DATE 09/08/2022
TO Honorable Mayor and City Council Members
FROM Michelle Villanueva, Senior Accountant
SUBJECT Public hearing to adopt a resolution amending the Master Fee Schedule for Fiscal Year 2023
SUMMARY AND RECOMMENDATION
Staff recommends that the City Council, by resolution, approve an amendment to the Master Fee Schedule (MFS) for Fiscal Year 2023 to reflect updated fees. On May 26, 2022, the Council approved the FY 2023 Master Fee Schedule. After approval, it was discovered that some of the proposed updates to the Building Inspection section were inadvertently omitted. The Master Fee Schedule has been updated and any approved changes would take effect on October 1, 2022.
BACKGROUND
Staff annually reviews and analyzes rates and charges for providing City services and incorporates these rates into the City’s Master Fee Schedule (MFS). Staff recommends certain changes to the MFS for Fiscal Year 2023 to include updates that were inadvertently omitted when the MFS was approved by the City Council on May 26, 2022.
DISCUSSION/ANALYSIS
The proposed updated fees are all within the Building Inspection Division and range from permit application fees to plan check deposits to building permits. A summary of the additional changes is attached to this report as Exhibit A and a complete MFS is also included as Exhibit B.
Staff recommends that the Council, by resolution, amend only the Building Inspection section of the MFS. The sections amended by Council will then be editorially merged with the unchanged portions of the MFS as last amended by the City Council in Resolution No. 11354 on May 26, 2022.
FISCAL IMPACT
Fees collected reflect the cost of services provided by the City and are placed into the appropriate budget accounts.

Revenue & Cost Specialists ( RCS) is providing the City of Newark with a study identifying a comparison of fees to recover costs associated with the City' s nine EV charging stations located at City Hall.
In summary, staff recommends making the EV Charging Stations available to the public on a first -come, first served basis, with a charging fee of $0. 25 per kWh until the vehicle is fully charged. Once the vehicle is fully charged, the owner has a 30- minute grace period to vacate the spot, and allow others to use the charging station. RCS recommends a parking fee of $2. 50 per 30 minutes to apply on the 315t minute after full charge, not to exceed $ 25.
The $ 0. 25 per kWh charging fee, along with any collected parking fee, would fully recover the variable costs associated with the electricity, and possibly cover all fixed costs. The $ 0. 25 per kWh charging fee should increase along with any PG& E price increases annually.
BACKGROUND
The City of Newark is currently providing residents and visitors access to free Electric Vehicle charging at ChargePoint charging stations installed at Newark City Hall. There are a total of nine charging plugs, from four stations with dual plugs and one station with a single plug. General Funds were used to pay for and install these charging stations at the price of $32, 268. 75.
The City entered into an agreement with ChargePoint to purchase their equipment and have their certified technicians install the equipment, activate and configure the stations for connectivity to necessary cloud and network accounts. ChargePoint is the largest electric vehicle ( EV) charging network in the US, with more than 22, 000 charging locations throughout the country. Newark staff performs minimal account administration, oversight, and inspection of the charging stations. The City did not incur any additional direct costs.
DISCUSSION
City Costs
ChargePoint offers an annual maintenance program, called ChargePoint Assure, which provides remote monitoring, proactive troubleshooting, onsite repairs, and a station uptime guarantee. The cost for ChargePoint Assure, plus their required Commercial Cloud Plan, is $ 500 per year, per station, if prepaid for five years. The maintenance cost for the five charging stations would be $ 2, 500 per year or $12, 500 for five years.
Based on the data from Pacific Gas and Electric Company, the average monthly operational unit cost for all City owned charging stations is about $ 0. 225 per kilowatt. Below is the data used to calculate the City's average electricity per kWh rate.

Below is the data for the City' s EV charging stations.

EV- 9 813 183 61
Total 6, 274 kWh 1, 412 471
Average 697 kWh per plug 157 52
Taking the average 697 kWh per station, and dividing it by 90 days ( Jan -March) would result in 7. 75 kWh of use, per day, per station. The ChargePoint Level 2 Commercial Charging Stations can provide up to 12. 9 kilowatts of power each hour, so basically each EV plug is being used for less than one hour per day.
An owner connecting and charging their EV vehicle at the Level 2 station for one hour currently costs the City $2. 90 and provides the driver with 70 miles of travel.
Since the City's EV charging location has only been active for several months. including the City' s fixed costs into the per kilowatt" rate is not recommended. If we assume the annual fixed costs are $ 2, 500 for ChargePoint, plus $ 1, 000 for five hours of staff time at the fully burdened hourly rate, then the fixed costs would be $ 3, 500 per year, or slightly under $ 300 per month. The $ 300 monthly fixed cost is 64% of the monthly electricity cost of $471, and the City would have to increase the EV charging fee from $0. 225/ kWh to $0. 37/ kWh to recover both fixed and variable costs.
If data at year- end shows higher usage of the charging stations, then the fixed cost would be spread out more, lowering the per kilowatt rate. It is suggested that the City capture at least one to two years of utilization before including the fixed costs and recommend an updated charging fee.
Below are the assumptions used to develop the 100% cost recovery fee. The cost recovery estimates are based on assumptions derived from the current use of the existing chargers in Newark and anticipated changes to the use of the chargers once this fee goes into effect.

Comparing Charging Locations
Revenue & Cost Specialists ( RCS) is providing the City of Newark with a study identifying a comparison. RCS researched online to identify EV charging locations within the City, and those of nearby cities. These charging locations, times of operations, number of operating plugs, and their charging rates frequently change. Therefore, the table below is high- level snapshot that provides the City with some varying fee structures.
Newark Based Charging EV Charging Fee

Surrounding Cities EV Charging Fee
City of Hayward 1 per hour
City of Milpitas Free for first 4 hours, then $2 per hour and $0. 16 kWH City of San Leandro 1. 50 per hour
City of Union City 1. 35 per hour
RCS recommends a " per kilowatt hour" fee over the " per hour" fee because electric vehicles chargeg at di fferent rates.
Charging for the amount of kWh a vehicle absorbs is more accurate than charging for the amount of time the vehicle is connected to a charger.
Pricing and Demand
Currently, there are 22, 600 charging plugs in California, and more than 210, 000 EVs registered to Bay Area drivers.
Many EV car users use EV charging websites and mobile apps to find charging locations that are free or convenient.
With the high prices of gasoline, there will be a higher demand for EV vehicles. The ALoft Hotel, mentioned above, provides free charging and parking, and online comments show their two EV plugs are constantly in use. NewPark Mall offering free charging is another high -demand location for EV charging and is used all the time.
The commercial building at 3900 NewPark Mall Rd, located next to the NewPark Mall, provides 10 plugs, with each charging $0. 45/ kWh. However, you can see in the image, that the high rate leads to low utilization. PlugShare, an online EV charging locator, confirms its low utilization.
Immediately surrounding the Newark City Hall charging location are the Newark Library, Civic Center Park, Civic Terrace Condominiums, and various businesses. Within a 5- 10 minute walk are the Newark Pavilion, Old Town Shopping Center, various religious organizations, and more residential properties, shops, and businesses. At the same time, there are no competing EV charging locations within a'/ z mile radius ( equivalent to a 10- minute walk).
Based on the RCS finding, staff believes that the demand for the City Hall EV Charging station will continue to increase from current levels. How much usage will be in the future is dependent on socio- economic factors and City policies.
EV Charging Use Polices
The City of Newark could discuss EV Charging Fees and policies that have been implemented in other communities.
Some municipalities offer free charging, or a very low charge fee to incentivize EV vehicle usage. Some municipalities may not have a charging fee because the equipment was grant -funded, or the community believes electricity is a cost already paid by taxpayers. There were a few municipalities that offered free parking for vehicles with an active Clean Air Vehicle decal.
The City could allow free charging to city employees as a strategy to attract and retain employees. Finally, cities can promote more residential purchases of EV vehicles, by removing the parking fee ( applied after fully charging), for vehicles parked and charging overnight. This would allow nearby residents who don' t have a garage or driveway with a nearby electrical outlet to park their EV vehicle.
CONCLUSION AND RECOMMENDATION
With the number of EV and plug- in hybrid ownership growing, the demand for EV charging locations is also increasing. The City of Newark' s nine charging plugs help serve this demand, and establishing a charging fee will help recover costs borne by the City. In addition to the charging fee, a parking fee will encourage turnover of the parking space, allowing other EV owners to use it. These charging and parking fees should be monitored over the next year to determine if the fee is set at the appropriate level.
In summary, staff recommends making the EV Charging Stations available to the public on a first -come, first -served basis, with a charging fee of $0. 25 per kWh until the vehicle is fully charged. Once the vehicle is fully charged, the owner has a 30- minute grace period to vacate the spot and allow others to use the charging station. Based on the comparison report from RCS, staff also recommends a parking fee of $2. 50 per 30 minutes to apply on the 315t minute after full charge, not to exceed $ 25.
The $ 0. 25 per kWh charging fee, along with any collected parking fee, would fully recover the variable costs associated with the electricity, and possibly cover all fixed costs. The $ 0.25 per kWh charging fee should increase along with any PG& E price increases annually.
