CITY COUNCIL STAFF REPORT
MEETING OF: May 24, 2023 Agenda Item No. 13
Subject: Consideration of a Nevada Street Bridge Replacement Project Update and Authorization to Advertise for Bids
From: Bryan McAlister, City Engineer
Date: May 16, 2023
Reviewed & Approved:
City Manager: STG
City Attorney:
Recommended Action: Receive and file the report and authorize City staff to advertise for bids.
ISSUE STATEMENT AND DISCUSSION:
The City is proposing to replace the existing bridge on Nevada Street over Deer Creek. The project is located at the south end of Nevada Street, near Broad Street in Nevada City, CA. The bridge has been programmed for replacement as a result of routine bridge inspections conducted by Caltrans and Federal Highway Administration (FHWA) which identified numerous deficiencies.
The existing bridge is a 34-ft wide, 61-ft long, two-span steel girder bridge constructed in 1938. The existing bridge has two lanes with sidewalk on both sides. The bridge is located within Nevada City Downtown Historic District which is listed on the National Register of Historic Places. A bridge was originally constructed at this location in the 1860’s and later reconstructed in 1938. The City plans to reconstruct the bridge using natural rock walls (and/or rock facing) and aesthetic railings to closely match the original 1860’s bridge but with structural elements that meet current bridge standards. The proposed bridge will be an approximately 42-ft wide, 68-ft span with a 30-degree skew angle. The proposed skew will be used to improve roadway approaches. The project also requires utility relocations of sewer, water, electric and telephone.
In 2016 funding was procured for design of the bridge replacement through the Federal Highway Bridge Program administered by Caltrans. A request for proposal was then issued for Professional Engineering Services to prepare and provide the City with all required studies, plans and specifications for Bridge Replacement in accordance with the Highway Bridge Program and Caltrans standards and requirements for Federal and State funded projects. Dokken Engineering was selected as the most qualified consultant capable of performing the tasks required based on the evaluation criteria set forth in the RFP. To-date, the City and its consultants have completed topographic survey, hydraulic report, environmental permitting, utility relocation plans, geotechnical investigations, design and permitting.
Given the location of the bridge within the historic district, an emphasis was made to consider designs that have the look and feel of original bridges that were located throughout the City in the late 1800’s. Public outreach conducted in 2016 and 2017 included community workshops, presentations to Planning Commission and City Council helped determine consensus on the preferred design. As shown in the attached historic photos, this bridge was originally a steel truss design. The new design developed by public consensus is a ‘hybrid design’ with a reinforced concrete deck and upper steel truss elements which carry the required loads. Rock facing at abutments and weathering steel railings are also being used to provide the historic look with modern materials.
Rights-of-way, utility agreements and final design was approved by Caltrans Local Assistance in 2020.
Funding for construction was delayed between 2020 and 2023 due to the impacted highway bridge program which has a longer list of bridges eligible for funding than there are actual funds available. In January 2023 the City received final approval and authorization to proceed with construction based on the engineers estimate of cost at $6,567,374 (this includes construction management, inspection and contingencies). The project funding consists of 88.6% from the Federal Highway Bridge program, with gas tax and local funds being used for the 11.4% remainder.
As with most grant funds, the City will need to first expend funds, making payments to the contractor based on progress estimates, then seek reimbursement from the State who administers the federal bridge program.
The project will be completed over a two fiscal-year timeframe which will help disperse the amounts being expended.
Project phasing will be used to help minimize traffic impacts to the surrounding neighborhood. In 2023 there will be underground utility work completed, then the project will be winterized. The existing bridge left in place available for traffic until spring 2024. Demolition and replacement of the bridge will occur in spring/summer of 2024 with a detour for access to Nevada Street and Grove Street from Washington Street.
Given the cost of overall scope of the project, City staff is providing this report to inform City Council of the project status and the intent to advertise the project for bidding. Upon receipt of bids, in July 2023 the contract will be presented to city council for approval of the award of contract.
FINANCIAL AND/OR POLICY IMPLICATIONS:
The project will be funded by $5,752,500 in Federal Highway Bridge funds, of which $220,999 has already been expensed, with an 11.4% match, or $747,500, in Measure “M” funds. The City plans on managing cash flow for the project within the adopted budget and CIP processes for Fiscal Years 2023/2024 and 2024/2025. With the largest expenses in 2024/2025 the City’s budget for that year will include a primary funding plan and a contingency funding plan should a short-term loan or other financial instrument be required in the event of an unanticipated occurrence.
STRATEGIC PLAN ALIGNMENT:
This action, reporting on the program, is consistent with the embedded strategic initiative of Engagement:
Community engagement and communications with stakeholders. The project is aligned with the strategic initiative of INFRASTRUCTURE: Parking, Roads, Right-of-Way, and other public and contracted infrastructure.
ENVIRONMENTAL CONSIDERATIONS:

Subject: Consideration of Request from Waste Management Disposal for a Rate Increase and Ancillary Charges Changes as Provided for and Set Forth in its Agreement with the City and Consideration of Resolution No 2023-21: A Resolution of the City Council of the City of Nevada City Approving a Rate Increase for Refuse Service Based on the U.S. City Average Consumer Price Index for All Urban Consumers and
Modifications of Ancillary Charges
From: Sean Grayson, City Manager
Date: May 19, 2023
Reviewed & Approved:
City Manager:
City Attorney:
Recommended Action: Adopt the resolution.
ISSUE STATEMENT AND DISCUSSION:
The current agreement between the City and WM (Waste Management) is dated September 28, 2011 and expires on June 30, 2025. There are provisions in the agreement for an annual cost of living increase on a formula with a basis point being the U.S. City Average Consumer Price Index for all Urban Consumers (CPI). The calculated increase requested to be effective July 1, 2023, is 5.58% for service and 3.99% for disposal. A new rate sheet and detail on the increase are included as attachments in addition to a letter from Waste Management submitting the request. Additionally, WM is requesting ancillary charges to be added to the rate sheet effective July 1, 2023, that do not include a contract CPI escalator, including:
1. Recycle cart service and rates (after three free carts) for commercial customers with trash service (64 and 96 gallons)
2. 10 Yard Roll Off Container Charges to provide an option for smaller service of heavy materials
3. Relocation charges for roll-off bins (currently we only have delivery charges listed in the rate sheet)
4. Adjust the following change in the commercial contamination rate:
Current rate: If recycle bin is more than 5% contaminated, the customer will be charged 100% of the corresponding monthly trash rate for equivalent bin size.
New Rate: If recycle bin is more than 5% contaminated, the customer will be charged at the applicable rate for solid waste. These rates will be the equivalent 1 x week monthly trash rates divided by 4.33. The change in contamination fee will reduce the fines for our customers by approximately 1/4th.
The included resolution would authorize the requested increase. WM representatives will present this item for the City Council’s consideration.
FINANCIAL AND/OR POLICY IMPLICATIONS:
There is no direct financial impact to the City with the adoption of the resolution however the approved rate increases will be billed to WM account holder within the city.

Dear Mr. Grayson,
In accordance with Sections VI.A and VI.B. of our solid waste, recyclables, and green waste franchise agreement, attached are the calculations for our 2023 rate increase and the updated rate sheet effective July 1, 2023.
The adjustment is based on the contractual CPI formula for the 12-month period ending March 31, as calculated in the attached rate package. The 2022 service portion of the rate was adjusted by 5.58% approximately based on CPI and disposal changes.
In accordance with Section VI.D, the disposal portion of the rates is being increased by
3.99% due to the proposed July 1, 2023 rate increase at the transfer station.
The impact on the most common residential rate (35-gallon cart) is an increase of $0.82.

Grass Valley Disposal 13083 Grass Valley Avenue, Grass Valley, CA 95959 May 10, 2023
Mr. Sean Grayson,
City Manager
City of Nevada City
317 Broad Street
Nevada City, CA 95959
Dear Mr. Grayson,
We are requesting the following charges to be added to the rate sheet effective July 1, 2023. The items below are based on requests we have seen come through from our Nevada City customers in the recent past and will add needed services to the city residents.
In addition, we would like to adjust the following change in the commercial contamination rate:
Current rate: If recycle bin is more than 5% contaminated, the customer will be charged 100% of the corresponding monthly trash rate for equivalent bin size.
New Rate: If recycle bin is more than 5% contaminated, the customer will be charged at the applicable rate for solid waste. These rates will be the equivalent 1 x week monthly trash rates divided by 4.33.
The change in contamination fee will reduce the fines for our customers by approx. 1/4th.
Please do not hesitate to contact me or our Public Sector Manager, Shavati Karki-Pearl with any questions at [email protected] or 530-559-1128.
.
Sincerely,
Larry Picard, District Manager

Hello Council,
Happy Pride Month starting June!
I have several concerns with Item 13, Nevada Street Bridge Replacement project.
1. Please plan for the American Dipper nesting by either eliminating their nesting void in the bridge support this fall, or by waiting to remove the bridge until after their nesting season next year. If possible, add new nesting spots in the concrete supports on the new bridge. They nest along this area every year. It is very special to have them right in town and would be nice if we can accommodate their needs.
2. I use this parking lot frequently. It is important to have the two entrances. The design shows just one entrance. This would make it hard to maneuver, especially for larger vehicles. Two driveways also helps create flow through the parking lot, which makes it less likely encampments and drug activities will occur at the upper end.
3. Parking lot aesthetics: Please plan to add trees to planting areas where possible (two are slated for removal), and consider seating to enjoy the creek. It would be lovely to replace the chainlink fence overlooking Deer Creek with something nicer.
Attached is a short video (by Stuey Weills) of the Dipper feeding young. The nest is in a large void in the concrete support.
Thank you for your consideration.
