RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NAPA, STATE OF CALIFORNIA, (A) APPOINTING LIZ ALESSIO as cOUNCILMEMBER – dISTRICT 1, AND mAry luros as cOUNCILMEMBER – DISTRICT 3, each TO SERVE a full FOUR-YEAR TERM ON cITY COUNCIL as if ELECTED ON TUESDAY, NOVEMBER 8, 2022; AND (b) CANCELLING THE GENERAL MUNICIPAL ELECTION SCHEDULED FOR nOVEMBER 8, 2022 WHEREAS, On June 7, 2022 the City Council adopted Resolution R2022-046 Calling and Giving Notice of a General Municipal Election to be held on Tuesday, November 8, 2022 for the purpose of electing one Councilmember from District 1 and one Councilmember from District 3; requesting that the Napa County Board of Supervisors consolidate the General Municipal Election with the Statewide General Election, and requesting that the Napa County Registrar of Voters render specified services to the City relating to the conduct of the General Municipal Election; and WHERAS, The City Clerk posted the Notice of Election and the nomination period for the two Councilmembers began on Monday, July 18, 2022 and closed on Friday, August 12, 2022 at 5:00 P.M; and WHERAS, Pursuant to California Elections Code section 10229, as of the close of the nomination period on August 12, 2022, there was only one candidate for each Councilmember office to be elected for the General Municipal Election, and Elections Code section 10229 allows for one of the following courses of action to be taken by the City Council: (1) Appoint to the office the person who has been nominated; or (2) Hold the election; and WHEREAS, the only qualified candidates for the General Municipal Election are: Liz Alessio for Councilmember from District 1, and Mary Luros for Councilmember from District 3; and WHEREAS, on August 16, 2022, the City Clerk posted and submitted a certificate of these facts to the City Council as required by California Elections Code section 10229; and WHEREAS, on August 17, 2022, the City Clerk published notice of these facts and the course of action available in the Napa Valley Register, and the City’s website, as required by California Elections Code section 10229; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Napa, as follows:
1. The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution.
2. Pursuant to California Elections Code section 10229, the following persons are hereby appointed to the office for which they were nominated for the following terms:
NAME OFFICE TERM
Liz Alessio Councilmember – District 1 Four Years
Mary Luros Councilmember – District 3 Four Years
3. Pursuant to California Elections Code section 10229, each person appointed shall qualify and take office and serve exactly as if elected on November 8, 2022, at a municipal election for the office.
4. By making the appointments of Councilmembers as set forth in this Resolution, the General Municipal Election previously scheduled to be held on November 8, 2022, is hereby cancelled.
5. The City Clerk is directed to forward a certified copy of this resolution without delay to the Napa County Board of Supervisors and to the County Registrar of Voter. The City Clerk is further directed to coordinate with the County Registrar, and to take all actions necessary to implement the cancellation of the general municipal election that was previously called pursuant to Resolution R2022-046.
6. This Resolution shall take effect immediately upon its adoption.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Napa at a public meeting of said City Council held on the 23rd day of August, 2022, by the following vote:
