayor Hicks and Councilmembers,
I am pleased to report that the Board of Trustees approved the Joint Use Agreement (JUA) at its December 7, 2023 meeting. Our Board and district team value the positive impact this partnership has on our community, and we look forward to a successful collaboration with the City in the years to come.

City Manager McCarthy and Assistant City Manager Arnold raised a question yesterday regarding Board Policy (BP) and Administrative Regulation (AR) 1330. The updated BP/AR 1330 approved yesterday replace existing policies and establish the operating procedures needed for the District to comply with and implement the JUA in its current form.

These policies allow the Board to delegate authority fo r setting fees to the City as is set forth in the JUA. The proposed fee schedule in AR 1330 listing hourly rates of field rentals is for community groups who apply directly to the district for the use of facilities. Per BP 1330, and similar to previous board policies, the City is not required to adhere to and does not qualify for the community fee schedule for fields.

Instead, the JUA provision determines the fees structure for joint City/District use. BP 1330 states:
“The Superintendent or designee shall work with the partner agency, institution, or organization to develop a written site-specific joint use agreement that delineates the terms and conditions for joint use of district or community facilities, the parameters related to the partner agency’s assessment of fees, the responsibilities of all parties, and that the use will comply with the district’s board policies, administrative regulations and the Civic Center Act, California Education Code section 38130, et seq.”
