Dear Mr. Smith.
The City is aware of your intent to seek development of your property located at the northeast corner of Whitewood and Clinton Keith Road, in the City of Murrieta. As part of that proposed development, you will be seeking annexation from LAFCO into the Eastern Municipal Water District ("EMWD") for your Property for sewer service. The City believes that there are significant sewer service availability issues in the area in which your property is located and the City has no knowledge or control over when, or if, EMWD will be able to adequately serve your property. Accordingly, the City is asking for you to sign and return this letter acknowledging the current status of sewer service to your property, that your application for annexation with LAFCO and any associated fees are at-risk, and that the City will be unable to issue any construction permits until such time as EMWD is able to provide a Service Availability Letter for your property and that any early development review, including the payment of any fees to the City, is also at-risk and that the City Is unable to guarantee any outcome or refund application fees. You further acknowledge that any conditions EMWD issues if and when its annexation process is complete may require modifications to any approved zoning entitlement for development granted by the City, or additional review pursuant to the California Environmental Quality Act as determined by the City.
