A general plan is each local government’s blueprint for meeting the community’s long-term vision for the future. The General Plan Guidelines serve as a resource to help jurisdictions draft and update their general plans. Technical advisory documents provide supplemental information about general plan topics in response to local needs around the state or changes in State law.

All jurisdictions are required to provide OPR and the Department of Housing and Community Development (HCD) with separate General Plan and Housing Element Annual Progress Reports (APRs) by April 1 each year, per Government Code Sections 65400 and 65700.

The last comprehensive update to the General Plan was on February 18, 1986. In that time, multiple elements have been updated on an individual basis. The last elements to be updated have been the Housing Element (September 30, 2022), Land Use and Circulation Elements (February 28, 2023). 3 GENERAL PLAN CONSISTENCY EVALUATION
This introduction section will provide the date of last General Plan update. Priorities for land use decision making that have been established by the local legislative body (e.g., passage of moratoria or emergency ordinances) will also be included in this section. One or more lists of the following should be included, including reference to the specific general plan element or policy, status (i.e., approved/denied, initiated/ongoing/completed, etc.), and brief comment on how each advanced the implementation of the General Plan during the past year:
• Planning activities initiated – These may include, but are not limited to, master plans, specific plans, master environmental assessments, annexation studies, and other studies or plans. • General Plan amendments – These may include agency-driven as well as applicant-driven amendments.
• Major development applications processed

Where appropriate, these key housing guidelines have been developed consistently with other elements of the General Plan, as well as other planning and policy documents for the City.

WHEREAS, a public hearing notice for the Needles City Council meeting was published in the Needles Desert Star at least 10 days prior to said meeting, and notices were sent to property owners within a 300-foot radius of the subject property specifying the date, time and location of the public hearing; and WHEREAS, on August 10, 2021 the Needles City Council held a duly noticed and advertised public hearing to receive oral and written testimony for a Conditional Use Permit for a new outdoor advertising sign at 429 N “K” Street, also known as APN 0185-067-08-0000; and WHEREAS, Section 94.07(d) of the Needles City Code describes the findings required to approve a Conditional Use Permit; and
WHEREAS, the Needles CITY COUNCIL has sufficiently considered all testimony and any documentary evidence presented to them in order to make the following determination.

NOW, THEREFORE, BE IT RESOLVED by the CITY COUNCIL of the City of Needles as follows:

SECTION 1. The City Council HEREBY FINDS AND DETERMINES that this project is categorically exempt under California Environmental Quality Act, CEQA guidelines Class 3: New Construction or Conversion of Small Structures. Class 3 consists of construction and location of limited numbers of new, small facilities or structures; installation of small new equipment and facilities in small structures; and the conversion of existing small structures from one use to another where only minor modifications are made in the exterior of the structure.

SECTION 2 The City Council HEREBY FINDS AND DETERMINES, with reports and findings, that facts do exist to approve a Conditional Use Permit for a digital Outdoor Advertising Sign, according to the criteria specified in Section 94.07(d) of the Needles City Code:

A. That the requested permit is within its jurisdiction according to the table of permissible uses.

FINDING: The project site is zoned General Commercial (C-2) and an Outdoor Advertising Sign is permitted in the C-2 Zone with a Conditional Use Permit (CUP); and B. The Application is Complete
FINDING: The applicant has submitted a complete application and has provided the required Site and Elevation plan drawings for the proposed sign.

B. The development is in general conformity with the Needles General Plan.

FINDING: The proposed project, a new outdoor advertising sign is consistent with uses identified in the General Plan for promotion of development and recreational activities.

C. The development is in harmony with the area in which it is located.

FINDING: The project site is located in a developed portion of the city, at the gateway into Needles, for the purpose of promoting development and other uses in the city.

North of the project is vacant land, proposed as part of a residential development that incorporates space for recreational vehicles and exterior living space, a Mobile home park, and a boat and RV storage. To the east is the municipal park with a boat launch and the Colorado River; to the south is residential housing and commercially zoned residential housing; to the west is a retail cannabis business, restaurant, and boat and RV storage.

D. The development will not materially endanger the public health or safety.

FINDING: The project site is at the corner of an intersection, with setbacks sufficient so that if it should fall, it will remain on the owner’s property.

E. The development will not substantially injure the value of adjoining or abutting properties.

FINDING: The project site is zoned General Commercial (C-2). The area surrounding the site is also zoned General Commercial (C-2). The project site will be conditioned with a desert-themed landscape using low-volume water plants due to the drought conditions. This requirement will assist in maintaining the value of adjoining or abutting properties
F. The project overall is consistent with the preceding findings.

FINDING: The project, with findings discussed in detail regarding compatibility with other similar uses in the area, conditions of approval applied to the project for enhancements to the landscape and site to ensure the surrounding area’s adjoining or abutting property values are not substantially injured, places the overall project in consistency with the preceding findings.

SECTION 3. The City Council HEREBY FINDS AND DETERMINES that facts do exist to approve RESOLUTION 2023-30.

SECTION 4. Title: Authorize Community Works Design Group to conduct a needs assessment and cost estimate for the Needles Municipal Aquatic Center not to exceed $7,400, utilizing $5,800 of general fund reseNes and $1,600 from the Needles Sandshark Swim Team.

Background: The current infrastructure at the Aquatic Center is aged and deteriorating. The existing slide is dilapidated, the existing play area is non-functional, and the main pool needs upgrades to be in compliance with California Building Codes and ADA regulations.

The Aquatic Center needs new plaster and tile in the main pool, new pool mechanical equipment (filter, pumps, floor inlets, cutter system, piping), renovate the existing bathroom, concrete coping repairs surrounding the pool for public safety and renovating the original 1990 pool slide.

In order to secure grant or loan funding for the needed improvements an assessment of the overall condition of the Aquatic Center and a cost estimate is needed.

Fiscal Impact: The Needles Sandshark Swim Team is contributing $1,600 and $5,800 to be funded utilizing general fund reseNes.

RE: Action Needed on Fentanyl and Substance Use-Related Legislation Dear Speaker Rendon and Assembly Republican Leader Gallagher, The League of California Cities (Cal Cities) requests to participate in the upcoming informational hearing on fentanyl and urges the Legislature to take further action this year to address the fentanyl crisis.

Cities are committed to enacting legislative solutions that strike an appropriate balance between community justice and public safety. However delaying additional legislative action another year will undoubtably result in many more preventable lives lost.

Constituents throughout California are relying on their legislators to act swiftly.

Fentanyl poisonings and the rising death toll illustrate a complex issue that requires a multi-faceted and collaborative approach. Cal Cities supports additional funding and resources to address the substance use crisis through appropriate prevention and intervention efforts, educational awareness campaigns, and increased access to lifesaving overdose treatment aids such as naloxone.

Cities not only welcome increased collaboration with our state and federal partners, but we truly require it in order to meaningfully address the fentanyl crisis facing our communities.

For these reasons, Cal Cities calls on the Legislature to thoughtfully deliberate on and provide solutions for one of the most pressing issues of our time. If you have any questions, do not hesitate to contact Elisa Arcidiacono at [email protected] or Caroline Cirrincione at [email protected].

Sincerely,
Mayor, XXXX Mayor, XXXX
