RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NAPA, STATE OF CALIFORNIA, authorizing OVERTIME PORTAL TO PORTAL PAY FOR Non-EXEMPT EMPLOYEES IN THE FIRE DEPARTMENT, AND OVERTIME RATE FOR EXEMPT EMPLOYEES IN THE FIRE DEPARTMENT, AS REIMBURSED BY THE STATE OF CALIFORNIA GOVERNOR’S OFFICE OF EMERGENCY SERVICES WHEREAS, the City of Napa is a public agency located in the County of Napa, State of California; and WHEREAS, it is the City of Napa’s desire to provide fair and legal payment to all its employees for time worked; and WHEREAS, the City of Napa has in its employ, Fire Department response personnel include Fire Chief, Deputy Chief, Battalion Chief, Fire Captain, Firefighter/Paramedic, Firefighter, and WHEREAS, from time to time, Fire Department response personnel provide support and assistance in the event of an emergency response declared by the Governor’s Office of Emergency Services (“OES emergency incident”) and receives reimbursement for costs through the California Fire Assistance Agreement (CFAA), and WHEREAS, the City of Napa compensates its eligible employee’s portal to portal while on duty in the course of their employment and away from their official duty station and assigned to an OES emergency incident, in support of an OES emergency incident, or pre-positioned for emergency response to an OES emergency incident, and WHEREAS, the City of Napa compensates its eligible employees’ overtime in accordance with the applicable Memorandum of Understanding while on duty in the course of their employment and away from their official duty station and assigned to an OES emergency incident, in support of an OES emergency incident, or pre-positioned for emergency response to an OES emergency incident; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Napa, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution.
The City Council hereby authorizes overtime portal to portal pay for non-exempt employees in the Fire Department, and overtime rate for exempt employees in the Fire Department, as reimbursed by the State of California Governor’s Office of Emergency Services.
This Resolution shall take effect immediately upon its adoption.
I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Napa at a public meeting of said City Council held on the 15th day of July 2025, by the following vote:
