RESOLUTION R2024-__
RESOLUTION OF THE CITY OF NAPA, STATE OF CALIFORNIA, APPROVING AND AUTHORIZING THE SUMMARY VACATION OF A RIGHT OF WAY AND WATERLINE EASEMENT AFFECTING PROPERTY AT REDWOOD PLAZA (APN 042-050-023) AND DETERMINING THAT THE ACTIONS AUTHORIZED BY THIS RESOLUTION ARE EXEMPT FROM CEQA WHEREAS, in 1960, DeMatei & Co., Inc. granted a 10-foot-wide right of way and waterline easement to the City of Napa, recorded as Document No. 1960-0007522 in the Napa County Recorder’s Office, affecting property at Redwood Plaza at 3331 Solano Avenue Napa, CA (APN: 042-050-023) ('Subject Easement') and described in Exhibit A attached hereto; and WHEREAS, the City of Napa approved a redevelopment project in 2003 under Resolution No. 03-0092, which required the grant of a new 20-foot-wide waterline easement for the realigned waterline, and the new easement was recorded September 5, 2024, as Document No. 2024-0012718; and WHEREAS, the new easement now accommodates the realigned waterline, and the original right of way and waterline easement from 1960 is no longer necessary; and WHEREAS, the City Council is authorized to vacate the Subject Easement under the summary vacation process under California Streets and Highways Code Section 8333(c) because the Subject Easement has been superseded by the relocation and no public facilities are located within the easement area; and WHEREAS, the City Council has considered all the information related to this matter as presented at the public meeting, including any supporting reports by City Staff.

NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Napa, as follows:

1. The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct and establish the factual basis for the City Council’s adoption of this Resolution.

2. The City Council hereby determines that the actions authorized by this Resolution are exempt from CEQA pursuant to CEQA Guidelines Section 15301 (minor alteration of existing facilities).

3. Pursuant to Chapter 4 of Part 3 of Division 9 of the Streets and Highways Code including Sections 8333(c) and 8335, the City Council hereby vacates the Subject Easement, as defined in the recitals to this Resolution.
