RESOLUTION R2022-__
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NAPA, STATE OF CALIFORNIA, APPROVING A TWO-YEAR EXTENSION OF THE DESIGN REVIEW PERMIT FOR THE PREVIOUSLY APPROVED NAPA RIVER INN PROJECT AT 500 MAIN STREET AND DETERMINING THAT THE ACTIONS AUTHORIZED BY THIS RESOLUTION ARE EXEMPT FROM CEQA WHEREAS, Napa Mill, LLC (the “Applicant’”) submitted an application for a second two-year extension of the previously approved Design Review Permit for a new hotel building and a third floor addition to the existing embarcadero building for the Napa River Inn Expansion (the “Project”) at 500, 520, 530, 540, 540-B, 542, 550 Main Street, 1071, 1091 Fifth Street, and 700 Brown Street (APNs 003-275-003, -004, 003-277-002, -003, -006, -008); and WHEREAS, the application for an extension was filed prior to the expiration of the Design Review Permit; and WHEREAS, the Planning Commission of the City of Napa, State of California, held a noticed public hearing on December 2, 2021, and has recommended approval of the subject application; and WHEREAS, the City Council of the City of Napa, State of California, held a noticed public hearing on February 1, 2022 on the subject application.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Napa as follows:
Section 1. The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution.
Section 2. The City Council hereby determines that the potential environmental effects of the actions authorized by this Resolution are exempt from the requirements of CEQA pursuant to Section 15332 of the CEQA Guidelines (Categorical Exemptions; Class 32) which exempts in-fill development projects that are consistent with the general plan designation and all applicable general plan policies as well as with applicable zoning designations, occurs within the city limits on a site smaller than five acres, has no value as habitat for endangered, rare or threatened species, would not result in any significant effects relating to traffic, noise, air, or water quality, and can be adequately served by all required utilities and public services. The exceptions to categorical exemptions identified in Section 15300.2 of the CEQA Guidelines are inapplicable because the land is in an urbanized area with no environmentally sensitive habitats or species of concern on the property, there has been no successive effort to intensify land uses in the area, and no unusual circumstances exist that would pose a reasonable possibility of having a significant effect on the environment, and the project does not involve or affect historic resources. Based on this analysis, no significant environmental effects would result from this project and the use of categorical exemptions is appropriate.
Section 3. The City Council hereby finds that the circumstances upon which the approval of the Design Review Permit were based have not substantially changed and that the findings made for the Napa River Inn in Resolution No. R2012-112 still apply to this project and adequately support the requested extension of the approvals.
Section 4. The City Council hereby grants a two-year extension of the Design Review Permit for the Napa River Inn Expansion Project to August 21, 2023. This extension is granted subject to compliance with the conditions of approval contained in Resolution No. R2012-112, except as modified herein.
Section 5. This Resolution shall take effect immediately.
I HEREBY CERTIFY that the foregoing resolution was duly and regularly adopted by the City Council of the City of Napa at a regular meeting of said City Council held on the 1st day of February 2022 by the following vote:
