ORDINANCE NO.
AN ORDINANCE OF THE CITY OF MOUNTAIN VIEW
AMENDING THE ZONING MAP TO EXCLUDE PROPERTIES DESIGNATED ON THE MOUNTAIN VIEW REGISTER OF HISTORIC RESOURCES PRIOR TO JANUARY 1, 2025 FROM GOVERNMENT CODE SECTION 65912.157 (SENATE BILL 79) AND
FINDING THAT THE AMENDMENTS ARE EXEMPT FROM REVIEW UNDER THE
CALIFORNIA ENVIRONMENTAL QUALITY ACT,
PURSUANT TO CEQA GUIDELINES SECTION 15061(b)(3),
AS RECOMMENDED BY THE ENVIRONMENTAL PLANNING COMMISSION
WHEREAS, Senate Bill (SB) 79, signed into law on October 10, 2025 and codified in Government Code Sections 65912.155 to 65912.162, will make a qualified transit -oriented housing development project, as defined, an allowed use on any site zoned for residential, mixed, or commercial development that is located within a specified distance of a transit-oriented development stop, as defined, in urban transit counties (defined as a county with more than 15 passenger rail stations), which includes Santa Clara County, if the development complies with applicable requirements, as specified in the statute; and
WHEREAS, SB 79 (Gov. Code § 65912.161(b)(1)(F)) allow s a local agency to defer the application of SB 79 for any historic resource designated as of January 1, 2025 on a local register until after adoption of the next housing element by adopting an ordinance to exclude such sites; and
WHEREAS, on January 27, 2026, the City Council directed City staff to evaluate and prepare potential amendments to the City’s Zoning Code and Zoning Map to preserve locally designated historic resources from the application of SB 79, consistent with the authority provided under Government Code S ection 65912.161, and to return to the City Council with recommended implementing ordinances; and
WHEREAS, 24 parcels (as shown in Exhibit A , attached hereto and incorporated herein as though fully set forth herein) within the areas affected by SB 79 were designated as historic resources on the local register prior to January 1, 2025; and
WHEREAS, the City has complied with the procedures and requirements set forth in Government Code Section 65853, et seq., and Section 36.52.40, et seq. (Zoning amendments), of the Mountain View City Code; and
WHEREAS, the Environmental Planning Commission held a duly noticed public hearing on August 19, 2026 and recommended the City Council approve the Zoning Map Amendment; and

WHEREAS, the City Council held a public hearing on September 22, 2026 on this Ordinance and received and considered all information, documents, and comments presented at said hearing regarding the amendment to the Zoning Map, including the recommendation from the Environmental Planning Commission, the City Council report, and project materials; now, therefore,
THE CITY COUNCIL OF THE CITY OF MOUNTAIN VIEW DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. Findings. T he City Council hereby makes the finding s for a Zoning Map Amendment pursuant to Section 36.52.70 of the City Code:
a. The proposed amendment is consistent with the General Plan. The proposed amendment is consistent with the General Plan because it implements the General Plan ’s goals and policies supporting the preservation and protection of the City ’s historic and cultural resources. The amendments are consistent with General Plan Policy LUD 11.1 (Historical Preservation) as they exclude existing locally designated historic resources and properties from the application of SB 79 until the City’s next Housing Element update. This approach preserves the City ’s ability to identify, evaluate, and protect historic resources while maintaining consistency between the Zoning Code and the General Plan. The amendment implements the authority provided in Governme nt Code S ection 65912.161 to exclude qualifying historic resources from the application of SB 79. At the same time, SB 79 continues to apply in eligible areas that are not subject to the exclusion, thereby preserving opportunities for housing development consistent with state law. The amendment does not alter the General Plan land use designations, underlying Zoning Districts , or permitted land uses and , therefore, maintains consistency with the General Plan’s land use policies while ensuring that implementation of SB 79 does not inadvertently compromise the preservation of significant historic and cultural resources during the interim period before the next comprehensive Housing Element update;
b. The proposed amendment would not be detrimental to the public interest, health, safety, convenience, or welfare of the City. The proposed amendment would not be detrimental to the public interest, health, safety, convenience, or welfare of the City as it implements the authority provided under Government Code S ection 65912.161 to exclude locally designated historic resources from the application of SB 79. The amendment supports the public interest by preserving the City’s historically significant resources while maintaining implementation of SB 79 in all other eligible areas. Because the amendment does not modify the underlying Zoning Districts, permitted land uses, or development standards applicable to the affected properties, it will not adversely affect the public health, safety, convenience, or general welfare;
