RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NAPA, STATE OF CALIFORNIA, ACCEPTING A PUBLIC UTILITY AND ACCESS EASEMENT GRANT DEED FROM THE NAPA VALLEY COMMUNITY COLLEGE DISTRICT FOR WATER FACILITIES, AND DETERMINING THAT THE ACTIONS AUTHORIZED BY THIS RESOLUTION ARE EXEMPT FROM CEQA WHEREAS, the Napa Valley College District (“District”) is in the process of modernizing its industrial technology building, including a new fire service to the building and a new on-site private hydrant; and WHEREAS, the new water facilities on the District’s side of the new meter will be owned by the District and will connect to an existing public 8-inch waterline; and WHEREAS, the City has requested the Napa Valley College District grant a 20-ft wide Public Utility and Access Easement for the existing public 8-inch waterline, fire hydrant, metered service, and appurtenances as well as the new 8-inch fire service and meter.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Napa, as follows:
1. The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution.
2. The City Council hereby determines that the actions authorized by this Resolution are exempt from CEQA pursuant to CEQA Guidelines Section 15301(b) which exempts minor alteration of existing utilities to provide water, electric power, natural gas, sewerage, or other public utility services.
3. The City Council hereby accepts the Public Utility and Access Easement Grant Deed from the District affecting a portion of APN 046-450-056 that is attached hereto as Exhibit “A” and incorporated herein by reference.
4. The City Council hereby authorizes the Public Works Director to execute a certificate of acceptance for the herein described Public Utility and Access Easement Grant Deed and record said deed at the Napa County Recorder’s Office.
5. This Resolution shall take effect immediately upon its adoption.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Napa at a public meeting of said City Council held on the 19th day of July, 2022, by the following vote:
