RESOLUTION NO. 26-4974
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MURRIETA,
CALIFORNIA TO SET A PUBLIC HEARING FOR THE ABANDONMENT
OF LOT A OF PARCEL MAP 28280 AND CAUSING THE PUBLISHING
AND POSTING OF THE NOTICES
WHEREAS, pursuant to California Streets and Highways Code §8300 et seq, (‘the Code”) an interested person, may request the abandonment (vacation) of a public services easement, and;
WHEREAS, Domenigoni-Barton Properties, LLC and Tres Estrellas, LLC owns Lot A of Parcel Map 28280 and has requested abandonment of a lettered lot located on their property in order to receive the full enjoyment of said property (Exhibit A and B), and; WHEREAS, pursuant the Code, at its discretion, the City Council may abandon all or part of a right-of-way easement within the City, and;
WHEREAS, the Planning Commission of the City of Murrieta conducted a hearing on September 23, 2026, and found the proposed abandonment consistent with the City’s General Plan, and;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MURRIETA, CALIFORNIA DOES HEREBY RESOLVE AS FOLLOWS:
Section 1. The recitals above are true and correct and incorporated herein by this reference.
Section 2. The City Clerk shall set a hearing for the proposed abandonment for November 17, 2026, at the regular City Council meeting scheduled for 4:00 p.m. at 1 Town Square, Murrieta, California.
Section 3. The City Clerk shall cause the publication of a notice of the hearing on the proposed abandonment for at least two successive weeks prior to the hearing in a newspaper of general circulation for the City of Murrieta. The notice shall provide a description of the street, highway, or public service easement proposed to be vacated and a reference to a map or plan, that shows the portion or area to be vacated and includes a statement that the vacation proceeding is conducted under this chapter. The description shall include the general location of the street or highway, its lawful or official name or the name by which it is commonly known, and the extent to which it is to be vacated.
Section 4. At least two weeks before the day set for the hearing, the City Clerk shall post conspicuously notices of the proposed abandonment along the line of the easement proposed to be abandoned in accordance with the Code.

Section 5. All property owners of record within 500 feet of the subject site will be notified by the City Clerk in a timely manner of the public hearing and invited to voice any concerns.