c. The site is physically suitable (including, but not limited to, access, provision of utilities, compatibility with adjoining land uses, and absence of physical constraints) for the requested zoning designation and anticipated land use development. The site is physically suitable (including, but not limited to, access, provision of utilities, compatibility with adjoining land uses, and absence of physical constraints) for the requested zoning designation and anticipated land use development because the proposed amendment does not change the -3-
underlying zoning designation, General Plan land use designation, permitted land uses, or development standards applicable to the affected properties. Rather, the amendment identifies locally designated historic resources that are excluded from the application of SB 79 pursuant to Government Code Section 65912.161. Existing access, public utilities, surrounding land uses, and physical site conditions will remain unchanged, and the amendment will not affect the physical suitability of the properties for development otherwise allowed under the City ’s General Plan and Zoning Ordinance; and
d. The proposed amendment is in compliance with the provisions of the California Environmental Quality Act (CEQA). The proposed project, including the amendment, complies with the California Environmental Quality Act (CEQA) because the amendment is exempt from CEQA pursuant to CEQA Guidelines Section 15061(b)(3), the common sense exemption, which provides that CEQA applies only to projects that have the potential for causing a significant effect on the environment. The amendment does not approve any phys ical development, increase development intensity, change existing land use designations, or modify underlying zoning regulations or development standards. As a separate and independent basis, Government Code Section 65912.160(c)(2) states that an ordinance consistent with the provisions of SB 79 shall not be considered a project under CEQA. Therefore, the proposed Zoning Map amendment is not a project under CEQA and does not have the potential for causing a significant effect on the environment.
SECTION 2. The Zoning Map Amendment, identifying 206 Bush Street (APN 158 -22-032), 445 Calderon Avenue (located on the common lot shared by APN 158 -57-001 through 158-57-019), 124-126 Castro Street (APN 158-15-038), 142-156 Castro Street (APN 158-15-038), 169-175 Castro Street (APN 158-20-012), 201 Castro Street (APN 158-22-011), 228 Castro Street (APN 158-13-039), 298 Castro Street (APN 158-13-047), 350 Franklin Street (APN 15 8-12-020), 394 Franklin Street (APN 158 -12-024), 403 Hope Street (APN 158- 23-049), 425 Hope Street (APN 158-23-067), 302 Loreto Street (APN 158-30-047), 484 Loreto Street (APN 158 -30-060), 157 Moffett Boulevard (APN 158-44-001), 372 Mountain View Avenue (APN 154 -08-023), 360 Oak Street (APN 158-12-007), 390 Palo Alto Avenue (APN 154-08-039), 472 South Shoreline Boulevard (APN 154-25-052), 322 View Street (APN 158-23-020), 327 View Street (APN 158-23-015), 1043 Villa Street (APN 158-13-007), 515 Villa Street (APN 158 -22-031), and 1074-1076 Wright Avenue (APN 150 -23-009) as “Properties excluded from Government Code Section 65912.157 (SB 79) until one year following the adoption of the seventh revision of the housing element,” as shown in Exhibit A, is hereby approved.
SECTION 3. Severability. If any section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held to be unconstitutional, such decision shall not affect the validity of the other remaining portions of this Ordinance. The City Council hereby declares that it would have passed this Ordinance and each section, subsection, sentence, clause, or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses, or phrases be declared unconstitutional.

SECTION 4. Publication. Pursuant to Section 522 of the Mountain View City Charter, it is ordered that copies of the foregoing proposed Ordinance be posted at least two (2) days prior to its adoption in three (3) prominent places in the City and that a single publication be made to the official newspaper of the City of a notice setting forth the title of the Ordinance, the date of its introduction, and a list of the places where copies of the proposed Ordinance are posted.
SECTION 5. Effective Date. Pursuant to Section 519 of the Mountain View City Charter, this Ordinance shall be effective thirty (30) days from and after the date of its adoption.
