A. Design Services Proposal
SVA and its Consultant/s (Design Team) shall provide the following services in accordance with the terms and conditions of the Agreement:

Reconcile design fee to align with current projected construction cost of $4,545,454.55.
*Prepare topo survey of additional area not included in original survey. *Re-work schematic design based on city selected option. *Estimated budget for scope of work described, actual cost +15% to be formalized with the city.

Architect will be compensated for the additional services delineated herein in accordance with the terms and conditions of the Agreement on a fixed fee basis in the amount of Two Hundred Twenty-Two Thousand Seven Hundred Dollars.
Architect shall not exceed this fee without Client’s prior written authorization. Reimbursable expenses of Architect will be invoiced in accordance with the terms and conditions of the Agreement.

It is expressly understood that the requirements of Cal. Business and Professions Code § 5536.22 requiring mutual written agreement by the parties prior to proceeding with the work are met by this Amendment. In the eve nt that contract negotiations are pending at the ti me this Amendment is executed, the parties understa nd and agree that upon execution of such final agreement, that all work performed under this Amendment will be governed by the terms and conditions thereof. In the event that an agreement has been executed by the parties at the time of this Amendment, it is understood that this Amendment amends the Agreement only as delineated herein, all other terms of the Agreement shall rema in the same. Architect will not proceed with work u ntil this form is executed and returned. The undersigned represents and warrants that he/she has the authority to bind the entity for which he/she is executing this Amendment .
