RESOLUTION R2022-__
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NAPA, STATE OF CALIFORNIA, approving the 2023 Annual REPORT AND BUDGET FOR THE oxbow BUSINESS PROMOTIONS ASSESSMENT AREA; authorizing the CITY CLERK TO SCHEDULE A PUBLIC HEARING ON JUNE 21, 2022, TO levY ASSESSMENTS IN accordance with nAPA mUNICIPAL cODE CHAPTER 3.29; AND DETERMINING THAT THE ACTIONS AUTHORIZED BY THIS RESOLUTION ARE EXEMPT FROM CEQA.
WHEREAS, pursuant to California Streets and Highways Code Section 36500, et seq. and Agreement No. 9354 between the City of Napa (“City”) and the Napa Downtown Association, Management of Assessment Districts, approved on June 19, 2007, the City Council reviews an annual report and budget for the Oxbow Business Promotions Assessment Area (“Oxbow BPAA”) and authorizes the levying of assessments upon businesses within the Oxbow BPAA boundary as outlined in Napa Municipal Code Chapter 3.29 (as used in this Resolution, the phrase “Oxbow BPAA” is the “Oxbow Business Improvement Area” defined by Napa Muncipal Code Chapter 3.29); and WHEREAS, the Advisory Board of the Oxbow BPAA caused to be prepared and submitted to the City the 2023 Annual Report and Budget, which is on file with the City Clerk, and is attached hereto as Exhibit “A” (2021 Budget to Actuals for the Oxbow BPAA and DBPTA); and Exhibit “B” (2022 Budget for the Oxbow BPAA and DBPTA); and Exhibit “C” (2022 Budget Estimate of Revenue Contributions to the Oxbow BPAA and DBPTA); and Exhibit “D” (2023 Annual Report for the Oxbow BPAA); and Exhibit “E” (Boundary Map for the Oxbow BPAA), (collectively, the “2023 Oxbow BPAA Annual Report and Budget”); and WHEREAS, the 2023 Oxbow BPAA Annual Report and Budget contains a full and detailed description of the improvements and activities to be provided to the Oxbow BPAA, the boundaries of the area, and the proposed assessments to be levied upon the businesses in the Oxbow BPAA; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City staff, and any information provided during public meetings.
NOW THEREFORE BE IT RESOLVED, by the City Council of the City of Napa, as follows:
The City Council hereby finds that the facts set forth in the recitals to this resolution are true and correct, and establish the factual basis for the City Council’s adoption of this resolution.
The City Council hereby determines that the actions authorized by this Resolution are exempt from CEQA, pursuant to CEQA Guidelines Section 15323 (normal operation of facilities for public gatherings).
The City Council hereby approves the 2023 Oxbow BPAA Annual Report and Budget.
The City Council hereby declares its intention to levy and collect assessments upon businesses within the Oxbow BPAA for Fiscal Year 2023.
The City Council hereby acknowledges the following members of the NDA Board of Directors who will serve as the 2022 Oxbow BPAA Advisory Board:

The City Council hereby sets the time and date to levy assessments in the Oxbow BPAA at a public hearing on Tuesday, June 21, 2022, at 3:30 p.m. at City Hall Council Chambers, 955 School Street, Napa, CA, at which time written and oral protests may be made in accordance with Streets and Highways Code Section 36524 and 36525.
The City Council hereby directs the City Clerk to give notice of the public hearing by publishing said notice once in a newspaper of general circulation in the city not less than seven days before the public hearing.
This Resolution shall take effect immediately upon its adoption.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Napa at a public meeting of said City Council held on the 7th day of June 2022 by the following vote:
