This Amendment to the Agreement, made effective on the date executed by the City by and between the City of Murrieta, a Municipal Corporation, duly organized and existing under and by virtue of the laws of the State of California ("City"), and the above re ferenced Contractor with reference to the following facts which are acknowledged by each party as true and correct:
RECITALS
Whereas, City is a general law city, formed and existing pursuant to the provisions of the California Government Code.
Whereas, City and Contractor entered into an Agreement on the Effective Date set forth above for the Services.
Whereas, City and Contractor wish to amend the Agreement as further set forth herein.
AMENDMENT
NOW, THEREFORE, it is agreed by and between the parties as follows:
1. The above recitals are true and correct.
2. The following terms of the Agreement are hereby amended to read as follows:
1. The Scope of Work for the Agreement is hereby amended to include the supplemental item(s) (“Amended and Expanded Scope of Work: Existing Interior Library Demolition and Add New Flooring” and “Amended and Expanded Scope of Work: Site Concrete and Sidewalks/Ramps”), attached hereto as Exhibit “A” and incorporated herein.

2. The additional costs for the amended Scope of Work shall be $810,006.34.
3. The total not-to-exceed amount of the Agreement is hereby amended to be $5,998,606.34, which amount is based upon the original not-to-exceed amount of $5,188,600.00 plus the additional Scope of Work authorized by this Amendment in the amount of $810,006.34. The contingency amount of 15% remains the same.
4. The Total Not-To-Exceed Contract Amount (“Contract Sum”) set forth on the Cover Page of the Agreement is hereby amended to read as: “$5,998,606.34, plus 15% contingency.”
3. All other conditions of the Agreement shall continue in full force and effect.

Cost to provide, labor, materials, and equipment to demo existing carpet tile, VCT flooring, and adhesive. Prepare subfloor for new flooring by grinding existing concrete. Install manufacturer approved moisture barrier system. Install new carpet flooring tiles, including layout, cutting, and transitions per the project specifications. Install new VCT flooring including layout, cutting, and transitions per the project specifications. Install new flexco rubber cove base per the specifications. Existing bookshelves to remain in place, flooring to be ran up to the base of the bookshelves. Removal of the office furniture is not included in this proposal, however coordination with the city provided vendor to remove the furniture will be coordinated with this subcontractor and the city vendor/subcontractor.
NOTE: A moisture test was taken on the existing floor area, the results came back very high for moisture in the slab, therefore, a moisture barrier system is required to provide a complete warranty.
