BACKGROUND
Joint Use Agreement
On January 23, 2024, the City Council authorized the City Manager or designee to execute a new Joint Use Agreement (”JUA”) between the Mountain View Whisman School District (“District” or “MVWSD”) and the City of Mountain View for recreational use of school sites. This agreement includes 11 sites:
• Benjamin Bubb Elementary School (“Bubb School Field”)
• Mariana Castro Elementary School and Gabriela Mistral Elementary School (“Castro School Field”)
• O.J. Cooper Elementary School (“Cooper Park”)

• Amy Imai Elementary School (“Imai School Field”)
• Edith Landels Elementary School (“Landels School Field”)
• Monta Loma Elementary School (“Monta Loma School Field”)
• Jose Antonio Vargas Elementary School (“Vargas School Field”)
• Stevenson/Theuerkauf Elementary Schools (“Stevenson School Field”)
• Crittenden Middle School (“Crittenden Athletic Sports Complex”)
• Graham Middle School (“Graham Athletic Sports Complex”)
• Whisman School site (“Whisman Park”)
Under the JUA, the City maintains these fields and the recreational area defined in the JUA's Attachments and manages reservations and public access during non -school hours. The JUA outlines the City's and the public's access to these sites, as well as the City’s and District’s maintenance responsibilities. The JUA was signed by both parties on February 26, 2024, and has a 10-year term.
Following execution of the JUA, the City and District reviewed the maintenance responsibilities outlined in Attachments 1 through 11 of the JUA and identified opportunities to clarify them, as outlined in the Analysis section of this memorandum . Any revisions to the Attachments of the JUA require that an amendment to the JUA to be executed with Council approval.
Restroom Facilities at Castro, Imai, and Landel Elementary Schools
In 2014, the City adopted the sixth update to the Parks and Open Space Plan (“POSP”). The POSP evaluated open space resources across the City and its neighborhoods and prioritized recommendations for acquiring, improving, and preserving parks and open space. The POSP included a recommendation to improve and renovate existing parks, with a highlighted project to work with the MVWSD to design and construct joint- use restrooms at Castro School Field, Landels School Field, and Imai School Field (formerly Huff School Field).
The City Council previously approved three capital improvement projects to provide restroom facilities at these sites : Bubb Park and Huff Park Restrooms, Project 04 -29; Landels Park Restrooms, Project 13 -34; and the Castro Park Bathroom, Partnership with the Mountain View Amendment to the Joint Use Agreement with Mountain View Whisman School District, Payment for Restroom Facilities at Castro, Imai, and Landels Elementary School

Whisman School District, Project 17-47. In partnership with the City, the District took the lead in designing and constructing the standalone restroom facilities at each site with input from City staff. As part of this partnership, the City is to reimburse the District for 50% of the design and construction costs associated with each restroom facility.
Following the execution of the 2024 JUA, the MVWSD began construction of the restrooms at Imai, Landels, and Castro school sites. Construction of each restroom facility was completed in November 2025, and the facilities opened for use on November 10, 2025. Surrounding site restoration was completed in spring 2026. The new restroom facilities are available to the public daily during non-school hours, including evenings, weekends, holidays, and school breaks , until 30 minutes past sunset.
ANALYSIS
Amendment to the Joint Use Agreement
The proposed amendments to the JUA Attachments are intended to clarify and update maintenance responsibilities within the Recreation Areas based on current site conditions and operational practices, and to incorporate the new restroom facilities completed since the agreement was executed.
A consistent amendment applicable to all sites clarifies that the City is responsible for removing trash from receptacles within the defined Recreation Areas, while the District is responsible for trash receptacles outside the Recreation Areas.
The amendment s to the JUA Attachments also include several site -specific updates , with the substantive changes summarized below:
• Clarifying the City’s maintenance responsibilities for the newly constructed restroom facilities at Castro, Imai, and Landels School Fields;
• Assigning responsibility for tree maintenance to the City within Recreation Areas at Cooper and Whisman School Fields;
• Updating landscape maintenance responsibilities at Bubb School Field, Crittenden Athletic Sports Complex, and Stevenson School Field;
• Incorporating a reciprocal statement that the City will not permit eating on artificial turf fields at Vargas School Field, Graham Athletic Sports Complex, and Crittenden Athletic Sports Complex; and

• Updating that the District is responsible for the maintenance of the shot put and long jump pits at both Crittenden and Graham Athletic Sports Complexes.
City and District staff worked collaboratively to develop the proposed amendment to the JUA Attachments. In practice, many of the responsibilities identified in the amendment have already been implemented by the respective parties, and the proposed changes formalize and clarify maintenance responsibilities as they are currently carried out at the school fields. All changes are identified by underline and strikeout in the attached copy of the proposed amendment (Attachment 1).
Restroom Facilities
Upon completion of the restroom facilities in November 2025, the City assumed maintenance and operational responsibilities for them. With Council’s acceptance of the restroom facilities, staff recommend that Council authorize the City Manager or designee to remit $941,571.05 to MVWSD for the City’s 50% share of the design and construction costs.
FISCAL IMPACT
There is no fiscal impact associated with approv al of the amendment to the JUA . The City’s existing budget includes sufficient funding for the maintenance and programming of the District fields.
Funding for the restroom facilities is included in Bubb Park and Huff Park Restrooms, Project 04- 29; Landels Park Restroom, Project 13-34; and Castro School Bathroom, Partnership with School District, Project 17 -47. All three projects are funded by the Park Land Dedication Fund for the City’s share of restroom facilities costs. The current available budget and the City’s share of project costs are summarized below.

The current combined available budget for the three projects is approximately $1.2 4 million, which is sufficient to fund the City’s total share of project costs of approximately $942,000.
Therefore, no additional appropriation is required. Any remaining funds will be returned to the Park Land Dedication Fund upon payment to the District and closeout of the projects.
