RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NAPA, STATE OF CALIFORNIA, ESTABLISHING THE FINE AMOUNT FOR MALICIOUS OR EXCESSIVE FALSE FIRE ALARMS PURSUANT TO NAPA MUNICPAL CODE CHAPTER 9.65 WHEREAS, the City Council has considered an Ordinance entitled “Ordinance of the City Council of the City of Napa, State of California, amending Napa Municipal Code Title 9 to repeal section 9.04.040 and add Chapter 9.65 “Regulation of False Fire Alarms” to reduce the occurrence of false fire alarms (“False Fire Alarm Ordinance”); and WHEREAS, the False Fire Alarm Ordinance authorizes the City Council to establish by resolution the amount of the fine for a Malicious or Negligent False Fire Alarm; and WHEREAS, the City wishes to establish the fine amount for a Malicious or Negligent False Fire Alarm in an amount that is based on the City’s actual and reasonable costs of responding; and WHEREAS, a duly noticed public hearing was held by the City Council to provide an opportunity for comments from the public on the matter of the Malicious or Negligent False Fire Alarm Fine; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Napa, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution.
The City Council hereby establishes a fine amount of $546 (the “False Fire Alarm Fine”) for each “Malicious False Alarm” and each “Excessive False Alarm,” as those terms are defined by Napa Municipal Code Chapter 9.65.
This Resolution shall take effect immediately upon its adoption.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Napa at a public meeting of said City Council held on the 1st day of February, 2022, by the following vote:
