1 PUBLIC COMMENT FOR TUESDAY, MARCH 3, 2026
Good afternoon,
A. Showing up for Bullies
I understand you, Mayor Morrison and Councilmember Bush, were gloating about using your City work day to watch Paul Wapnowski -- your new “baby sheep” -- at the Chula Vista court house, protecting a bully. Wow! What great leaders. You have time to protect bullies like Josie Flores Clark (who although accused of sexual harassment and those accusations have been substantiated by a third party investigator, remains your assistant and frequent plus-one) and Paul Wapnowski (who uses his stature to try to intimidate women, even aggressively putting his hand up within inches of a woman’s face outside the courtroom), yet you don’t have time to run an effective and efficient City. You have dragged National City into Financial and Moral Bankruptcy.

The sad part is that neither one of your fellow councilmember sheep see it: Luz lacks courage and Marcus lacks brains because he has fried them all with his Dope. (He has been seen toking on a huge bong in public wearing his official National City logo polo shirt.)
B. Where are the RECORDS?
(You have claimed you are not hiding anything, yet you are still hiding the records responsive to the Public Records Request) I have provided you with a copy of my Reply to your Opposition to our motion to obtain the records that could have been timely produced, but instead, withheld and therefore costing the City money in litigation because of your intransigent position.
2 It is no surprise that under Ron Morrison’s leadership, National City has a track record of VIOLATING the PRA (Public Records Act). The Public Records Act and the California Constitution Article 1 Section 3 gives the public the right to see any communications that pertain to the conduct of the people’s business.

Who are the People? We are the people.

And we will not tolerate secrecy and corruption in local government.

It is there as a law for a reason, Councilmembers.

In fact in 2013, while Ron Morrison was the Mayor, National City was sued by Community Youth Athletic Center. The case went up to the Court of Appeal, which in a published opinion, found National City, under Ron Morrison’s leadership:
(1) violated the PRA because the City did not
“diligently search for and produce” the requested documents that were known to exist and that were under the control of its employes.
(2) “failed to secure…information during litigation to
prevent it from being destroyed”
(3) The City’s inability or unwillingness to locate the records had the same effect as withholding requested
information from the public.

Ron Morrison, and the Councilmembers who now follow him, have not learned their lesson. He continues to lie, deny and blame everyone else but himself or his assistant for their inept behavior.

The public has the right to know HOW the Public Nuisance Project located at one of the most deadly segments of Sweetwater Road got fasttracked through an approval recommendation, and WHO was pushing 3 the project for approval? WHO was helping Eddy Brikho, Robert Zakar, and Ken & Roy Muraoka to get this approved and WHY?
In particular we are looking for the following:

1. Communications that took place on April 22, 2024, between City Officials and Developers regarding a single project known as the “Nuisance Project”;

2. Communications between the developer, the mayor, and his assistant relating to the May 29, 2024, “incomplete” letter, the August 6, 2024, “incomplete “letter, and the October 9, 2024, Nuisance letter;

3. Communications relating to an October 23, 2024 meeting between the developer, City manager, City mayor, and Mayor’s assistant;

4. Text messages on the cell phones of City manager, City mayor, and Mayo’s assistant’s City-issued personal cell phones; and

5. Calendar entries for the specified meetings.

C.What has happened with the Sexual Harassment Complaint against Josie Flores Clark?
Has justice been made to Elyana Delgado?
Why does the City of National City not follow its own procedures to hold accountable Josie Flores Clark, especially when others have been terminated upon a substantiated finding?
The independent investigation’s Recommendation was her termination.

Why has Josie Flores Clark, a sexual harasser, not been terminated? Why does the City not want to do anything? Is it because Ms. Clark will appeal it? And so what if she appeals? She can do so after she has been terminated.
4 Do the right thing. Two other employees were terminated because of Sexual Harassment, and they appealed it. Why is she not being held to the same standards? Is Josie Flores Clark above the law? Is the termination and continuation of this Human Resources issue being put on hold in an effort to keep the issue away from an upcoming election cycle?
As a member of the public, I am requesting the City Council report on the status of the Delgado complaint.

The public deserves to know who National City is protecting: the victim or the harasser?
Thank you,
Micaela Polanco
