A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MURRIETA,
CALIFORNIA, APPROVING A TENTATIVE AGREEMENT BETWEEN THE CITY OF
MURRIETA AND THE MURRIETA FIREFIGHTERS A SSOCIATION, REGARDING
PARTICIPATION IN THE IAFF MEDICAL EXPENSE REIMBURSEMENT PLAN
WHEREAS, the City of Murrieta (“City”) endeavors to recruit and retain the most qualified and talented employees to serve its citizens; and
WHEREAS, the compensation and benefits offered by the City to its employees are designed to aid in the City’s employee recruitment and retention efforts; and
WHEREAS, the Memorandum of Understanding (“MOU”) between the City and the Murrieta Firefighters Association (“ MFA”), adopted by City Council Resolution No. 19- 4097 covering the period July 1, 2019 through June 30, 2023 (“MFA MOU 2019-23”) expired June 30, 2023; and
WHEREAS, the City and MFA met and conferred in good faith and c ame to a ratified Tentative Agreement on a fair and equitable package of compensation and benefits for a successor MFA MOU for the period July 1, 2023 through June 30, 2026 (“MFA MOU 2023-26”), pursuant to the Meyers -Milias-Brown Act (“MMBA”) (Government Code sections 3500- 3511) and the City's Employer-Employee Relations Resolution No. 93-214; and
WHEREAS, on June 20, 2023, the City Council adopted Resolution No. 23- 4691, approving the Tentative Agreement for the Successor MFA MOU 2023-26 (“MFA MOU 2023-26 Tentative Agreement”); and
WHEREAS, the MFA MOU 2023 -26 Tentative Agreement included deal terms to establish a new retiree medical trust plan, with the parties agreeing to subsequently meet and confer on the specific MOU language for the new retiree medical trust plan and on the redirection of any amount funding another employer-sponsored account to the trust plan; and
WHEREAS, the parties have met and conferred to establish a new retiree medical trust plan provision for the MFA MOU 2023-26 and jointly prepared a Tentative Agreement Regarding Participation in the IAFF Medical Expense Reimbursement Plan dated August 20, 2024 (“Medical Trust Plan Tentative Agreement”) for this new provision to be added to the successor MFA MOU 2023-26 which they also desire to be made effective with City Council adoption of the Medical Trust Plan Tentative Agreement to allow member participation in the IAFF Medical Expense Reimbursement Plan (“Plan”); and
WHEREAS, the MMBA provides in Section 3505.1:
“If a tentative agreement is reached by the authorized representatives of the public agency and a recognized employee organization or recognized employee organizations, the governing body shall vote to accept or reject the tentative agreement within 30 days of the date it is first considered 2 at a duly noticed public meeting. A decision by the governing body to reject the tentative agreement shall not bar the filing of a charge of unfair practice for failure to meet and confer in good faith. If the governing body adopts the tentative agreement, the parties shall jointly prepare a written memorandum of understanding."
WHEREAS, once the City Council adopts the Medical Trust Plan Tentative Agreement for the MFA MOU 2023-26, the parties are required to jointly prepare a written MOU to present to City Council at a later date for consideration and adoption consistent with the Tentative Agreement, which remains pending from the prior MFA MOU 2023- 26 Tentative Agreement adopted by Resolution No. 23-4691; and
WHEREAS, once approved by the City Council, the Medical Trust Plan Tentative Agreement becomes a binding agreement between the parties, each in their own right; and
WHEREAS, upon City Council approval of the Medical Trust Plan Tentative Agreement, the benefit changes outlined therein shall be implemented; and
WHEREAS, the City Council desires to approve the Medical Trust Plan Tentative Agreement and commence the benefit changes stated therein.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MURRIETA, CALIFORNIA DOES HEREBY RESOLVE AS FOLLOWS:
Section 1. The recitals set forth above are true and correct and incorporated herein by this reference.
Section 2. T he executed Medical Trust Plan Tentative Agreement, a fully executed copy of which is attached hereto as Exhibit A, is accepted, approved, and adopted.
Section 3. The labor representatives of the City and MFA are directed to jointly prepare a written memorandum of understanding in accordance with the previous MFA MOU 2023-26 Tentative Agreement and the new Medical Trust Plan Tentative Agreement and present same to the City Council at a future date for its consideration and approval.
Section 4. The City Clerk shall certify to the adoption of this Resolution and deem it effective as of August 20, 2024, the same shall be in force and effect.
