RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NAPA, STATE OF CALIFORNIA, (1) aPPROVING AND Authorizing the grant of AN easement deed to Pacific gas and electric company (PG&E) For underground utility facilities over a Portion of city-owned property identified as Assessor Parcel Number 041-030-040; and (2) determining that the actions authorized by this resolution are exempt from ceqa pursuant to ceqa guidelines section 15301.
WHEREAS, the City owns property identified as Assessor Parcel Number (APN) 041-030-040; and WHEREAS, Pacific Gas & Electric Company (PG&E) holds an existing easement over a portion of APN 041-030-040, originally granted in 1977 and subsequently relocated pursuant to a recorded Easement Relocation Agreement, which remains in full force and effect; and WHEREAS, PG&E operates utility infrastructure within the area and is implementing improvements, including the undergrounding of electrical facilities, to reduce wildfire risk and improve system reliability; and WHEREAS, in connection with these improvements, PG&E has requested that the City grant an easement for the installation, operation and maintenance of underground utility facilities over a portion of APN 041-030-040; and WHEREAS, the proposed easement area is more particularly described and shown in Exhibit “A” (Legal Description) and Exhibit “B” (Plat Map) attached to the Easement Deed, which is attached hereto as Exhibit “A”; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Napa, as follows:
The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution.
This City Council hereby determines that the actions authorized by this Resolution are exempt from CEQA pursuant to CEQA Guidelines Section 15301 (minor alteration of existing facilities).
This City Council hereby approves the grant of an Easement Deed to Pacific Gas and Electric Company (PG&E) for underground utility facilities affecting a portion of City-owned property identified as Assessor Parcel Number 041-030-040, consisting of an area of approximately 100 square feet, as described in the Easement Deed attached hereto as Exhibit “A”.
The City Council hereby authorizes the City Manager (or designee) to execute all related documents and take all actions necessary to implement the Easement Deed to Pacific Gas and Electric Company.
This City Council hereby authorizes the City Manager (or designee) to record the Easement Deed and this Resolution in the Office of the County Recorder of Napa County.
This Resolution shall take effect immediately upon its adoption.
