RESOLUTION R2023-__
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NAPA, STATE OF CALIFORNIA, (1) AUTHORIZING THE PUBLIC WORKS DIRECTOR TO AWARD A CONSTRUCTION CONTRACT TO, AND EXECUTE A CONSTRUCTION CONTRACT WITH, SIERRA EXCAVATING, LLC FOR THE 3875 JEFFERSON STREET ABATEMENT & DEMOLITION PROJECT IN THE BID AMOUNT OF $210,852; (2) AUTHORIZING THE PUBLIC WORKS DIRECTOR TO APPROVE CHANGE ORDERS AND CHARGES FOR PROJECT SERVICES UP TO $40,785 FOR A TOTAL PROJECT AMOUNT NOT TO EXCEED $251,637; AND (3) DETERMINING THAT THE ACTIONS AUTHORIZED BY THIS RESOLUTION ARE EXEMPT FROM CEQA WHEREAS, on March 15, 2023, the City acquired the parcel located at 3875 Jefferson Street (“Property”); and WHEREAS, the Property is intended to be developed as housing in the future, and the City is facilitating the demolition of the existing building and ancillary structures in advance of the development of the property; and WHEREAS, five (5) bids were received, opened, and read on July 13, 2023, for the 3875 Jefferson Street Abatement & Demolition (“Project”); and WHEREAS, the lowest and best bid was submitted by Sierra Excavating, LLC, for a total bid amount of $210,852; and WHEREAS, the construction budget consists of funding the total contract amount of $40,785 plus contingency, contract administration, construction management, and inspection (amounts are interchangeable) for a total amount of $251,637; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.

NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Napa, as follows:

The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct and establish the factual basis for the City Council’s adoption of this Resolution.

The City Council hereby determines that the actions authorized by this Resolution are exempt from CEQA pursuant to CEQA Guidelines Section 15332, which exempts in-fill development projects consistent with the applicable general plan designation and on a project site of no more than five acres substantially surrounded by urban uses, and Section 15330, which exempts minor cleanup actions to prevent the release of a hazardous waste or substance.

The exceptions to categorical exemptions identified in Section 15300.2 of the CEQA Guidelines are inapplicable because the land is in an urbanized area with no environmentally sensitive habitats or species of concern on the property, there has been no successive effort to intensify land uses in the area, and no unusual circumstances exist that would pose a reasonable possibility of having a significant effect on the environment, and the project does not negatively affect historic resources. Based on this analysis, no significant environmental effects would result from this project and the use of categorical exemptions is appropriate.

The City Council hereby authorizes the Public Works Director to award a construction contract to, and execute a construction contract with, the lowest and best bidder, Sierra Excavating, LLC, for the 3875 Jefferson Street Abatement & Demolition project in the amount of $210,852.

The City Council hereby authorizes the Public Works Director to execute construction contract change orders, and authorizes the charge of contract administration, construction management, inspection and testing up to $40,785 for a total project amount not to exceed $251,637.

This Resolution shall take effect immediately upon its adoption.

I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Napa at a public meeting of said City Council held on the 1st day of August, 2023, by the following vote:
