RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NAPA, STATE OF CALIFORNIA, authorizing THE UTILITIES DIRECTOR, OR DESIGNEE, TO EXECUTE ALL DOCUMENTS NECESSARY TO IMPLEMENT AND SECURE PAYMENT FROM THE DEPARTMENT OF RESOURCES RECYCLING AND RECOVERY (CALRECYCLE) SB 1383 LOCAL ASSISTANCE GRANT IN AN AMOUNT NOT TO EXCEED $250,000 WHEREAS, Public Resources Code sections 48000 et seq. authorize the Department of Resources Recycling and Recovery (CalRecycle) to administer various grant programs (grants) in furtherance of the State of California’s (state) efforts to reduce, recycle and reuse solid waste generated in the state thereby preserving landfill capacity and protecting public health and safety and the environment; and WHEREAS, in furtherance of this authority CalRecycle is required to establish procedures governing the application, awarding, and management of the grants; and WHEREAS, CalRecycle’s grant application procedures require, among other things, an applicant’s governing body to declare by resolution certain authorizations related to the administration of CalRecycle grants; and WHEREAS, the State of California (via AB 341, AB 1826, SB1383) and the City of Napa (via R2012 100) have adopted policy goals to achieve or exceed a minimum level of 75% recycling and composting by the year 2020, including mandatory collection and recovery of recyclable and compostable material; and WHEREAS, Council resolution R2023-123 adopted on November 7, 2023, approved an SB 1383 grant application and execution not to exceed $175,000; and WHEREAS, CalRecycle informed the City of Napa that they had increased the estimated grant award to $207,005. As outlined in the Request For Approval, the Budget Act allocated $180 million to CalRecycle to help jurisdictions with SB 1383 implementation. Of that, $90 million was specifically earmarked for the SB 1383 Local Assistance Grant Program, while the remainder was allocated to the Organics Grant Program. After award of the Organics Grant Program, there was $19,590,543 remaining. Those funds were moved to the SB 1383 Local Assistance Grant making the total amount available for an award to $109,590,543. Those monies were reallocated to all eligible applicants making awards larger than what was originally estimated; and WHEREAS, the estimated higher SB 1383 Local Assistance grant award available to the City of Napa exceeded the original not to exceed $175,000 and CalRecycle requires an updated Council resolution to award grant funds in excess of $175,000, and WHEREAS, the City of Napa will submit a grant application to CalRecycle for an estimated $207,005 to provide durable, UV resistant outdoor decals (or replacement containers as needed) for all residential and commercial recycling, compost, and landfill collection containers to provide public education, minimize contamination and comply with mandatory SB 1383 label requirements; and WHEREAS, actual grant funds received may be up to $250,000; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
