RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NAPA, STATE OF CALIFORNIA, AMENDING RESOLUTION 2024-089 TO CORRECT A CLERICAL ERROR TO THE ASSESSOR’S PARCEL NUMBER (APN) FOR THE REDWOOD ROAD EXTENSION EASEMENT GRANT DEED AND ACKNOWLEDGING AND APPROVING THAT THE CORRECTED EASEMENT GRANT DEED HAS BEEN RECORDED WITH THE NAPA COUNTY RECORDER’S OFFICE UNDER DOCUMENT NUMBER 2024-0013696 AND DETERMINING THAT THE ACTIONS AUTHORIZED BY THIS RESOLUTION ARE EXEMPT FROM CEQA UNDER STATE CEQA GUIDELINES SECTIONS 15060(C)(2)-(3) AND 15061(B)(3) WHEREAS, on September 17, 2024, the City Council approved Resolution 2024-089, authorizing the acceptance of two Easement Grant Deeds from the Napa Valley Wine Train, LLC to incorporate into a segment of the Vine Trail for public recreational trail purposes over portions of APN 007-082-005 and APN 024-054-009; and WHEREAS, after recordation of the Easement Grant Deed for the Redwood Road Extension, a clerical error was discovered in which the APN was incorrectly listed as 024-054-009 instead of the correct 042-054-009; and WHEREAS, the Easement Grant Deed cover page and surveyor’s plat map have been corrected, and the corrected Easement Grant Deed was recorded with the Napa County Recorder’s Office under Document Number 2024-0013696; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Napa, as follows:
1. The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct and establish the factual basis for the City Council’s adoption of this Resolution.
2. The City Council hereby finds that the correction of the clerical error of the Assessor’s Parcel Number discussed herein is exempt from the California Environmental Quality Act (“CEQA”). Notably, this action will not result in a direct or reasonably foreseeable indirect physical change in the environment as the City is merely making a clerical correction without any plans to improve the trail at this time. The action is thus not subject to CEQA under State CEQA Guidelines section 15060(c)(2)-(3). Additionally, the action is exempt from CEQA under State CEQA Guidelines section 15061(b)(3) because it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment.
3. The City Council hereby amends Resolution 2024-089 (attached hereto as Exhibit B) to correct the clerical error to the Assessor’s Parcel Number (APN) for the original Redwood Road Extension Easement Grant Deed (attached hereto as Exhibit A), changing the APN from 024-054-009 to the correct APN 042-054-009.
4. The City Council hereby acknowledges and approves that the corrected Easement Grant Deed, recorded with the Napa County’s Recorder’s Office as Document Number 2024-0013696 (attached hereto as Exhibit C), contains the correct APN.
5. This Resolution shall take effect immediately upon its adoption.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Napa at a public meeting of said City Council held on the 15th day of October, 2024, by the following vote:
