RESOLUTION R2023-__
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NAPA, STATE OF CALIFORNIA, APPROVING SALARY RANGE REVISIONS FOR THE LEGAL ANALYST CLASSIFICATION IN THE CITY ATTORNEY’S OFFICE WHEREAS, on January 5, 2021, the classification specification and salary range for Legal Analyst was approved by City Council under Resolution R2021-002; WHEREAS, on January 19, 2021, by separate ordinance of the City Council under Ordinance O2021-001, the Legal Analyst position was established as an “appointive officer” under City Charter section 75 and as codified at Napa Municipal Code Section 2.24.070, meaning that the positions are “unclassified” at-will positions, and it is therefore necessary to document the compensation and benefits of the Legal Analyst as being equivalent to those approved by the City Council for the Administrative, Managerial and Professional Employees (“AMP”); and WHEREAS, on December 20, 2022, the City Council adopted the AMP Tentative Agreement for a Successor Memorandum of Understanding (“MOU”) for the term January 1, 2023 through December 31, 2024, and authorized the City Manager to finalize a successor MOU to implement the terms of the Tentative Agreement; and WHEREAS, on December 20, 2022, the City Council adopted Resolution R 2022-109 tying the compensation and benefits for City Unrepresented Management Staff to the AMP MOU for the term January 1, 2023 through December 31, 2024; and WHEREAS, “City Unrepresented Management Staff” (as used in Resolution R2022-109), includes the following classifications: Assistant City Attorney, Legal Analyst, Deputy City Manager, Risk Manager, Community Relations and Media Manager, and Management Analyst I/II under the City Manager’s Office.

WHEREAS, Members of the City Unrepresented Management Staff receive compensation and benefits pursuant to the terms of the AMP MOU as modified by the Tentative Agreement referenced in the recitals to this resolution, for the term of January 1, 2023 through December 31, 2024, with the specific exception of the grievance procedure.

WHEREAS, the City previously applied salary equity adjustments effective the pay period beginning December 24, 2022, for each employee in the following classifications and in the following amounts: 0.2% to the Assistant City Attorney classification, and 4.07% to the Community Relations and Media Manager classification. These adjustments are consistent with section 3.4 of the AMP MOU.

WHEREAS, as part of the compensation salary survey, it was recommended that the Management Analyst II salary range receive a 1.37% salary equity adjustment and that the Legal Analyst salary range be in alignment with the Management Analyst II salary range.

WHEREAS, due to an administrative oversight, the City did not apply the salary equity adjustment to the Legal Analyst classification. Effective the pay period beginning December 24, 2022, the Legal Analyst classification is adjusted in the amount of 1.37%. This adjustment is consistent with section 3.4 of the AMP MOU.

WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.

NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Napa, as follows:
