RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF NAPA, STATE OF CALIFORNIA, APPROVING A TWO-YEAR EXTENSION OF A PREVIOUSLY APPROVED TENTATIVE SUBDIVISION MAP, DESIGN REVIEW PERMIT AND USE PERMIT TO SUBDIVIDE AN APPROXIMATELY 5.53-ACRE PROPERTY INTO SIX (6) RESIDENTIAL LOTS AT 45 LOS ROBLES DRIVE AND DETERMINING THAT THE ACTIONS AUTHORIZED BY THIS RESOLUTION WERE ADEQUATELY ANALYZED BY A PREVIOUS CEQA ACTION WHEREAS, on April 24, 2023, Ron and Susan Modrall, (“Applicant’s”), submitted an application (File No. PL23-0074) to the City of Napa for an Extension pursuant to Napa Municipal Code (“NMC”) Section 16.20.100 (“Extension”) for a two-year extension of a previously approved Tentative Subdivision Map, Design Review Permit and Use Permit for Modrall Tentative Subdivision Map (File No. PL18-0079) located at 45 Los Robles Drive (“Site”) for the Modrall Tentative Subdivision Map Extension (the “Project”); and WHEREAS, the City Council held a duly noticed public hearing on February 6, 2024, on the Project, where it considered all written and oral testimony submitted to it including a presentation by Staff; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Napa as follows:
Section 1. The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct and establish the factual basis for the Council’s adoption of this Resolution.
Section 2. The City Council hereby determines that the potential environmental effects of the Project were adequately analyzed by the Mitigated Negative Declaration that was adopted on January 8, 2008 in conjunction with the approval of the Modrall Tentative Subdivision Map by Resolution R2008-14, pursuant to CEQA Guidelines Section 15162.
Section 3. The City Council hereby finds that the circumstances upon which the original Tentative Subdivision Map, Design Review Permit and Use Permit were based have not substantially changed and that the findings for these entitlements made for the Project in Resolution No. R2021-032 still apply to the Project and adequately support the requested extension of these entitlements.
Section 4. The City Council hereby approves a two-year extension of the Tentative Subdivision Map, Design Review Permit and Use Permit for the Project, to May 4, 2025. This extension is approved subject to compliance with the conditions of approval contained in Resolution No. R2021-032 and mitigations in Resolution No. R2008-14, and subject to the following additional conditions:
Section 5. This Resolution will become effective immediately upon adoption.
I HEREBY CERTIFY that the foregoing resolution was duly and regularly adopted by the City Council of the City of Napa at a regular meeting of said City Council held on the 6th day of February 2024 by the following roll call vote:
