RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NAPA, STATE OF CALIFORNIA, (A) APPROVING AND ADOPTING AN ADDENDUM TO THE CERTIFIED ENVIRONMENTAL IMPACT REPORT FOR THE CITY OF NAPA GENERAL PLAN UPDATE, AND (B) ADOPTING THE CITY OF NAPA 2040 GENERAL PLAN, AND DETERMINING THAT THE ACTIONS AUTHORIZED BY THIS RESOLUTION WERE ADEQUATELY ANALYZED IN COMPLIANCE WITH CEQA WHEREAS, the City of Napa is required by State law to prepare and adopt a General Plan for the long-term physical growth and development of the City; and WHEREAS, the City’s current General Plan, Envision Napa 2020, was adopted on December 1, 1998; and WHEREAS, the City Council directed staff to prepare a comprehensive update to the current General Plan that fully complies with State law and will be useful to the City in implementing future growth and development programs; and WHEREAS, the City Council approved a Professional Services Agreement with Dyett & Bhatia Urban and Regional Planners for the preparation of the City of Napa 2040 General Plan (“2040 General Plan”) and corresponding environmental impact report on May 1, 2018; and WHEREAS, the City Council established a General Plan Advisory Committee to advise City staff and serve to engage and involve the public in the update process, inform development and prioritization of long-range planning programs and policies, and facilitate preparation of the 2040 General Plan; and WHEREAS, the Committee used an open, inclusive process that incorporated a combination of in-person and virtual outreach; sixteen public meetings; and four community workshops; and WHEREAS, the recommended 2040 General Plan provides new Goals and Policies to carry out the Vision and Guiding Principles; and WHEREAS, on September 1, 2022, the Planning Commission held a noticed public hearing, considered comments from the public and members of the Commission, and recommended certification of the EIR and adoption of the 2040 General Plan; and WHEREAS, on September 20, 2022, the City Council held a noticed public hearing on the EIR and the 2040 General Plan, considering testimony from the public, the recommendations of the Planning Commission, and the whole of the record, and (a) adopted Resolution No. R2022-085 to certify the adequacy of the City of Napa General Plan Update Environmental Impact Report (State Clearinghouse Number 2021010255) (the “EIR”) prepared for the City of Napa 2040 General Plan; and (b) continued the public hearing to October 18, 2022, to further consider and deliberate on the adoption of the 2040 General Plan; and WHEREAS, on October 18, 2022, the City Council reconvened and then closed the public hearing that was continued from September 20, 2022, and considering all previously given public testimony, the recommendations from the Planning Commission, and the whole of the record, completed its deliberations on the 2040 General Plan.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Napa as follows:
Section 1. The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct and establish the factual basis for the City Council’s adoption of this Resolution.
Section 2. Based on evidence in the entire record, including, but not limited to, the Revised Draft EIR and Final EIR, all Staff reports relating to the General Plan, and the written and oral testimony received at the hearings for the General Plan, the City Council finds and determines all of the following:
The City Council has reviewed and considered the information in the certified EIR, the General Plan Background Report and Policy Document, and the recommendations of the Planning Commission in making its decision to adopt the 2040 General Plan.
The actions authorized by this Resolution were adequately analyzed by the EIR certified by the City Council by Resolution No. R2022-085 on September 20, 2022.
The process for preparation of the 2040 General Plan resulted in revisions to the draft 2040 General Plan that was presented to the City Council on September 20, 2022, and resulted in the preparation of that certain Addendum to the City of Napa General Plan Update Environmental Impact Report dated October 2022 (the “Addendum”), a true and correct copy of which is attached hereto as Exhibit B, and the Addendum has been prepared in compliance with all applicable requirements of CEQA and its implementing regulations and is adequate to support the City Council’s action on the 2040 General Plan.
The City Council has considered the alternatives presented in the EIR and has adopted the Environmentally Superior Alternative as the project for the 2040 General Plan based on information in the EIR. With regard to the unavoidable significant environmental effects identified in the EIR, the City Council has included feasible mitigations to help reduce these impacts but has found that they cannot be mitigated to a less than significant level as a certainty. The City Council has considered the need for balance between the community wide benefits of implementing the 2040 General Plan and the unavoidable significant impacts and has determined that economic, legal, social, technological and other benefits outweigh the unavoidable adverse environmental effects that may result from implementation of the 2040 General Plan and hereby re-adopts the Statement of Overriding Considerations attached as Exhibit C to City Council Resolution No. R2022-085.
Pursuant to Public Resources Code Section 21081.6, Subdivision (a), and as specified in Exhibit D to City Council Resolution No. R2022-085, adoption of the 2040 General Plan will, in effect, constitute adoption of a mitigation monitoring and reporting program for the 2040 General Plan.
Section 3. The City Council hereby approves and adopts the Addendum to the EIR attached hereto as Exhibit “B” and incorporated herein by reference.
Section 4. The City Council hereby adopts the Napa 2040 General Plan, the City of Napa General Plan as attached hereto and incorporated herein as Exhibit “A.” Section 4. This Resolution shall take effect immediately upon its adoption.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Napa at a public meeting of said City Council held on the 18th day of October, 2022, by the following vote:
