TITLE: Updates to City Council Policy B-5—
Claims & Litigation

RECOMMENDATION

Adopt a Resolution of the City Council of the City of Mountain View Amending City Council Policy B-5 to Change the Title of the Policy to “Claims & Litigation,” Clarify Authority to Resolve Claims and Litigation, and Update Procedures for Handling Liability Claims, to be read in title only, further reading waived (Attachment 1 to the Council report).

BACKGROUND

The City Council expressed an interest in reviewing Council Policy B -5 for purposes of improving procedural efficiency and clarifying existing policies regarding the authority of the City Attorney and the City Manager to manage liability claims and litigation. Staff reviewed the policy and presented clarifying amendments to Policy B-5 to the Council Finance Committee (CFC) for review and consideration on December 6, 2023. Those amendments include renaming the policy to “Claims & Litigation,” clarifying the delegation of authority granted to the City Attorney and the City Manager for the management of claims and litigation, aligning the establishment of litigation budgets with City Council Policy A-10, and updating the procedures to process liability claims.

The CFC considered and discussed the proposed amendments to Council Policy B -5 at its December 6, 2023 meeting and voted to recommend City Council approval of all of the proposed amendments as shown in redline in Attachment 2.
