RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NAPA, STATE OF CALIFORNIA, (1) AUTHORIZING THE CITY MANAGER TO EXECUTE ON BEHALF OF THE CITY AMENDMENT NO. 2 TO THE AGREEMENT WITH DYETT & BHATIA FOR CONSULTANT SERVICES RELATED TO THE GENERAL PLAN UPDATE FOR AN ADDITIONAL AMOUNT OF UP TO $77,050 AND A TOTAL AMOUNT OF UP TO $1,607,873, AND (2) AMENDING THE CITY’S FIVE-YEAR CAPITAL IMPROVEMENT PROGRAM TO APPROPRIATE $100,000 OF THE NONRECURRING GENERAL FUND’S UNDESIGNATED FUND BALANCE TO FUND AN INCREASE TO THE EXPENDITURE BUDGET OF THE CAPITAL IMPROVEMENT FUND OF $100,000, AS DOCUMENTED IN BUDGET ADJUSTMENT FORM NO. 300, FOR THE PROJECT WHEREAS, in 2018, the City entered into an agreement (C2018-148) (“Agreement”) with Dyett & Bhatia, Urban & Regional Planners to prepare a comprehensive update to the City’s General Plan and an Environmental Impact Report to support the General Plan (“Project”); and WHEREAS, City Council authorized Amendment No. 1 to the Agreement in July 2021; and WHEREAS, Dyett & Bhatia has requested additional funds to complete the Project; and WHEREAS, Staff has prepared Amendment No. 2 to the Agreement for an additional amount of up to $77,050 and a total amount of up to $1,607,873; and WHEREAS, it is recommended to use the Nonrecurring General Fund’s undesignated fund balance to fund an increase to the expenditure budget of the Capital Improvement Fund of $100,000 as documented in Budget Adjustment Form No. 300 for the Project; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Napa as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution.
The City Council hereby authorizes the City Manager to execute Amendment No. 2 to the Agreement for an additional amount of up to $77,050 and a total amount of up to $1,607,873.
The City Council hereby appropriates $100,000 of the Nonrecurring General Fund’s undesignated fund balance to fund an increase to the expenditure budget of the Capital Improvement Fund of $100,000 for the Project budget, as documented in Budget Adjustment Form No. 300, attached hereto as Exhibit “A” and incorporated herein by reference.
This Resolution shall take effect immediately upon its adoption.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Napa at a public meeting of said City Council held on the 19th day of July, 2022, by the following vote:
