RESOLUTION R2026-XX
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NAPA, STATE OF CALIFORNIA, UPDATING CITY FEES AND CHARGES RELATED TO IMPACT FEES FOR AFFORDABLE HOUSING UNITS.

WHEREAS, the City has identified, in the Napa Municipal Code (“NMC”) Section 3.04.030, a range of City charges (including taxes, assessments, fees, and fines) that have been established by the City pursuant to separate ordinances and resolutions, most of which have been previously documented in ordinances codified in the NMC, and administratively assembled by City staff in the Master Fee Schedule; and WHEREAS, the City Council has previously established the amounts of City charges, and authorized City staff to administratively assemble those City charges in the Master Fee Schedule, pursuant to the most recent City Council Resolution R2026-057 on May 19, 2026; and WHEREAS, the City Council previously adopted the Affordable Housing Impact Fee Ordinance (NMC Chapter 15.94) which establishes a comprehensive program for funding affordable housing projects and the Council intends to rely on the definitions of the Ordinance for the terms used in this resolution, including, but not limited to: Area Median Income (“AMI”), Moderate Income Households (120% AMI), Median-Income Households (100% AMI), Low-Income Households (80% AMI), Very Low-Income Households (50% AMI), Extremely Low-Income Households (30% AMI), Affordable rent, and affordable sales price; and WHEREAS, the City of Napa is working to incentivize the creation of deed restricted affordable housing by reducing costs and barriers to development in order to meet the Regional Housing Needs Allocation assigned to the City of Napa; and WHEREAS, the City Council has considered all information related to this matter, as presented at the public meetings of the City Council identified herein, including any supporting reports by City Staff, and any information provided during public meetings.

NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Napa, as follows:

The City Council hereby finds that the facts set forth in the recitals to this Resolution are true and correct, and establish the factual basis for the City Council’s adoption of this Resolution.

The City Council hereby finds that the reduction of Impact Fees charged to applicants for the construction of deed restricted affordable housing units (as defined in this resolution), will further the important public interest of encouraging the development of Affordable and Workforce Housing Units.

The definitions of the NMC Chapter 15.94 shall be used to interpret this resolution unless otherwise particularly provided herein. The City Council hereby defines “affordable housing unit” to mean each dwelling unit for which the Community Resources and Development Director determine that the applicant has submitted sufficient documentation that the unit can be reported on the City of Napa’s Regional Housing Needs Allocation Annual Report, that the unit is not part of a City Council approved alternative equivalent to paying Affordable Housing Impact Fees, and that one or more of the following criteria are satisfied:

The unit will be sold at an affordable sales price to a low, very low or extremely low-income household, pursuant to an affordable housing agreement in compliance with NMC Section 15.94.080 and deed restricted for a term of no less than 45 years.

The unit will be rented at an affordable rent to a low, very low or extremely low-income household, pursuant to an affordable housing agreement in compliance with NMC 15.94.08 and deed restricted for a term of no less than 55 years.

The City Council hereby amends the fee amounts previously established in the City’s Master Fee Schedule, as set forth herein. For each application for a building permit for an Affordable Housing unit, the following Impact Fees shall be 25% of the fee for low-income units, and 0% of the fee for very low-income units and extremely low-income units:

Fire and Paramedic Development Impact Fee (NMC 15.78)
Street Improvement Fee (NMC 15.84)
Park Development Fee (NMC 15.68)
Park Land Dedication Fee (NMC 16.32.040)
Orchard Avenue Area Park Fee (NMC 15.72)
North Jefferson Park and Street Improvement Fees (NMC 15.76) High-Priority Improvement Payback Fee (NMC 15.88)
Big Ranch Road Specific Plan Area Development Impact Fee (NMC 15.98) Lone Oak Drainage Fee (NMC 15.100)
The reduction of Impact Fees shall be offered upon submission of a building permit application and shall be limited to a cap of 250 Very Low-Income Units and 250 Low-Income Units. The Community Resources and Development Director shall maintain a list of units authorized fee reductions for reporting purposes and shall have the authority to determine that the fee reduction or waivers will move the project to construction and no other funding gaps exist.

If a proposed building permit includes units at various income levels, the Community Resources and Development Director shall determine the appropriate fees based on % square footage for square footage-based fees, or a fixed charge per unit based on fees with a per unit charge that it considers the discounted units as a portion of the entire project If construction does not begin on a building permit issued under this resolution within one year of issuance, the building permit shall be rescinded by the Community Resources and Development Director.

This Resolution shall take effect immediately upon its adoption and be applicable to building permits applied for or issued between July 1, 2026 and December 31, 2028, or until the established cap for Very Low Income and Low Income Units is met.

I HEREBY CERTIFY that the foregoing Resolution was duly adopted by the City Council of the City of Napa at a public meeting of said City Council held on the 15th day of September, 2026, by the following vote:
