ISSUE STATEMENT AND DISCUSSION:
Attached is the monthly statistical crime report from July 2023, for the Nevada City Police Department.
Refer to the attached spreadsheet for additional information.
This last month was a busy month for Nevada City Police Department. With the weather warming up, we see people more active in the community, and calls for service increase accordingly. Summer Nights was a very popular event, with large crowds in attendance. I am happy to report that we had a significant and visible presence each night of the event and encountered no major issues on any of the days. The officers also did an excellent job investigating some major vandalism crimes on city property that resulted in suspect identification and arrest. Without a dedicated detective unit, this was accomplished by patrol staff working together while still completing their everyday duties.
Nevada City Police Department will always be available for comments and will notify the council of any concerns.

This action is consistent with the embedded strategic initiative of Engagement: Community engagement and communications with stakeholders.

2023-07: An Ordinance of the City Council of the City of Nevada City, State of California Amending Sections
18.01.060, 17.30.080, 16.04.054, 17.30.020,17.32.020,
17.36.020, 17.40.020, 17.52.020, 17.12.125, 17.80.030,
17.12.090, 17.12.130, and Repealing Section 17.68.025 in Order to Update the City of Nevada City Municipal Code to be Consistent With Goals, Objectives, Polices, and Programs Adopted as Part of the 2019-2027 Housing Element
From: Lisa McCandless, Interim City Planner
Sean Grayson, City Manager
Date: July 31, 2023
Reviewed & Approved:
City Manager:
City Attorney:
Recommended Action: Hold second reading and adopt the ordinance.
ISSUE STATEMENT AND DISCUSSION:
At the July 27, 2023, regular City Council meeting, the City Council introduced Ordinance 2023-07 to amend sections of the municipal code needed to address the City’s adopted 2019-2027 Housing Element.
In March 2022 and 2023 staff presented the Annual Progress Report (APR) to the planning commission and to City Council. The APR is a tool that helps facilitate the implementation of the Housing Element in tracking and monitoring the City's progress. As reported in March, among the Housing Element tasks is a requirement for the city “to update the Municipal Code pursuant to program goals outlined in the Housing Element.” At that time, staff had outlined several “low-hanging-fruit” items to attempt to complete in 2022.
At their December 15, 2022, meeting, the planning commission reviewed ordinance texts amendments as recommended by staff in order to comply with adopted Housing Element tasks. The commission made recommended changes which incorporated in the draft ordinance. At their May 18, 2023, meeting the planning commission conducted a public hearing on the ordinance and voted to recommend that City Council adopt the Ordinance as drafted and attached to this staff report.
PROPOSED MUNICIPAL CODE TEXT AMENDMENTS:
Below is a summary of amendments proposed with the attached draft Ordinance, pursuant to program goals outlined in the Housing Element.
• Omit discretionary review of a tree removal permit in the R3 Zone when a development meets the 16 units per acre density standards.
• Modify Section 16.04.054 of the municipal code to avoid the production of moderate-and above moderate-income housing on R3 Zoned properties.
• Amend applicable chapters to allow transitional and supportive housing to be allowed in all zones that allow residential uses, subject to the same processes and standards applicable to the same type of housing in the same zone, pursuant to SB 2.
• Amend residential district standards (including the Historic District) to allow manufactured homes in all zones allowing single family residences.
• Amend to address employee and farmworker housing provisions of California Health and Safety Code Sections 17021.5 and 17021.6.
FINANCIAL AND/OR POLICY IMPLICATIONS:
There are no financial implications with the adoption of the ordinance. The ordinance changes are consistent with established policy and the adopted Housing Element.
STRATEGIC PLAN ALIGNMENT:
This action is consistent with the strategic initiative of Housing: Workforce and affordable housing, supportive of leasing local, and maintenance of homeowner value.
ENVIRONMENTAL CONSIDERATIONS:
Recommend that the City Council find the project statutorily exempt pursuant to Sections 15274 and 15282(h), and categorically exempt pursuant to Section 15061(b)(3) the California Environmental Quality Act (CEQA) Guidelines.
An Ordinance to make implementing changes as required by the adopted Housing Element is not considered a project under the California Environmental Quality Act (CEQA) per State law.
LEGAL REVIEW:
City Attorney Pucci has reviewed this item and finds that the recommended action complies with the law.

CODE TO BE CONISISTENT WITH GOALS, OBJECTIVES, POLICIES, AND PROGRAMS ADOPTED AS PART OF THE 2019-2027 HOUSING ELEMENT
WHEREAS, the City of Nevada City, California ("City") is a municipal corporation, duly organized under the constitution and laws of the State of California; and WHEREAS, the City Council of the City of Nevada City adopted the 2019-2027 Housing Element at their special meeting held November 6, 2019; and
WHEREAS, the California Department of Housing and Community Development (HCD) issued a letter to the City dated December 5, 2019, certifying that the 2019-2027 Housing Element update is in full compliance with State Law (Article 10.6 of the Government Code); and WHEREAS, the proposed ordinance text amendments make changes to the City Municipal Code in a manner that is consistent with adopted goals, objectives, policies, and programs of the 2019-2027 Housing Element update, necessary to remain in conformance with state law; and WHEREAS, the recommended actions do not constitute a “project” under CEQA, because implementation of State-mandated zoning changes are not discretionary acts; and WHEREAS, a duly noticed Public Hearing was held by the City of Nevada City Planning Commission on December 15, 2022 and May 18, 2023 to hear the proposed ordinance and all interested persons were given an opportunity to be heard at both meetings after which the Planning Commission recommend adoption of the ordinance by the City Council.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF NEVADA CITY DOES ORDAIN AS FOLLOWS (modified text is underlined):

b. Applicable mitigation measures may be included with the approval as provided for in Section 18.01.070.
c. The city planner's signature plus that of one (1) additional authorized staff member is required on all approval forms.
d. No discretionary review shall be required for tree removal associated with a multi-family development project located within an R3 zoning designation when the proposed project is consistent with the 16 units per acre density standard.

If the subdivision map creates two (2) or fewer new lots, none of the new lots shall be limited as set forth above. For maps creating three (3) or more new lots, the number of lots to be limited as set forth above shall be determined by multiplying 0.3 times the number of new lots created and then rounded up or down based on the common mathematical convention. For example, a map creating nine (9) new lots would be required to designate three (3) lots to be limited as set forth above since the number reached per the above formula would be 2.7 which would be rounded up to 3. Inaddition to designating such lots on the map, the subdivider shall record a deed restriction on each lot informing any potential owner of the lot of the size limitations of the home that can be constructed.
Thirty (30) percent of all homes located in new subdivisions shall be one thousand five hundred (1,500) square feet or smaller. These homes shall be affordable to below moderate-income households. This shall be accomplished through deed restrictions or through an affordable housing plan that includes below moderate-income housing opportunities accomplished through a variety of mechanisms including, but not limited to, size restrictions, rental units, second units, etc. The plan shall be approved by the planning commission and/or city council.

17.68.080 of Chapter 17.68 (“COMBINING DISTRICT
REGULATIONS”) and Section 17.80.190 of Chapter 17.80
(“DEVELOPMENT PERFORMANCE STANDARDS”) both
of Title 17 (“ZONING”) of the City of Nevada City Municipal Code, Relating to the Lighting of Signs.

Recommended Action: Hold first reading, waive reading of Ordinance in its entirety, read by title only, and schedule for second reading and adoption for August 23, 2023.
ISSUE STATEMENT AND DISCUSSION:
In April of 2023 the City Council authorized staff to explore the development of a Dark Sky compliant ordinance working with the Planning Commission. In reviewing the work needed for the future ordinance creation an issue was identified within the language of the City’s municipal code with regard to the lighting of signs. It has been long accepted that “internally illuminated” signs are not permitted within the City. The language within the sign sections for both the historical district (17.68.080) and the remainder of the City (17.80.190) does not adequately articulate the long-accepted prohibition. The draft ordinance update is crafted to address this specific issue. It is anticipated that the future Dark Sky ordinance may further amend portions of the municipal code including the sign sections; the proposed ordinance is not anticipated to be in conflict with any such future change.
The Ordinance as drafted adds one additional clause to each of the two sections that reads, “Internally illuminated signs and digital or electronic signs of all types are prohibited.” The remaining requirements of the two sections are unchanged. Effectively the addition of this clause in both sections prohibits internally illuminated signs, regardless of their source or type of illumination, within all of the City.
The Planning Commission conducted a public hearing on July 20, 2023, on the draft ordinance and recommended its adoption by the City Council.
FINANCIAL AND/OR POLICY IMPLICATIONS:
There are no financial implications with the adoption of the ordinance. The ordinance changes are consistent with established policy and the adopted Housing Element.
STRATEGIC PLAN ALIGNMENT:
This action is consistent with the embedded strategic initiative of Engagement: Community engagement and communications with stakeholders. The action is aligned with the strategic initiative of Business:
Business, industry, and cannabis support.
ENVIRONMENTAL CONSIDERATIONS:
The subject ordinance is not subject to the California Environmental Quality Act (“CEQA”) because the adoption of this ordinance is not a project, as defined by CEQA, but is instead an administrative action per California Code of Regulations, Title 14, section 15378(b)(2), and merely amends the regulatory process for sign applications.
LEGAL REVIEW:
City Attorney Pucci has reviewed this item and finds that the recommended action complies with the law.

CITY COUNCIL STAFF REPORT
MEETING OF: August 9, 2023 Agenda Item No. 08
Subject: Provide Direction on a Framework for Establishing a Public Arts Commission.
From: Sean Grayson, City Manager
Date: July 31, 2023
Reviewed & Approved:
City Manager:
City Attorney:
Recommended Action: Provide direction for future consideration of an ordinance.
ISSUE STATEMENT AND DISCUSSION:
One of the strategic initiatives within the City’s 2022-2027 Strategic Plan is Vibrancy: Arts, Culture, & Distinction. Goal #2 of that strategic initiative is, “Develop a public art process including an enabling ordinance”. At the July 27, 2023, regular City Council meeting, the City Council adopted Ordinance 2023- 06 to add a section to the municipal code relating to public art requirements. Goal #6 of the vibrancy strategic initiative is, “Evaluate the timing, formation, and mission of a Nevada City Arts Commission”. At the July 27, 2023, City Council meeting, the Council provided direction to ensure the delivery of a Public Arts Commission.
Some Art Commissions are established by Resolution of the Council (e.g. the Town of Truckee), while most are established by Ordinance. Assuming the City Council desires to assign the Art Review Authority established in the Public Art Ordinance to the Public Art Commission staff recommends establishing the Commission by ordinance. Staff seeks the direction of the City Council on the overall powers and duties of the Commission (its roles, responsibilities, and authorities) as these are these factors drive the overall ordinance. The ordinance should all of the powers and duties the City Council wishes to assign or delegate to the Commission but can be amended with future ordinance changes as needed. Staff will recommend that the City Council provide direction on a workplan for the Commission in each budget year. The following is a listing of powers and duties that could be considered by the City Council to place within the Commission’s purview that are common among cities with Arts Commissions:
• Serve as the Art Review Authority as defined by the City’s Public Art Ordinance. • To review and make recommendations to the City Council or City Manager for the allocation of City funds for arts and culture in the City.
• Advise the City Council on all matters affecting arts in the City. • Give recognition to, and maintain an inventory of, Artwork in the public view when reasonably feasible. • Advise and assist private property owners who desire such advice and assistance regarding the selection and installation of artwork to be located on their private property in the public view. • Create, review and, update a Public Art Master Plan.
• Review and make recommendations to the City Council or City Manager concerning the acquisition by the City of any work of art, or item of cultural significance, and the proposed location thereof. • To review and make recommendations to the City Council or City Manager for the establishment or termination of any City art programming.
• To review and make recommendations to the City Council or City Manager for the establishment or termination of programs memorializing or giving recognition to matters of cultural significance in the City.
• To review and make recommendations to the City Council or City Manager concerning the removal, relocation, maintenance, or alteration of existing works of art or items of cultural significance in the possession of the City.
• Upon request, to advise the City Council and other City boards, commissions, or committees regarding any matter affecting the beauty and culture of the City. • Liaise with internal and external stakeholders to facilitate communication and cooperation among the various groups involved arts and culture with the City, County and region. • Recommend needed changes in laws, legislation, and policies needed to promote the aesthetic, cultural development and historical preservation of the City.
• Coordinate the process and make recommendations to the City Council on the appointment of a Nevada City Poet Laureate who provides a focus for the appreciation and dissemination of poetry in the City, promotes the appreciation and knowledge of poetry among our youth, and acts as a spokesperson for the growing number of poets and writers in the City.
• Coordinate the process and make recommendations to the City Council on the appointment of Nevada City Artists in Residence within various disciplines who provide a focus for the appreciation and dissemination of their discipline of art in the City.
Staff also seeks the direction of the City Council on various considerations for the ordinance shown below:
Composition:
The Commission can be comprised of members in a variety of configurations. The Commission can have City Council appointed members in the same fashion as the Planning Commission. The Commission can have members appointed through an external stakeholder body with approval of the City Council (e.g. an Art’s Council representative, a Historical Society representative, etc.). The Commission can have a youth commissioner. The Commission can be assembled in any configuration of the above but should have an odd number of voting members.
Organization:
Following the established practice of the Planning Commission, the Public Art Commission should use a chair and vice chair configuration with positions established by vote of the commissioners each July aligning with the City Council reorganization.
Meetings:
The ordinance should establish that the Commission is subject to the Brown Act and can have regular and special meetings in the same fashion as the City Council or Planning Commission.
Qualifications:
Current City rules require that members of any commission be residents of the City. The City Council may change these requirements by amending the rules or establishing any specific requirements in the ordinance.
The City Council may require specific skills or background of commissioners or may elect to not have preestablished requirements in the same fashion as the Planning Commission.
Term of Office:
The term of office is at the discretion of the City Council. Current City rules would have commissioners appointed by individual City Council members serve a term that matches the appointing City Council Member. Current City rules would have a two-year term for commissioners appointed by the full City Council.
Vacancies:
Under current City rules vacancies would be filled in the same fashion as the appointment of the person who created the vacancy.
Referral of Matters to the Commission:
In addition to the powers and duties established, there should be a mechanism for the City Council and/or City Manager to refer items for review and recommendation by the Commission as needed.
Process to Establish the Commission
With input from the City Council, staff will develop an adoptable ordinance for consideration of the City Council in September of 2023. If the ordinance is approved at the September 13, 2023, meeting and adopted at the September 27, 2023, meeting, it will go into effect on October 27, 2023. The City Council could solicit applications for the Commission in November of 2023 and seek to appoint commissioners at the December 14, 2023, regular City Council meeting with the first commission meeting scheduled in January of 2024.
FINANCIAL AND/OR POLICY IMPLICATIONS:
None.
STRATEGIC PLAN ALIGNMENT:
This action is consistent with the strategic initiative of Vibrancy: Arts, Culture, & Distinction. Specifically, this action addresses, in part, Goal #6 of the vibrancy strategic initiative, “Evaluate the timing, formation, and mission of a Nevada City Arts Commission”.
ENVIRONMENTAL CONSIDERATIONS:
None.

CITY COUNCIL STAFF REPORT
MEETING OF: August 9, 2023 Agenda Item No. 09
Subject: Consideration of Award of Contract with Golden State Bridge Inc. in an Amount Not-To-Exceed $7,685,504.40 for Nevada Street Bridge Replacement; Authorize a Project Contingency of 10%, Not-To-Exceed $768,550; and Authorize the City Manager to Execute any Contracts or Related
Documents.
From: Bryan McAlister, City Engineer
Date: August 3, 2023

City Manager: STG
City Attorney:
Recommended Action: Award the contract, authorize the contingency, and authorize the City Manager to execute related documents.
ISSUE STATEMENT AND DISCUSSION:
The City of Nevada City advertised and procured bids for the Nevada Street Bridge Replacement Project No. BRLS-5018(012). The project was advertised on May 31, 2023, at local bidder exchange websites, on the City’s website and with a Union newspaper advertisement. Eight (8) prime bridge contractors attended the pre-bid meeting on June 20, 2023, and/or requested to be added to the planholders list. Three (3) bids were received and opened on July 18th, 2023.
The project consists of the replacement of the existing bridge on Nevada Street over Deer Creek. The project is located at the south end of Nevada Street, near Broad Street in Nevada City, CA. The bridge has been programmed for replacement as a result of routine bridge inspections conducted by Caltrans and Federal Highway Administration (FHWA) which identified numerous deficiencies. The existing bridge is a 34-ft wide, 61-ft long, two-span steel girder bridge constructed in 1938. The existing bridge has two lanes with sidewalk on both sides. The bridge is located within Nevada City Downtown Historic District which is listed on the National Register of Historic Places. A bridge was originally constructed at this location in the 1860’s and later reconstructed in 1938. The City plans to reconstruct the bridge using natural rock walls (and/or rock facing) and aesthetic railings to closely match the original 1860’s bridge but with structural elements that meet current bridge standards. The proposed bridge will be an approximately 42-ft wide, 68- ft span with a 30-degree skew angle. The proposed skew will be used to improve roadway approaches.
The project also requires utility relocations of sewer, water, electric and telephone.
Project phasing will be used to help minimize traffic impacts to the surrounding neighborhood.
Underground utility work within City streets is expected to commence in January 2024. The existing bridge will be left in place available for traffic until March 2024. During demolition and replacement of the bridge, from March thru November 2024, there will be a detour for access to Nevada Street and Grove Street from Washington Street.
Funding for bridge replacement was obtained through the Federal Highway Bridge Program administered by Caltrans. In January 2023 the City received final approval and authorization to proceed with construction based on the engineers estimate of cost at $6,567,374 (this includes construction management, inspection and contingencies). The project funding consists of 88.5% from the Federal Highway Bridge program, with gas tax and local funds being used for the 11.5% remainder. City staff has contacted Caltrans local assistance to verify the process for requesting additional funds based on final bid amounts and contingencies. This process involves 1) award of contract by the City; 2) submittal of award package to Caltrans for review; and 3) allocation amendment for federal funds.
City staff procured bids for the Nevada Street Bridge Replacement Project No. BRLS-5018(012) as advertised. Bids were received, as follows:
Base Bid Base Bid +ALT A
Viking Construction Co., Rancho Cordova CA $ 8,991,062.00 $ 9,719,402.00 Golden State Bridge Inc., Benicia CA $ 7,685,504.40 $ 7,961,634.40 Myers & Sons Constr., Sacramento CA $ 8,952,145.00 $ 9,189,000.00 Golden State Bridge Inc. was selected as the lowest responsive and responsible bidder.
Alt A is for railing replacement on the adjacent bridge at Broad Street over Deer Creek and is not eligible for federal participation. Due to limitations on funding and since ALT A would be 100% cost by the City, staff recommends award of Base Bid only.
FINANCIAL AND/OR POLICY IMPLICATIONS:
The project will be funded by $6,657,561 plus $665,756 in contingencies by Federal Highway Bridge funds which is 88.5% of participating costs. Non-participating costs and 11.5% match will be funded as follows:
Measure M FY 23/24 $290,700.00
Measure M FY24/25 $400,000.00
Water Distribution FY23/24 $ 75,000.00
Water Distribution FY24/25 $ 75,000.00
Sewer Collection FY23/24 $ 75,000.00
Sewer Collection FY24/25 $ 75,000.00
Local Transportation Fund FY24/25, Ped & Bike $ 50,000.00 Regional Surface Transportation Program FY24/25 $ 90,000.00 Note that this is a two-year project and FY24/25 funds are budgetary, to be determined at time of annual budget adoption. The City plans on managing cash flow for the project within the adopted budget and CIP processes for Fiscal Years 2023/2024 and 2024/2025. With the largest expenses in 2024/2025 the City’s budget for that year will include a primary funding plan and a contingency funding plan should a short-term loan or other financial instrument be required in the event of an unanticipated occurrence.
STRATEGIC PLAN ALIGNMENT:
This action, reporting on the program, is consistent with the embedded strategic initiative of Engagement:
Community engagement and communications with stakeholders. The project is aligned with the strategic initiative of INFRASTRUCTURE: Parking, Roads, Right-of-Way, and other public and contracted infrastructure.
ENVIRONMENTAL CONSIDERATIONS:
None with the award of the contract. The construction activities are subject to the environmental conditions and actions identified in the overall project.

Happy Fair Week Council,
I know you are very concerned with aesthetics in the historic downtown, even going so far as prohibiting permanent public art because it is somehow detrimental, so I am very puzzled why extensive graffiti is left on the most historic City buildings for over a month now. I know the City can move fast on these things, given the temporary river painted on Commercial was painted over by Public Works in less than a week.
Item 7: There is a typo in the ordinance, referring to the wrong section of code: it says “.090” instead of “.080.” I was curious how the prohibition on illuminated signs might affect businesses that sell antique lighted signs or businesses that have illuminated merchandise with words or symbols in them. Would merchants be prohibited from illuminating them?
In my opinion, the City should not interfere with what is displayed in the shop windows unless it actually creates so much light it will interfere with Dark Skies. Part of the essential creativity and individuality of Nevada City is how shops use their window displays. All this interference and design by committee will create a “cute” yet boring town.
