Someone who is in the news a lot lately said people should be proud of their lawns. I'll start taking care of ours again if you can manage to get the wrecked pickup truck off the lawn at the corner of Pine St. and Freeway Drive.

Are all

of you proud of your "entire"

city?

SUBJECT: Item 5.E. Salary Schedules for Full-Time and Part-Time Extra- Help Employees

Staff is submitting a supplemental memo and attachment for Item 5.E. Salary Schedules for Full-Time and Part-Time Extra-Help Employees on the September 17, 2024 City Council meeting agenda.

A minor correction has been made on Page 21 of the Exhibit A - Proposed City of Napa Salary Schedule for Full-Time Employees, due to a clerical error regarding the salary table for Napa City Firefighters Association (NCFA) for the Firefighter/Paramedic classification. The salary steps for Firefighter/Paramedic were incorrect in the original item, and these salary steps have been updated to reflect the correct salary steps for Firefighter/Paramedic.

A corrected version of Exhibit A - Proposed City of Napa Salary Schedule for Full-Time Employees has been provided for reference as an updated attachment to the Resolution for Council’s approval.

ATTACHMENT 2
Written Submission for Homeless Encampment Policy Item on Sept. 17, 2024 We would like to address the Napa City Council on a specific subset of “unhoused” individuals:
the “service resistant,” i.e. those not “involuntarily homeless,” according to the 9th Circuit US Court of Appeals, who reside on public streets and camp on our sidewalks.

We want to begin by stating that we recognize and extol the efforts and past work made on behalf of the unhoused by this Council and other civic leaders, and especially Molly Rattigan, and her team. That being said, it has come to our attention, that the City continues to administer policy using a model that considers the “unhoused” a single uniform entity. Recent statistical studies have shown that a minority of the “unhoused” can be characterized as suffering from mental health disorders, addiction disorders, and/or extreme poverty. A growing percentage, labelled “service resistant,” up to two-thirds, refuse domiciles (families/friends) and/or public shelters, when offered.

The Ninth Circuit of the US Court of Appeals, who gave us the “Boise” decision in 2018, that “tied the hands” of the City to enforce its ordinances against homeless encampments and Public Camping, clarified its ruling in an amendment in December 2023. It stated in Homelessness v. City and County of San Francisco, that 1. those who refuse an offer of shelter are no longer “involuntarily homeless” and are not “protected” by the 2018 ruling, and 2. cities do NOT need to have shelter beds for all to employ this clarification. In addition, just recently SCOTUS overturned the Ninth Circuit’s 2018 ruling.

We raise the issue now as there is still a lack of enforcement of Napa Code 12.65, regarding Camping and Storage of Personal Property.

Stated in 12.65.010, “The purpose of this chapter is to maintain public streets and areas within the City of Napa in a clean and accessible condition and to diminish problems such as disease, illness and crime by encouraging the use of appropriate shelter facilities.” Spelled out clearly in 12.65.030, “Unlawful Camping: Except as expressly indicated, it is unlawful for any person to camp, occupy camp facilities or use camp paraphernalia in the following areas, except as otherwise provided: Any street, sidewalk or park, or any right-of- way, shoulder or other publicly-owned or controlled area under, near or adjacent to any street, sidewalk or park…”
Thankfully, Napa Abajo (where we reside) does not have homeless tent encampments, but it is riddled with “illegal camping,” with personal possessions, including chairs, tables, coolers, BBQs, unleashed dogs, etc., spilling out of RVs/trucks/motor homes and onto the sidewalks.

This behavior is unhealthful and unsafe (fire hazard), and contributes to blight in our area.

We have spoken with most of the “campers” in our area, and it is our observation that they are networked, resourceful and enabled and all appear to be “service resistant,” making them essentially scofflaws of Napa Code 12.65.

We ask that the Council, through its resources at hand, i.e Napa PD, Napa Parking Enforcement and Napa Code Enforcement, to direct those agencies to enforce the law, post haste. There is no need to search inside their vehicles if they are found overtly camping. There should be fines and a warning that they could be towed at their own expense if the infraction recurs. It is not unlawful “seizure” to tow a vehicle that breaks the law anymore than it would be “seizure” to tow a vehicle parked in a red zone next to a fire hydrant.

Finally, we ask the Council to go on the record with their response to this submission.

I am glad that the city is taking action on this issue.

Living just off the river walk, we see a lot of homeless encampments.

The fire issue being the most concerning.

I will not be able to attend the meeting on 9/17/24, however, I would like to question why the Draft Encampment Management Policy defines an encampment as: A group of people sleeping outside in the same location for a sustained period of time.

This does not address the one off individual who do the same.

Is one person included as a “group”?

It wouldn’t
appear to be the case and that might limit the ability to enforce.

Why isn’t the wording simply: People sleeping
outside in the same location for a sustained period of time? I would also suggest that another designation be added to the definition of a High Sensitivity Area:

Proximity of
less than 25 feet from any public access area such as sidewalks, river walks and bike trails.

Hello Napa City Council,
I would like the following included in the Public Comment for the Homeless Encampment Policy discussion on the Sept. 17, 2024 City Council Agenda.

As a full-time resident and homeowner in the Napa Abajo community, I urge you to support efforts to enforce local laws regarding homeless encampments and illegal camping, including illegal vehicle camping.

In Napa Abajo, the City’s most historic and diverse neighborhood, we frequently witness illegal vehicle camping. In fact, many individuals have been camping in RVs, vans, and cars in our community for years, without fear of enforcement.

our neighbors have been confronted by these same individuals who are openly hostile to them, while their personal possessions, including chairs, tables, coolers, BBQs, firepits, and unleashed dogs, spill out onto the sidewalks.

This
behavior is unhealthy, unsafe, and contributes to blight and crime in our area.

While we have empathy for people without housing, we cannot allow our neighborhood to be overrun by those
who choose not to accept shelter or
services and instead opt to live in vehicles on our streets and in front of our homes, especially when existing laws (Napa Code 12.65) make this activity illegal.

We are also concerned that as other cities clear encampments, the number of RV and car campers will rise in Napa, particularly in Abajo. This will strain City services, increase crime, and create additional tension between the City and local residents.

We ask the Council to direct Napa PD, Parking Enforcement, and Code Enforcement to uphold the existing laws, and we support revising any outdated parking laws that don’t consider the types of vehicles being used by unhoused individuals today.

Thank you for your consideration of this important issue.

RE: Homeless Encampment Management Plan

Hello, below are comments and some recommendations regarding your draft plan around encampment management. First, living on the river, I want to say thanks for the work. This is a difficult issue for all involved and it won’t improve without everyone’s participation including the unhoused.

A general impression. I am encouraged that the city has considered some areas sensitive and therefore subject to accelerated enforcement. (Our veterinarian recently saw smoke coming out from under the Trancas St bridge!) What I feel is missing are repercussions for repeat offenders. I understand that fines don’t really work so what about community service or something creative. Maybe helping other homeless people? If you don’t provide some rules and discipline to a kid they keep doing what they are doing, this is no different.

As I negotiated contracts most of my adult life , section comments follow:

1.3 this language proposes that the public thinks out of sight cures the problem and I think it’s a bit insulting. The point of this is to ensure the protection of life and property by enforcing, (the already on the books) laws in areas that are dangerous for anyone to camp, build fires, damage the ecosystem… This is safety for the community, period.

2.0 I agree with my neighbor Mark who submitted comments on the first bullet point.

Many of the fires close to our homes have been by individual campers. They are not dumb if they see language like this they will move apart and a few feet from their last spot every night. Please tighten this language. Something like-“ …a person or persons sleeping outside on city property” I have searched many definitions and an encampment can be singular in both person and duration it’s simply a camp.

3.1.1 Nine people to make this “prompt” decision? Can this be streamlined so it does not die in someone’s email/vmail/vacation…

3.3 As above but slightly different concern- will having only these two decision makers create any bottleneck in process?

3.4 Please define promptly. Can the public get an SLA?

Finally, I strongly believe that this can only improve with the establishment of secure, dedicated camping locations where both security and services can be centralized. The cost and damage to the greater community just allowing what is already illegal camping to occur until this policy is enforced is not a solution.

Warm regards,
J Frederick
