RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NAPA, STATE OF CALIFORNIA, (1) AUTHORIZING THE UTILITIES DIRECTOR TO EXECUTE A PROFESSIONAL SERVICES AGREEMENT WITH CAROLLO ENGINEERS, INC. FOR THE PURIFIED WATER FEASIBILITY STUDY IN THE AMOUNT UP TO $480,267; AND (2) AUTHORIZING THE UTILITIES DIRECTOR TO EXECUTE A MEMORANDUM OF UNDERSTANDING WITH NAPA SANITATION DISTRICT PURSUANT TO WHICH THE PARTIES WILL SHARE THE COST OF THE PURIFIED WATER FEASIBILITY STUDY EQUALLY; and (3) APPROVING A TRANSFER IN THE AMOUNT OF $240,133.50 FROM NONRECURRING UNDESIGNATED FUND BALANCE 539-25399 TO NONRECURRING WATER ENGINEERING ACCOUNT 53960115-53210, an increase in revenue budget in the amount of $240,133.50 in account 53960115-44420 and an increase in expenditures in the amount of $480,267 AS DOCUMENTED IN COUNCIL BUDGET AMENDMENT NO. 84.
WHEREAS, in November 2021, the Cities of Napa, American Canyon, Calistoga and St. Helena, the Town of Yountville, Napa County, and the Napa Sanitation District worked together to prepare a regional Napa Valley Drought Contingency Plan (DCP) for Napa County; and WHEREAS, the DCP assessed water supplies and demands for all parties and identified 22 future projects for consideration; and WHEREAS, of the identified projects, three were recommended for near term implementation: Napa Valley Purified Water Assessment, Valley Wide Operations Assessment, and participation in development of Sites Reservoir; and WHEREAS, the City of Napa and the Napa Sanitation District have interest in developing the Napa Valley Purified Water Assessment; and WHEREAS, on August 30, 2022, the City of Napa and the Napa Sanitation District issued a request for proposals to perform a Feasibility Study to assess whether Purified Water is viable for direct potable reuse; and WHEREAS, on September 29, 2022, three (3) responsive proposals were received, reviewed and all three firms were interviewed for the Project; and WHEREAS, staff recommends that Carollo Engineers, Inc. be awarded the work in an amount not to exceed $480,267; and WHEREAS, the City of Napa and the Napa Sanitation District recognize they will benefit from the work and share the associated costs at 50 percent each under the terms of a Memorandum of Understanding; and WHEREAS, City of Napa Water Enterprise Nonrecurring Undesignated funds in the amount of $3,222,417 exist for the purpose of water system special projects; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Napa, as follows:
1. The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct and establish the factual basis for the City Council’s adoption of this Resolution.
3. The City Council hereby authorizes the Utilities Director to execute a Professional Services Agreement with Carollo Engineers, Inc. for the Purified Water Feasibility Study in an amount up to $480,267.
4. The City Council hereby authorizes the Utilities Director to execute a Memorandum of Understanding with Napa Sanitation District for the Purified Water Feasibility Study pursuant to which the parties will share the cost of the Study equally.
5. The City Council hereby approves a transfer in the amount of $240,133.50 from nonrecurring undesignated fund balance 539-25399 to nonrecurring water engineering account 53960115-53210, an increase in revenue budget in the amount of $240,133.50 in account 53960115-44420 and an increase in expenditures in the amount of $480,267 as documented in Council Budget Amendment No 84.
5. This Resolution shall take effect immediately upon its adoption.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Napa at a public meeting of said City Council held on the 17th day of January 2023, by the following vote:
