RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NAPA, OF THE STATE OF CALIFORNIA, authorizing THE UTILITIES DIRECTOR TO SUBMIT A PROPOSAL, IN AN AMOUNT NOT TO EXCEED $1,000,000, TO OBTAIN FUNDING FROM THE DEPARTMENT OF WATER RESOURCES DAM SAFETY AND CLIMATE RESILIENCY LOCAL ASSISTANCE GRANT PROGRAM AND TO EXECUTE THE FUNDING AGREEMENT, AMENDMENTS, AND ALL OTHER DOCUMENTS THERETO, SUBJECT TO THE AVAILABILITY OF MATCHING FUNDS, FOR THE HENNESSEY SPILLWAY FLOW EXPANSION DESIGN PROJECT AND DETERMINING THAT THE ACTIONS AUTHORIZED BY THIS RESOLUTION ARE EXEMPT FROM CEQA UNDER STATE CEQA GUIDELINE 15378 WHEREAS, the City of Napa is a Charter City with responsibility for and authority over water supply, water quality, and ecosystem management in the area proposed for the project and is willing to participate in, coordinate, and collaborate with other interested parties that are participating in the development of the Hennessey Spillway Flow Expansion Design Project; and WHEREAS, the City of Napa is authorized to enter into an agreement with the Department of Water Resources and the State of California; and WHEREAS, Dam Safety and Climate Resilience Local Assistance Grant Program application procedures require, among other things, an applicant’s governing body to declare by resolution certain authorizations related to the administration of Department of Water Resources grants; and NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Napa, as follows:
1. Pursuant and subject to all of the terms and conditions of the California Drought, Water, Parks, Climate, Coastal Protection, and Outdoor Access For All Fund Act of 2018 (Proposition 68; Water Code, § 80000 et seq.), the Utilities Director is hereby authorized to submit a proposal to obtain funding, in an amount not to exceed $1,000,000, for the Hennessey Spillway Flow Expansion Design Project from the Department of Water Resources Dam Safety and Climate Resiliency Local Assistance Grant Program.
2. The City Council hereby authorizes the Utilities Director to execute the funding agreement, amendments, and all other documents for the California Department of Water Resources Dam Safety and Climate Resiliency Local Assistance Grant Program, in an amount not to exceed $1,000,000, subject to the availability of matching funds in budget account Hennessey Spillway Flow Expansion Design (63WS23UT01), for the Hennessey Spillway Flow Expansion Design Project.
3. The City Council hereby authorizes the Utilities Director to prepare the necessary data, make investigations, and take other such actions as necessary and appropriate to execute the Hennessey Spillway Flow Expansion Design Project, contingent on City Council approval.
4. This Resolution shall take effect immediately upon its adoption and is effective for no less than five (5) years from the date of adoption of this Resolution.
